Monies have been included in the FY 2014/2015 Palm Desert Housing Authority's Replacement Expense budget for One Quail Place. Housing Commission Recommendation The Housing Commission reviewed the recommendation at its regular meeting of March 11, 2015. Staffwill provide a verbal report upon request. Staff Report Award a Contract No. HA33070 for Pond Demo and Landscape Improvements OQP March 12, 2015 Page 2 of 3 Executive SummarY One Quail Place currently has ten water feature ponds located throughout the property. Their current condition requires additional monthly costs to manage the algae growth, reduce insect breeding, balance the water chemistry, and maintain the existing pumps. The service provider has also recommended converting the ponds to chlorinated systems to keep the water conditions consistent. Both the Housing Commission and the Authority Board authorized the removal of nine of the ten ponds. We went out to bid and even though there was considerable interest we received only two bids. Staff recommends awarding the contract to Liberty Landscaping, Inc. for the removal of the ponds to reduce ongoing operational costs at One Quail Place. Background In 2013 both the Housing Commission and the Authority Board authorized the removal of nine of the ten ponds at One Quail Place. The rising costs for maintenance and water usage being the primary reasons for the removal. Staff went out to bid then but determined that the bids did not include the level of detail that was necessary to award a contract at that time. In 2014, staff entered into professional services agreement with Ray Lopez and Associates to prepare specifications to remove the nine ponds and prepare a landscape design for each of the removal areas. Upon approval by CVWD of the plans that included the changes to water usage, staff requested bids for the demolition of nine of the ten water feature ponds at One Quail Place and replacement landscape improvements. The bids include complete removal of the concrete ponds, salvaging any usable equipment, replacement landscape as well as a community gathering area in one of the larger spaces. Irwindale, CA $353,926.10 Liberty is our current landscape maintenance provider and performed their work satisfactorily. By having Liberty complete this work it will also allow the same provider to monitor and maintain the plants for the establishment period of 90 days, which in the past has been difficult when there are two providers of the services. WITNESSETH RECITALS: CONTRACTOR has submitted to AUTHORITY its Contractor's Bid for the construction of AUTHORITY Project, 1. POND DEMOLITION/LANDSCAPE IMPROVEMENTS AT ONE QUAIL PLACE, CONTRACT NO. HA 33070, in strict accordance with the Contract Documents identified below, AUTHORITY has accepted said Bid. 2. CONTRACTOR states that it has re-examined its CONTRACTOR'S Bid and found it to be correct, has ascertained that its Subcontractors are properly licensed and possess the requisite skill and forces, has examined the site and Contract in accordance with the Contract Documents for the money set forth in its Bid to be paid as provided in the Contract Documents. AGREEMENT: IT IS AGREED BY THE PARTIES AS FOLLOWS: 1. Contract Documents: The entire contract consists of the following: (a) The Agreement; (b) The Notice Inviting Bids; (c) The Instruction to Bidders; (d) The Contractor's Bid; (e) The Bidder's Bond; (fl The Performance Bond; (g) The Payment Bond; (h) The General Specifications; (i) The Special Provisions; (j) The Standard Specifications as modified in other portions of the Contract Documents; (k) The Plans; (I) Addenda Nos. 1, 2 and 3; (m) Any Change Orders issued; (n) Any additional or supplemental specifications, notices, instructions and drawings issued in accordance with the provisions of the Contract Documents. Throughout this Agreement and Contract Documents, the term "Agreement" shall also mean "Contract". 2. Contractor shall commence the work within ten calendar days after the date of the Notice to Proceed and wi11 do all things necessary to construct the work generally described in Recital No. 1 in accordance with the Contract Documents and will complete said work within 90 Calendar Days from the Notice to Proceed date to the satisfaction of the Authority. Any and all liability, claims, damages, losses or injuries to any person or other entity, including injury to Contractor's employees, and all claims which arise from or are connected with the negligent performance of or failure to perform the work or other obligations of this Agreement, or which are caused or which are claimed to be caused by the negligent or intentional acts or omissions of Contractor, its subcontractors, its agents or employees, and all expenses of investigating and defending against same. b. Any and all liability, claims, damages, losses or injuries to any and all contractors, subcontractors, material-men, laborers, or any other person, firm or corporation furnishing or supplying work, services, materials or supplies in connection with the performance of the Agreement. c. Attention is directed to the General Specifications - Claims, Liability, and Indemnity Agreement/Hold Harmless sections, which specifications are made part of this Agreement as set forth in Agreement paragraph 1, above. d. Attention is directed to Section 6-9, "Liquidated Damages" of the Standard Specifications and is hereby amended to substitute the "PALM DESERT HOUSING AUTHORITY" in place of "Agency." Liquidated damages shall be 500.00 dollars per calendar day of delay. 4. Should any litigation or arbitration be commenced between the parties concerning the works of improvements as referenced herein, the prevailing party in any such litigation, being the AUTHORITY or the Contractor, should be entitled to a reasonable sum for attorney's fees incurred in any such litigation relating to this Contract. 5. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 6. Contractor shall be paid in the manner set forth in the Contract Documents the amount of its Bid ($248,984 plus 10% contingency-contingency requires additional approvan as accepted by AUTHORITY, subject to such additions and deductions as may be made pursuant to the Contact Documents and applicable law. Satisfactor�r Performance: The prime Contractor agrees to pay each Subcontractor under this prime contract for satisfactory performance of its contract no later than 10 days from the receipt of each payment the prime Contractor receives from PALM DESERT HOUSING AUTHORITY. Any delay or postponement of payment from the above referenced time frame may occur only for good cause following written approval of the PALM DESERT HOUSING AUTHORITY. Page2of4 Contract No. HA 33070 Release of Retention: The prime Contractor agrees further to release retention payments to each Subcontractor within 30 days after the Subcontractor's work is satisfactorily completed. Any delay or postponement of payment from the above referenced time frame may occur only for good cause following written approval of the PALM DESERT HOUSING AUTHORITY. 7. Execution of the Agreement by the parties constitutes their agreement to abide by all applicable provisions of the California Labor Code; constitutes contractor's certification that he is aware of the provisions of said Code and will comply with them; and further constitutes Contractor's certification as follows: "I am aware of the provisions of Section 3700 of the California Labor Code which requires every employer to be insured against liability for worker's compensation or to undertake self insurance in accordance with the provisions of that Code, and I will comply with such provisions before commencing the performance of the work of this contract." Before final pavment will be made, all surplus material (except as noted in the Plans and Specifications), false work, temporary structures, debris and similar discarded materials resultinq from the proiect are to be removed from the site and the site put back in an orderlv condition. As noted in the Plans and Specifications, it is required that at the end of each work day all passageways shall be free from obstructions and the site itself will be kept clean from debris. 2. Sheets L-4, L-5 � L-6 under NOTES #1, Task 'A' state that the ponds and stream beds, after removal, shall be filled with 'Clean Fill' (a.k.a. clean fill dirt) and brouqht level with existinq adiacent prade or 2" below adiacent sidewalk / patio. For biddinq purposes, it is estimated that +/-535 cubic vards of"clean fitl dirt " will be required. This is based on 7,200 square feet of pond areas that are approx. 2 feet deep• If these or any estimations differ significantly from those identified in the Contract Documents and/or Plans and Specifications, such information will be provided in writing to the Authority by the Bidder immediately and prior to the bid opening deadline. If, upon notice to the Authority by Bidder, it is substantiated that such differences will affect the bid pricing, an addendum will be issued. If, in the opinion of the Authority, there is no affect to bid pricing, then such adjustment in estimations is considered to be part of the lump sum bid as submitted and no additional compensation will be considered.
