B-3 PALM DESERT, CA 92260 DATE: OCTOBER 27, 2005 CONTENTS: 1) CONSTRUCTION CHANGE ORDER NO. 8 TO CONTRACT NO. R 19540-A 2) NOTICE OF COMPLETION Recommendation: By Minute Motion, that the Agency Board: 1. Approve a final change order, Construction Change Order No. 8 in the amount of $71,381.81, to WDL Construction for adding fire lane signage, increasing the quantity and nature of hardscape and landscape around the building, and increasing the contract duration 25 days; and 2. Authorize the City Clerk to file a Notice of Completion for the subject project upon staff confirmation that all punchlist work has been completed. The funding necessary for this added work is available in Account No. 850-4358-433-4001. Executive Summarv: Approval of the staff recommendation will close out the Visitor Center construction contract by approving additional compensation for: extended overhead and general Staff Report Change Order No. 8 and Notice of Completion for Contract R19540-A Page 2 of 3 October 13, 2005 conditions costs due to Owner changes; contract additions on a directed basis; and the addition of 28 fire lane signs, as requested by the Fire Marshal. It will also authorize the City Clerk to file a Notice of Completion when the fire lane sign installation is complete. Discussion: On September 9, 2004, the Agency Board awarded Contract No. R19540-A to WDL Construction for construction of a new Visitor Information Center. The work is substantially complete, and the building is occupied and open for business. In order to expedite completion, several change orders were previously issued that increased the scope of work done under this contract, while simultaneously reducing the scope of work to be done under the future contract for landscape and hardscape at Entrada del Paseo. The additional work required that the contract time be increased by 25 calendar days, which results in an increase in the contractor's general conditions costs (job trailer, superintendent's wages, etc.) and overhead expenses. The total of these extended overhead and general conditions costs is $31,047.28, and is included in Change Order No.8. Change Order No. 8 also includes the following three items: $13,249.75 for 28 "No Parking" signs required by the Fire Marshal to be installed along both sides of the curved lane behind the Visitor Center; $17,613.12 for hardscape additions and revisions around the exterior of the building; and $9,471.66 for landscape additions and modifications between the preliminary set of landscape plans, from which bids were solicited, and the permitted set of landscape plans, which carried the final approvals from CVWD and the City of Palm Desert Landscape Department (early bidding from preliminary plans was accomplished in order to authorize work before the summer hiatus from Agency Board meetings). The first item listed above has not yet been performed, but if approved by the Agency Board, it will be completed prior to filing of the Notice of Completion for the project. The second item listed was performed as directed work to address items such as ADA, erosion concerns, and concrete footings for added lights, with the final amount negotiated by Harris & Associates (the Agency's Construction Manager). The third item was authorized by the Executive Director under the authority granted by Section 3.30.270 of the Palm Desert Municipal Code. This same section of the Code requires this report of the Executive Director's action. Change Order No. 8 will be the final change order on the subject contract. The non - elective change orders on this project have totaled 4.5 percent of the original contract value, which is within industry standards for a project of this size and nature.
