Approve Construction Change Order No. 5 to approve and ratify Change Order Requests (COR) from Taylor Frager, Inc. (Contract No. R21780) in the cumulative amount of $209,912 with twenty-one (21) additional workdays to the contract time for the construction of Palm Village Apartments; and 2. Authorize Finance Director to move $152,989.80 from contingency (Account No. 870-4349-433-4001) to base for the subject change order; and 3. Authorize appropriation of $56,922.20 from Agency's unobligated funds. Staff Report Approve Construction Change Order No. 5 to Contract No. R21780 (Taylor Frager, Inc.) Page 2 of 3 December 14, 2006 Executive Summarv: Change Order No. 5 for the Palm Village Apartments is for recommended enhancements that reduce future maintenance costs, correction of minor errors and omissions in the project design, and costs for extended general conditions. The total cost of all change order work for this project attributable to deficiencies in the plans is 4.4% of the contract amount, which is within industry standards. These changes have been reviewed and approved by Harris & Associates who is the consulting professional construction manager for this project. Discussion: On April 15, 2005, the Notice to Proceed was issued for Contract No. R21780 to Taylor Frager, Inc., for construction of the 36-unit Palm Village Apartments in the amount of $5,839,386. The recommended change order includes enhancements and necessary modifications to this contract. Enhancements included in the subject change order include paving, waterproofing, plumbing, and electrical revisions. To avoid a cost increase for asphalt and to enhance the project, Harris & Associates, the Construction Manager, recommends deletion of asphalt paving of the parking areas and substitution of 6" thick reinforced concrete that will be superior in strength and durability, and will reduce future maintenance costs, in the amount of $29,830. Particle board underlayment was deleted underneath the ceramic tile flooring on the second floors, Hardy Backerboard underlayment and epoxy grout were used instead to upgrade the installation, for a net increase of $14,325. Plumbing, electrical, and miscellaneous improvements in the amount of $7,321 were included to upgrade the maintenance and storage locations for future use. The additional contract time associated with these enhancements in COR Numbers 84, 63, and 20R totals eighteen (18) days. Miscellaneous corrections and revisions include the following: an electrical circuit and light for the bathrooms ($6,356); substitution of wall mounted light fixtures to accommodate trusses and mechanical equipment ($5,655); ADA compliant kitchen sinks and faucets ($5,280); reapplication of paint in some areas ($1,208); and replacement of some metal lathe ($585). The additional days of contract time associated with this additional work for the CORs associated with this work is three (3) days. The change order also contains $139,352 for additional overhead and general conditions costs associated with justifiable time extensions on the work. This amount is the sum of two items. The Agency Board previously approved change orders with fifty (50) additional workdays of time. Harris & Associates has verified that $95,634 is an appropriate cost for extended general conditions associated with these previously approved additional workdays. The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Change Order items for a lump sum price agreed upon between the Contractor and the Palm Desert Redevelopment Agency, otherwise referred to as Owner. Contract Time Extension 21 Days. After detailed discussions wlth De Soto, he agreed to do the work at $4.55 per SF for a total cost of $63,003.85. For a prevailing wage job, the price per SF is more than reason�ble.
