33433(c) OF THE HEALTH AND SAFETY CODE

Recommendation
By Minute Motion, that the Authority Board receive and file this
report pursuant to Section 33433 (c) of the Health and Safety Code.
Background
Pursuant to its Resolution No. 03-34, adopted on April 10, 2003, the City Council
authorized the former Palm Desert Redevelopment Agency to sell small housing
projects pursuant to Section 33433(c). On March 14, 2013, the City Council adopted
Resolution No. 2013-11 authorizing the Authority to sell small housing projects pursuant
to Health and Safety Code Section 33433(c) as the successor to the former Agency's
housing functions and assets.
Any Agency that has sold or leased a small housing project is required to file a report
with the legislative body after the end of the fiscal year which discloses; (i) the name of
the owner/purchaser of the property, (ii) the legal description or street address of the
property, (iii) the date of the conveyance of the property, (iv) the restrictions posed by
the agreement on the owner/purchaser of the property, and, (v) the date on which the
public hearing was held on the conveyance of the property, pursuant to Section
33431(c).
The following properties were sold during the fiscal year 2015/2016 and meet the
definition of a "small housing project" because the property was sold to person(s) of low
or moderate income. The Authority conveyed the property pursuant to Health and
Safety Code Section 33433(c).
The property was restricted by a Restrictive Agreement (also known as Unit Regulatory
and Lien Agreement ("URLA") or Affordable Housing Restriction and Lien Agreement
("AHRLA")) which was recorded at the time of sale which limits, among other things,
affordability, encumbrances, transfers and resales for a period of up to 45 years.
