PERFECT THE INTENT OF APPROVED PARCEL MAP WAIVER

Recommendation:
By Minute Motion, authorize the Chairman to execute a Grant Deed and a
Quitclaim Deed, which will implement the lot line adjustment pursuant to
Certificate of Compliance, Parcel Map Waiver 99-02, as approved by the
City of Palm Desert Planning Commission on October 19, 2004.
Discussion:
On October 19, 2004, the City of Palm Desert Planning Commission approved a waiver
of parcel map (PMW 99-02) for a lot line adjustment between the Morningstar Office
Building at 73-733 Fred Waring Drive (at San Pascual Avenue) and the five parcels to
the south, including the Palm Desert Redevelopment Agency's parcel for the Palm
Village apartments, all on Santa Rosa Way. The adjustment was done to conform to
the old wood fences and the newer block wall between the Morningstar parcel and the
five aforementioned parcels. The related Certificate of Compliance for PMW 99-02 will
be recorded concurrently with the subject deeds at the County of Riverside. As with any
lot line adjustments and lot mergers, new deeds for the attached properties need to be
recorded to provide constructive notice of the revised or merged lot configuration(s)
pursuant to Government Code Section 66412(d). A deed also perfects the intent of a lot
line adjustment or merger, as approved.
Prior to the Agency's purchase of Lot 12, now a portion of Parcel A, as described in
Exhibit "A", Agency had notice of the above -described lot line adjustment and the
existing block wall built along the adjusted lot line. The design of the approved Palm
Village Apartment complex conforms to the boundary lines described in Exhibit "A".

Therefore, staff recommends that the Redevelopment Agency Board, by minute motion,
authorize the Chairman to execute a Grant Deed and a Quitclaim Deed to perfect the
intent of approved Parcel Map Waiver 99-02.

Note: This quitclaim deed implements the revised lot configurations pursuant to Certificate of Compliance
Waiver of Parcel Map No. P.M.W. 99-2 as approved by the City of Palm Desert. The function of this deed
is to provide constructive notice of the revised lot configurations pursuant to Government Code Section
66412(d), and to perfect the intent of said P.M.W. 99-2 as approved.
