By Minute Motion, that the Housing Authority Board,
1) Approve Amendment No. 2 to Contract No. HA33480 with Liberty Landscaping
Inc. increasing the annual not-to-exceed extra work in the amount of $37,086.00
for annual landscape maintenance extra work services at the Housing Authority
Properties;
2) Authorize the Palm Desert Housing Authority to participate in the Coachella
Valley Water District Landscape Water Management Program;
3) Authorize the Executive Director and/or the Chairman to execute Amendment
No. 2 and any documents necessary to effectuate the actions taken herewith.
Monies are available in the FY 2015/2016 Palm Desert Housing Authority's ("Authority")
operating budget, in the appropriate Authority accounts.
Housinq Commission Recommendation
The Housing Commission will review the recommendation at its regular meeting of September
09, 2015. Staff will provide a verbal report upon request.
Executive Summary
Approval of this request will allow Liberty Landscape, Inc. ("Liberty") to correct Las Serenas
existing issues, wherein hardscapes are deteriorating from water overspray as well as eliminate

nuisance water. The scope for the extra work to be completed includes but is not limited to turf
removal, drought tolerant landscape conversion, relocating irrigation systems and replacing
irrigation system to weathermatic smart controllers. The Palm Desert Housing Authority
("Authority") proposes to complete the scope of work from the requested increase to be
allocated to extra work for Contract No. HA33480 with Liberty Landscaping Inc.
Backqround
The Authority contracts with Liberty for landscape maintenance in the annual amount of
$293,004.00. In addition to the standard contract amount there is a provision for extra work in
an amount not-to-exceed 20% of the contract for extra work ($58,600.00).
Liberty has identified at Las Serenas Apartments ("Las Serenas") several areas throughout the
property wherein hardscapes are deteriorating from water overspray. To correct Las Serenas
existing issues, Liberty along with the Authority's property management, RPM Company and
Coachella Valley Water District ("CVWD") have assessed the areas and determined that there
are 14,930 square feet of turf that can be removed and converted to drought tolerant landscape
("ProjecY') (see attached Las Serenas Property Turf Conversion Area Map).
CVWD's Landscape Water Management Program ("Program") was established for the purpose
of water conversion and to eliminate nuisance water, overspray and run-off. CVWD's Program
provides financial incentives to encourage turf conversion. The Authority may participate in this
program reducing the overall project cost at Las Serenas. RPM has applied for Las Serenas
turf conversion and has obtained approval. CVWD's program will provide a rebate to the
Authority up to $1.00 per sq. ft. for the turf removal providing an overall project savings of
approximately $14,930.00. In order to receive the rebate from the Program, the work must be
completed within ninety (90) days from approval. The Authority with approval will complete the
work from the allocated extra work amount being requested to be increased.
Amendment No. 2 incorporates the recommended landscape improvements and materials.
Costs for the additional extra work and materials are $37,086.00. The scope for the extra work
to be completed includes but is not limited to turf scalping and removal, drought tolerant
landscape conversion, relocating irrigation systems and replacing irrigation system to
weathermatic smart controllers. Staff and management believe that Amendment No. 2 with the
proposed work represents a fair value for the contract amendment. Liberty has the ability to
complete this work as part of the current contract work. It is expected that the regular contract
work as well as the additional work will be completed by the end of November 2015.
The Las Serenas Project additionally will provide other savings in the operation of the property.
The Project will eliminate the need to reseed annually on the converted areas as well as save
on water consumption and reduce the cost to maintain the hardscape areas that have been
deteriorating from water overspray. The water consumption and maintenance cost are direct
savings the properry will benefit. The elimination of the reseeding cost not only to these areas
but to the remainder of the property will be evaluated on with the Liberty to determine a credit to
the Authority as this work will not be required as part of the Contract for the remainder term.
The Authority proposes that depending on the credit amount, any additional areas at other
Authority properties that could benefit from having areas converted to drought tolerant
landscape, may be considered additional extra work to Liberty and the cost to complete the
extra work will be offset with any credit available.

Staff recommends authorization to participate in the CVWD Program and approval of the
proposed additional improvements as Amendment No. 2 to Contract No. HA33480 with Liberty
Landscaping Inc. increasing the annual not-to-exceed extra work in the amount of $37,086.00
(for a total of $95,686.00)for annual landscape maintenance extra work services.
Fiscal Analvsis
The fiscal impact is the cost of Amendment No. 2 which will be paid from the FY 2015/2016
Housing Authority's Operating budget. CVWD's program will provide a reimbursement to the
Authority for turf removal providing an overall project savings of approximately$14,930.00.

This Contract Amendment covers changes to the subject contract as described herein. The consultant shall perform
all work as necessary or required to complete the Contract Amendment items for a lump sum price agreed upon
between the Consultant and the Palm Desert Housing Authority, otherwise referred to as Owner.
Contract Time Extension -0- Days.
Revised Contract Total $293,004.00 with an additional amount for extra work not-to-exceed $96,686.00 annually.
The undersigned Consultant approves the foregoing Contract Amendment # 2 as to the changes, if any, in the
contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to
the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Contract Amendment # 2. The Consultant agrees to furnish all labor and materials and perform all other necessary
work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Contract
Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is
understood that the Contract Amendment shall be effective when approved by the Owner.
Execution of this Contract Amendment by the Consultant constitutes a binding accord and satisfaction that fully
satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity,
arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not
limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well
as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
