REQUEST: AUTHORIZE CONTRACT AMENDMENT NO. 6 TO MSA
CONSULTING (CONTRACT NO. R22730) FOR ADDITIONAL
SERVICES AT FALCON CREST/LA ROCCA VILLAS FOR
REVISIONS TO ROUGH GRADING, STREET AND STORM
DRAIN, WATER AND SEWER, TO ACCOMMODATE THE
STREET TREE DESIGN, ALSO THE REMOVAL AND
REPLACEMENT OF A DETERIORATED IRRIGATION LINE,

Recommendation:
By Minute Motion, that the Agency Board:
Authorize Contract Amendment No. 6 for Falcon Crest an the La
Rocca Villas in the amount not -to -exceed $43,000 for professional
services and a not -to -exceed amount of $2,000 for reimbursable to
MSA Consulting of Rancho Mirage, California (Contract No. R22730)
for revisions to the Rough Grading, Street and Storm Drain, Water
and Sewer plans to accommodate the street tree layout and
production of engineering and construction documents for the
removal and replacement of a deteriorated CVWD irrigation line, the
design and engineering of a temporary access road; and
2. Authorize the Chairman to execute the same.
Funds are available in Account No. 870-4698-466-4001.
Executive Summarv:
The Change Order is the result of amendments made by both the Agency and the City of
Palm Desert as approved by the Agency Board through previous action for Falcon Crest
and the La Rocca Villas. These changes are primarily related to the integration of a
street tree layout into the community design, a CVWD waterline, and all necessary
engineering and construction to institute them. This change order is necessary for the
completion of the project.

Discussion:
On May 13, 2004, the Redevelopment Agency Board awarded a contract to MSA
Consulting for final civil engineering services for the proposed single-family and senior
duplex housing project on 20 acres of land immediately west and south of Hovley
Gardens. The civil engineering services are approximately 90% complete.
As part of the design of the 20-acre affordable housing project, the City of Palm Desert
requested the design, development, and implementation of a street tree layout to run
throughout the 20-acre site. As a result, MSA was required to make revisions to the
Rough Grading, Street and Strom Drain, Water and Sewer Plans to accommodate the
street tree well layout design. Also included in the revision process were numerous
meetings, coordination, and development of a specialized ADA accessible sidewalk and
driveway detail.
The Agency also requested additional services from MSA for the design of a temporary
access road, and for the production of engineering and construction documents for the
removal and replacement of an existing CVWD irrigation line. The temporary access
road will allow for a streamlined flow of traffic for all construction vehicles during the
production of the single-family and senior units. The access road is designed to run from
Merle to the northernmost point of the senior villas, allowing for the simultaneous
construction of the villas and the single-family units. The pre-existing irrigation line runs
north/south in close proximity to the temporary access road and lies adjacent to the
Portola Country Club. Due to the advanced age of the irrigation line, CVWD informed
the Agency that movement of construction vehicles along the access road would most
likely cause the line to shatter. The Agency decided to remove and replace the existing
line in order to prevent any possible damage and ensure the line's longevity.
Staff recommends approval of Amendment No. 6 to the MSA Consulting contract for the
purpose of completing all necessary components for the construction of the Falcon Crest
single-family homes and the La Rocca Villas senior housing units.

This Professional Service Amendment covers changes to the subject contract as described herein. The consultant
shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump
sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as
Owner.
Contract Time Extension 0 Days.
Revised Contract Total $383,875.00
The undersigned Consultant approves the foregoing Professional Service Amendment # 6 as to the changes, if any,
in the contract price specified for each item including any and all supervision costs and other miscellaneous costs
relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on
account of said Professional Service Amendment # 6 . The Consultant agrees to furnish all labor and materials and
perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required
to complete the Professional Service Amendment items. This document will become a supplement of the contract and
all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the
Owner.
Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that
fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or
equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown,
including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of
productivity, as well as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
