REQUEST: 1) RATIFY CHANGE ORDER NO. 2 TO CONTRACT NO. R-21610
(CORA CONSTRUCTORS) FOR THE CONSTRUCTION, REPAIR AND
REHABILITATION OF THE LAKES AND PUMP SYSTEM AT THE
DESERT WILLOW GOLF RESORT FOR GRADING AND LINER
INSTALLATION AT LAKE #1, LAKE #2 AND LAKE #4; 2) AUTHORIZE
THE CITY CLERK TO FILE A NOTICE OF COMPLETION FOR
CONTRACT NO. R —21610 (CORA CONSTRUCTORS) FOR THE LAKE

NOTICE OF COMPLETION
Recommendation:
By Minute Motion, that the Agency Board:
1) Ratify Change Order No. 2 to Contract No. R-21610 with Cora Constructors
in the amount of $135,615.70 for grading and liner installation at Lake #1, #2,
and #4,
2) Appropriate $74,765.70 from unobligated project area funds to Account No. 851-
4663-454-4001;
3) Authorize Finance Director to transfer $60,850 from contingency to base;
4) Authorize Executive Director to execute the change order; and
5) Authorize the City Clerk to file a Notice of Completion for Contract No. R-21610.
Executive Summary:
Acceptance of this recommendation will ratify field changes to adjust the scope of the contract
for the construction, repair and rehabilitation of the lakes at the Desert Willow Golf Resort. The
Change Order will result in the total and final addition to the contracted cost in the amount of
$ 21,080.80 with a breakdown as follows:

Discussion:
There have been various issues with the Lake Rehabilitation Project at the Desert Willow Golf
Resort. Staff addressed many of the issues within the existing scope of the contract. However,
upon draining the lakes, a number of liner and subgrade problems were discovered. In order to
meet the Desert Willow Golf Resort's deadlines for over -seeding, scheduled events, and the
opening date for play, additional work was approved in the field as the most cost/time effective
method for completion of the Lake Rehabilitation Project at Desert Willow.
When work began on Lake #1, it was observed that the existing liner was extremely taut which
could have been caused by subsidence of the grade below the liner, tectonic movement, or
water damage. The severely deteriorated liner was extremely difficult to seam to, attributing to
project delays, and additional cost in labor and materials. Similar conditions were discovered at
Lakes #2 and #4. These were conditions that could not have been determined prior to the
commencement of construction. At PACE's recommendation, twenty samples of the liner have
been sent for testing to determine the cause of their decaying state. Results will be reviewed by
both staff and the project engineer for further information regarding the untimely deterioration of
the liner. Staff is also consulting Best, Best and Krieger as to any form of recourse the City
might have with those companies involved in the original construction and installment of the
lakes.
Further excavation of the lake edge revealed that the liner was as deep as 6 ft. — 8 ft. below the
elevations shown on the construction drawings. Change Order No. 1 addressed the draining of
Lakes #1, #2 and #4, as well as the shoreline subsidence in Lake #1. These are conditions that
could not be determined prior to construction. As a result, Cora, at the recommendation of the
project engineer, rebuilt the subgrade in Lakes #1, #2 and #4 so that the sides of the lakes
would not have a slope greater than 3H:1V. This will prevent erosion and stress on the newly
installed liner. At Lake #4 the shoreline had to be re-established in order to accommodate the
proper volume of water necessary to facilitate the functionality of the lake flow through system.
Breakdown of the $135,615.70 Change Order Amount:
• Additional sloping, grading, and removal of excess sand in the amount of $82,566.41
• Repair of existing liner totaling $53,049.29.
❑ $22,908.15 in additional costs of tie — in to damaged liner.
❑ $30,141.14 in additional cost patching existing holes in liner.
At this time Lakes #1, #2 and #4 on the Fire Cliff course have been repaired, restored to full
use, and the deadline for over -seeding and seasonal play has been met. If the Fire Cliff course

was not able to open in November, Desert Willow would have lost approximately $115,000 in
over -seeding, approximately $450,000 in lost revenue, and been unable to accommodate
twenty-five tournaments. The flow through system has been repaired and is currently
functioning as originally intended. Desert Willow staff is now able to monitor the volume of
water in each of the lakes, which will enable staff to maximize the use of reclaimed water for
irrigation.
Staff recommends that the Agency Board authorize the City Clerk to file a Notice of Completion
for the subject project and ratification of Change Order No. 2 in the amount $135,615.70.
The work had to be performed in order for the project to be completed for the pending
season and over -seeding, and could be performed most cost effectively by the
contractor already mobilized on the site. Lake #3 is scheduled for renovation during the
summer of 2005, however, the lake will be evaluated for subsidence and liner condition
prior to construction.
