Recommendation:
By Minute Motion, that the Palm Desert Redevelopment Agency authorize
staff to enter into contract with Emery Landclearing and Grading for the
purposes of a pool demolition on Hermosa Avenue located at Laguna Palms
Apartments in the amount of $10,880, plus a not to exceed amount of $2,500
for unforeseen conditions as a part of the demolition (Contract No. R24530)
Executive Summary:
Staff is recommending the complete demolition of the easterly pool at Laguna Palms
Apartments for a future child play area. This will also provide valuable information as to
what materials were used during the pool's original construction that can and will be used
to determine the best way to renovate the west pool during the projects renovation.
Discussion:
In 2004, during discussions regarding the renovations of the overall Laguna Palms project,
it was determined that the condition of the east pool was such that major deterioration had
occurred and it would be difficult to renovate. Suggestions were made on the annual
housing tour to demolish the east pool and create a children's play area for the complex.

The west pool appears to be in better condition but will be renovated as a part of the
overall project.
Once demolished, the pool area will be used for a staging location for the project
renovation which is why staff is suggesting we do this now. It will also provide us with the
exact materials used for the pool's original construction giving us insight to the west pool's
construction and to what extent we will need to renovate it. The demolition will include
removing and disposing of the all of the pools components, the decking, the planters, the
re -bar, and the conduits. The area will be backfilled with dirt at a compaction rate of 85%;
a compaction report will be required.
The project manager requested three proposals from demolition contractors and received
two with the third stating they were too busy to bid the project. The proposals ranged from
$34,371 to the low bid of $10,880, plus a not to exceed amount of $2,500 for unforeseen
conditions as a part of the demolition.
Staff is recommending approval of the lowest proposal from Emery Landclearing in the
amount of $10,880, plus a not to exceed amount of $2,500 for unforeseen conditions as
a part of the demolition.

On October 10, 2005 Stantec Consulting solicited proposals for the demolition and backfilling of
one of the pools at the Laguna Palms Apartments. Contacted were: Earth Scupltures, Emery
Land Clearing, and Demo Unlimited. Demo Unlimited declined to bid because they are too busy.
Emery Land Clearing had the lowest proposal in the amount of $10,880. Stantec's Engineer's
Estimate for this Scope of Work is $16,000.
Emery's proposal includes all of the items you mentioned in your E mail of October 10, 2005.
Copies of the proposals are attached for your use and review. Please consider incorporating a
Special Services provision in the amount of $2,500 to cover any unforeseen circumstances that
may occur given the age of the site.

SCOPE OF WORK. Earth Sculptures Inc. Shall provide the necessary labor, equipment, and
materials to construct the following:

2. Demo pool deck and haul offshe
3. Derno swimming pool and haul offsite
4 .Demo 2 foot block wall and haul offshe
5. Fill pool and pool equipment area and compact
Total Proposed Amount: $34.371.00
Exclusions: Permits, engineering, pm10 compliance, construction water. Not prevailing wage.
Palm trees to be relocated by others. All utilities to be disconnected by others. Pool equipment
to be removed by others.
Payments are to be made as the work progresses to the value of one hundred percent of the work completed. The
antire amount- of contract to be paid _30_4ays after completion of work performed by Earth Sculptures.

Terms: All payments shall be made in full and upon presentation of each completed invoice. If payment is not
made according to terms above, Earth Sculptures will have the following rights and remedies: Earth Sculptures
may charge a monthly service of one and a half percent (1.5%), eighteen percent (180/*) per year from the first
day default is made. Earth Sculptures may use all legal methods in collection of monies owed to it. Earth
Sculptures may seek payment for legal fees and other costs of collection, to the full extent of the law.
This proposal shall be considered withdrawn of not executed within 30 days. If you have any questions or do not
understand this proposal, seek professional advice. Upon acceptance this proposal beoomes a binding contract
between both parties.
