Recommendation
By Minute Motion:
1. Accept the work as complete for the Carlos Ortega Villas offsite
improvements (Project No. 825-11); and
2. Authorize the Chairman to sign the Certificate of Substantial Completion for
the offsite improvements.
Commission Recommendation
The Housing Commission reviewed the recommendation at the regularly scheduled meeting of
September 9, 2015. Staff will provide a verbal report upon request of the Authority Board.
Backqround
On July 10, 2014, the Authority Board authorized award of the contract for construction of the
Carlos Ortega Villas to Optimus Construction, Inc. The Notice to Proceed was issued on
September 4, 2014. On April 9, 2015, Change Order No. 9 was authorized for construction of
an offsite parking lot to compensate for the lost parking due to the new roundabout.
The contractor completed the offsite improvements on Avenue of the States, including the new
parking lot, during the summer months to minimize the impact to the community. The
intersection of California Drive, Michigan Drive, and Avenue of the States was scheduled to be
closed for eight weeks, but the contractor was able to complete all the improvements in seven
weeks and opened the intersection one week early.
Staff has inspected the work performed by the contractor and has found said work to be
complete and in accordance with the contract requirements. The Palm Desert Country Club
Association has also inspected the work and found it to be complete.

This Certificate of Substantial Completion establishes the date of commencement of all
warranties and guarantees required by the Contract Documents for this scope of work. The
document also establishes when construction is sufficiently complete so the Owner may occupy
the Work, or designated portion thereof, for the use for which it is intended.
Therefore, staff recommends that the Authority accept the specified work as complete and
authorize the Chairman to execute the Certificate of Substantial Completion for the subject
project.
Fiscal Analvsis
There is no fiscai impact associated with this action.

Palrn Desert E[ousing Authority who has hereby established the Date of Substantial Completion as Au�:ust 12, 2015
which is also the date of commencement of all warranties and buarantees required by the Contract Documents. The
Date of Substantial Completion of the Work or designated portion thereof is the date established by the City of Palm
Desert 1-iousing Authority when construction is sufficiently complete, in accordance with the Contract Documents,
so the Owner may occupy the Work, or designated portion thereof, for the use for which it is intended.
The Owner accepts the Work or designated portion thereof as substantially complete and assumes full possession
thereof, in accordance with the contract documents.
