REQUEST: APPROVE CONSTRUCTION CHANGE ORDER NO. 3 TO WDL
CONSTRUCTION (CONTRACT NO. R19540-A) FOR INCREASING THE
SCOPE OF WORK TO INCLUDE LANDSCAPING AND
MISCELLANEOUS FIELD CHANGES INCIDENTAL TO THE
CONSTRUCTION OF A NEW VISITOR INFORMATION CENTER AT

Recommendation:
By Minute Motion, that the Agency Board:
1. Approve Construction Change Order No. 3 in the amount of $219,032.89 to WDL
Construction of Palm Desert, California, for increasing the scope of the contract
work to include landscaping the half -acre pad surrounding the Visitor Information
Center, plus performing miscellaneous extra work associated with the
construction of the new building.
2. Authorize Finance Director to move $120,846.98 from contingency to base for the
subject change order. The remaining $98,185.91 necessary for this added work
is available in Account No. 850-4358-433-4001.
Executive Summary:
Approval of the staff recommendation will add the landscaping of the parcel on which the Visitor
Information Center sits to the scope of work to be accomplished under the Agency's contract
with the building contractor. Rejection of the staff recommendation will delay completion of the
landscaping surrounding the building such that it will not be complete until after the building is
open.
Discussion:
On 9 September 2004, the Agency Board awarded Contract No. R19540-A to WDL
Construction for the construction of a new Visitor Information Center. The landscaping was not
a part of this contract; it was part of a larger project that included the landscape buffer along
Highway 111 and Phase 2 of the Eric Johnson Gardens. Completion of design of this larger

project was delayed in the approval process, and consequently the Visitor Information Center
will be completed in advance of the remainder of the landscaping at Entrada del Paseo.
In order to complete the landscaping around the new Visitor Information Center simultaneously
with the completion of the building, the subject landscaping was removed from the larger
landscape project. The design was accelerated and completed on this smaller portion, and the
building contractor was asked to solicit competitive bids for the landscaping of the parcel on
which the new building is situated.
Bids were requested from four local landscape contractors: Hort Tech, Sierra Landscape
Company, Steven Burt & Associates, and Valley Crest. Hort Tech declined to submit a bid due
to their heavy workload, but the remaining three contractors submitted bids that ranged from
$206,288 to $231,142 (including the general contractor's standard mark-ups). An analysis of
the bid spread indicates that the prices are a reasonable reflection of the cost of the work in the
current market; all three bids are within eleven percent of one another. Sierra Landscape
submitted the low bid for the work.
Staff recommends that Change Order No. 3 to WDL Construction be awarded to add the
landscaping of the Visitor Information Center parcel to their scope of work so that the
landscaping will be complete when the building is ready to open. The total value of change
orders, including this Change Order No. 3, will be $249,141, which is approximately 8.2% of the
original contract amount.
Change Order No. 3 also includes addition of an exterior lighted flagpole and six nickel bronze
downspouts, and revision of Kieri board thickness from W to 1-1/8". These modifications
comprise $12,690.81 of the $219,032.89 change order amount.

OF CHANGE/REASON FOR CHANGE: DESCRIPTION
This change order provides for the addition of (6) nickel bronze downspouts as provided in Architectural Supplimentary
Instructions #037. Work involves the modification of the existing roof drain piping and the placement of perofrated
buckets filled with gravel in lieu of conceret splash blocks.
As designed, these downspout locations would have had a black drain pipe protruding beyond the face of the building
exterior. The use of the added brass spouts will improve the exterior building aesthetics.

DESCRIPTION OF CHAN GE REA SON FOR CHANGE:
This change order provides for the addition material cost for the revision of the Kieri Board thickness from 3/4" thick to
1-1 /8" thick.
The thickness of the Kieri Board was increased in the shop drawing comments. The original thickness of 3/4" was
deemed to thin for it's use and the Architect recommended the thicker size.
