Recommendation
By Minute Motion, that the Housing Authority Board,
1) Approve Change Order No. 1 to Contract No. HA33070 in the amount of
$6,535.00 for the pond demolition and landscape improvement at One Quail
Place;
2) Authorize the Director of Finance to transfer $6,535.00 from contingency to base;
and
3) Authorize the Executive Director and/or the Chairman to execute Change Order
No. 1 and any documents necessary to effectuate the actions taken herewith.
Monies have been included in the FY 2014/2015 proposed Palm Desert Housing
Authority's Replacement Expense budget for One Quail Place, in the appropriate
Authority accounts.
Housinq Commission Recommendation
The Housing Commission reviewed the recommendation at its regular meeting of June 10,
2015. Staff will provide a verbal report upon request.
Backqround
On March 12, 2015, the Palm Desert Housing Authority Board authorized the award of Contract
No. HA33070 to Liberty Landscape, Inc. ("Liberty") for the removal of nine of the ten water
feature ponds located throughout One Quail Place including landscape improvements. The
Notice to Proceed was issued on April 21, 2015. Removal efforts are progressing well and to
the satisfaction of staff and management.

In the process of completing the contracted scope of work, Liberty discovered that there was a
need for additional work at each of the nine (9) pond locations. Liberty is recommending that
the opposite side of the bridges to be filled in order to eliminate one side drop off where the
ponds were removed.
Change Order No. 1 incorporates the recommended landscape improvements and materials.
Costs for the additional work and materials are $6,535.00. Staff and management believe that
Change Order No. 1 with the proposed changes represents a fair value for the changed scope
of work. Liberty has the ability to complete this work as part of the current contract work. It is
expected that the original contract work as well as the changed scope of work will be completed
by the end of June 2015.
Staff agrees and recommends acceptance of the proposed additional improvements as Change
Order No. 1, to prevent fall hazards.
Fiscal Analvsis
The fiscal impact is the cost of Change Order No. 1 which will be paid from the Housing
Authority's Replacement Reserve Fund. The funding for these changes is available in the
project contingency and requires a transfer of contingency to base.

This Contract Amendment covers changes to the subject contract as described herein. The consultant shall perform
all work, furnish equipment and materials as necessary or required to complete the Change Order items for a lump
sum price agreed upon between the Contractor and the Palm Desert Housing Authority, otherwise referred to as
Owner.
Contract Time Extension -0- Days.
Revised Contract Total $255,519.00.
The undersigned Consultant approves the foregoing Change Order# 1 as to the changes, if any, in the contract price
specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in
work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Change
Order# 1. The Consultant agrees to furnish all labor and materials and perform all other necessary work, inclusive of
that directly or indirectly related to the approved time extension, required to complete the Contract Amendment items.
This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the
Contract Amendment shall be effective when approved by the Owner.
Execution of this Contract Amendment by the Consultant constitutes a binding accord and satisfaction that fully
satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity,
arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not
limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well
as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
