Award Contract No. C23040A to Steven Burt and Associates, Inc. for Landscape and Lighting District Landscape Renovations in the amount of $ 469,082.00. B. Set aside a 10% contingency of $46,908.20. C. Authorize the Mayor to execute the agreement. D. Appropriate $271,433.80 to Fund 400 Capitol Projects Reserves. 2) That the Agency Board, by minute motion: A. Authorize the transfer to Fund 400 Capitol Projects Reserves of $55,324.50 from Project Area No. 1, $178,041.60 from Project Area No. 2 and $38,067.70 from Project Area No. 3. B. Appropriate $26.000.00 to Account No. 853-4388-433-4001 from Project area No. 3 unobligated funds. Discussion: On May 13, 2005 the City of Palm Desert advertised for bids for the landscape renovation on twelve (12) Landscaping and Lighting Assessment Districts. Four CONTRACT NO. C23040A Award Contract C23040A for LLD Landscape Renovations to Steven Burt June 23, 2005 Page 2 of 2 (4) companies requested bid documents. On June 7, 2005, at 10:30 a.m., the City Clerk opened sealed bids with the following bid submitted: Steven Burt & Associates, Inc. (Bermuda Dunes, CA) $ 469,082,00 Public Works and Development Services staff have reviewed the proposal from Steven Burt and Associates and determined that all specifications and provisions of the bid have been met. Funds are available in Fund 400 Capitol Project Reserves and from RDA Project Areas No. 1, 2 and 3. The Owner has the right to reject any or all Proposals and to waive any irregularities or informalities contained in a Proposal. 3. That the contract shall be awarded only by the governing body of OWNER; and said contract shall only be deemed awarded after the contractor's complete submission of all contract documents, bonds, insurance documentation, and the OWNER shall obtain all necessary signatures of the governing body. At which time, the contract shall be deemed awarded. 4. To submit to Owner such information as Owner may require to determine the Bidder's financial standing experience and to perform the work. 5. That the accompanying certified or cashier's check or Bid Bond constitutes a guarantee that if awarded the contract, Contractor will execute the Agreement and deliver the required bonds and certificates of insurance within 10 days after notice of award.
