Provision of all desired services 1 2 3 4 5 REQUEST FOR PROPOSAL FOR CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES City of Palm Desert Freedom Park Project No. 713-00 Contract No. R21620 INVITATION The City of Palm Desert is soliciting proposals from qualified firms for professional Construction Management and Inspection Services for the construction of Freedom Park in the City of Palm Desert, California, at the location shown on the attached vicinity/location map. Four (4) copies of your Proposal shall be submitted no later than 4:00 pm on December 8, 2005 addressed to: Department of Parks & Recreation Attn: Janis R. Steele Parks & Recreation Services Manager 73-510 Fred Waring Drive Palm Desert, CA 92260 II. PROJECT DESCRIPTION The project includes but is not limited to: The construction of a new 23-acre Freedom Park consisting of underground utility construction, clearing and grubbing, irrigation and landscape installation, rough and finish grading for baseball fields, volleyball courts, tennis courts, skate park, play equipment, soccer field with an underground drainage system, concrete site improvements, curb and gutter, asphalt parking lot, a Snack Bar and Men's/Women's Restroom facility per City of Palm Desert specifications and plans. Construction Management and Inspection Service requirements are described in the scope of services, below. Additionally, the following requirements apply: 1. The Consultant will be required to enter into an agreement for professional services with the City of Palm Desert. 2. Prepare documentation and coordinate all activities. SCOPE OF CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES In performing Construction Management and Inspection Services for the City of Palm Desert Freedom Park project, the Consultant will furnish a resident representative, assistants and other field staff to carry out the following duties and responsibilities: 1. Contract Documents: Review the project contract documents, including the plans and specifications, and any other pertinent information provided by the City of Palm Desert. 2. Schedules: Review project permits, progress payment requests and equipment and material submittals by the Contractor as required by the contract documents. Make recommendations to the City Parks and Recreation Staff (City) regarding acceptability and compliance with the contract documents. Review, track, and analyze the project schedule(s), and report to City regarding the contractor's progress. 3. Conferences: Schedule and attend pre-construction and weekly project meetings with the contractor to discuss current construction issues. Arrange a schedule of progress meetings and other job conferences and notify those expected to attend in advance. Attend meetings and maintain and circulate copies of minutes thereof. 4. Requests For Information (RFI): Review and process RFI's for designer response, and make recommendations to the City regarding responses to the Contractor. 5. Change Orders: Be available to answer questions regarding the special provisions, the design drawings or conflicts in the design during construction, and assist the City in issuing change orders regarding omissions or conflicts in the design. 6. Coordinate: a. Coordinate with the City of Palm Desert Building Division regarding building inspection and building permit issues. Liaison: Serve as the City's liaison with the Contractor, working principally through the Contractor's project manager and superintendent to assist them in understanding and complying with the intent of the plans and contract documents. 8. Shop Drawings and Samples: b. Record date of receipt of submittals shop drawings and samples which are furnished by the Contractor, review by the design team and notify the City of their availability for examination. c. Advise the City and Contractor or its superintendent immediately of the commencement of any Work requiring a submittal, shop drawing or sample submission if the submission has not been approved. 9. Review of Work, Rejection of Defective Work, Inspections and Tests: d. Conduct on-site inspections of the Work in progress to determine if the work is proceeding in accordance with the contract documents. e. Report to the City whenever any Work is unsatisfactory, faulty or does not conform to the contract documents. After review with the design team, advise the Contractor when work should be corrected or has been rejected, or should be uncovered for observation, or requires special testing or inspection for approval. f. Verify that tests, equipment and system startup and operating and maintenance instructions are conducted as required by the contract documents and in presence of the required personnel, and that the Contractor maintains adequate records thereof. Observe, record and report appropriate details relative to the test procedures and startups. g. Coordinate visiting inspectors representing the City and other agencies having jurisdiction over the project, record and report the outcome of these inspections. h. Assist City Building Inspector in conducting inspections related to City building permit requirements. 10.Interpretation of Contract Documents: Transmit to the Contractor clarifications and interpretations of the contract documents. Construction Management and Inspection Services RFP Page 4 of 10 November 8,2005 11.Modifications: Consider and evaluate Contractor's suggestions for modifications in drawings or specifications and report them with recommendations to the City. Prepare and maintain record of changes and modifications made to the drawings to the City at the completion of the project. 12 Project Photos: Maintain and catalog progress photos of the progress and quality of the construction. 13. Cellular Telephone Service: Provide cellular telephone service for construction management and inspection personnel communication with City and Contractor. 14.Transportation: Provide transportation for Construction Management and Inspection personnel. 15. Records: i. Maintain orderly files for correspondence, reports of job conferences, submittals and sample submissions, reproductions of original contract documents including all addenda, change orders, additional drawings issued subsequent to the execution of the contract, Designer's clarifications of the contract documents, progress reports and other project related documents. j. Keep a diary or log book, recording hours on the job site, weather conditions, data relative to questions of extras or deductions, list of visiting officials and representatives of manufacturers fabricators, suppliers and distributors, and daily activities, decisions, observations in general and specific observations in more detail as in the case of observing test procedures. k. Record names, addresses and telephone numbers of all Contractors, subcontractors and major suppliers of materials and equipment. I. Reports: Furnish periodic reports of progress of the Work and Contractor's compliance with the approved progress schedule and schedule of shop drawing submissions. m. Consult with the Designer in advance of scheduled major tests, inspections or start of important phases of the work. Construction Management and Inspection Services RFP Page 5 of 10 November 8,2005 n. Report immediately to the City upon the occurrence of any accident. o. Payment Requisitions: Review applications for payment with Contractor for compliance with the established procedure for their submission and forward them with recommendations to City. p. Certificates, Maintenance and Operation Manuals: During the course of the Work, verify that certificates, maintenance and operation manuals and other data required to be assembled and furnished by Contractor are applicable to the items actually installed and delivered to the City. 18. Completion: a. Before the issuing a Notice of Completion and recommending final payment, submit to the Contractor a list of observed items requiring completion or correction. b. Conduct a final inspection in the company of the Designer and Contractor, and prepare a final list of items to be completed or corrected. c. Verify that all items on final list have been completed or corrected and make recommendations to the City concerning acceptance. Limitations of Authority: Except upon written instruction from the City, Consultant: 1. Shall not authorize any deviation from the contract documents or approve any substitute materials or equipment; 2. Shall not exceed limitations or authority as set forth in the contract documents; 3. Shall not undertake any of the responsibilities of Contractor, Subcontractors or Contractor's Superintendent, or expedite the work; 4. Shall not advise on or issue directions relative to any aspect of the means, methods, techniques, sequences or procedures of construction unless such is specifically called for in the contract documents; 5. Shall not advise on, or issue directions as to safety precautious and programs in connection with the work; 6. Shall not authorize the City to occupy the project the whole or in part; 7. Shall not participate in specialized field or laboratory tests. The consultant will coordinate and schedule tests and have testing firm bill direct to the City through separate agreements. Construction Management and Inspection Services RFP Page 6 of 10 November 8,2005 IV. CITY RESPONSIBILITIES The City will provide, or assume actual costs, for the following products or services: 1. The City of Palm Desert Parks and Recreation Staff will administer the project. 2. Process Consultant's progress payments. 3. Provide building code special deputy inspections. V. CONSULTANT'S PROPOSAL AND COMPENSATION: The City of Palm Desert desires a professional construction management firm that has specific experience in providing Construction Management and Inspection services to public sector building projects and park projects. Your firm's response to this request should be in the form of a proposal to perform, Construction Management and Inspection services, with a corresponding cost estimate. All proposals shall include, as a minimum, the following elements: 1. A statement that this RFP shall be incorporated in its entirety as a part of the Consultant's proposal. 2. A statement that this RFP and the Consultant's Proposal will jointly become part of the "Agreement for Professional Consultant Services" for this project when said Agreement is fully executed by the Consultant and the City of Palm Desert. 3. A statement that the Construction Management and Inspection Services to be provided, and fees therefore, will be in accordance with the City's RFP, except as otherwise specified in the Consultant's Proposal under the heading "EXCEPTIONS OR ADDITIONS TO THE CITY'S REQUEST FOR PROPOSAL." 4. A single and separate section with the heading "EXCEPTIONS OR ADDITIONS TO THE CITY'S REQUEST FOR PROPOSAL" containing a complete and detailed description of all of the exceptions to the provisions and conditions of this Request for Proposal upon which the Consultant's proposal is contingent and which shall take precedent over this RFP. 5. A statement of qualifications applicable to this project including the names, qualifications and proposed duties of the Consultant's staff to be assigned to this project; a listing of recent similar projects completed, including the names, titles, addresses, and telephone numbers of the appropriate persons whom the City could contact. If one or more of the Consultant's Staff should Construction Management and Inspection Services RFP Page 7 of 10 November 8,2005 become unavailable, the Consultant may substitute other Staff of at least equal competence only after prior written approval by the City. 6. A statement of Subconsultant's qualifications applicable to this project including the names, qualifications and proposed duties of the sub- consultant's staff to be assigned to this project; a listing of recent similar projects completed including the names, titles, addresses and telephone numbers of the appropriate persons whom the City could contact. The Consultant will not be allowed to change the sub-consultant without written permission from the City. 7. A statement that all charges for Construction Management and Inspection services is a "Not-to-Exceed Fee" as submitted with and made a part of said Consultant's Proposal. Payment will be for actual time and materials expended in furnishing authorized professional services. 8. A copy of the Consultant's hourly rate schedule and a statement that said hourly rate schedule is part of the Consultant's proposal for use in invoicing for progress payments and for extra work incurred that is not part of this RFP. All extra work will require prior approval from the City. 9. A statement that the Consultant will not discriminate against any employee or applicant for employment because of race, color, religion, sex, or national origin. VI. GENERAL COMPLIANCE WITH LAWS AND WAGE RATES 1. The Consultant shall be required to comply with all federal, state, and local laws and ordinances applicable to the work. This includes compliance with prevailing wage rates and their payment in accordance with California Labor Code, Section 1775. 2. The Consultant is required to submit certified payrolls weekly for field personnel only were applicable. VII. PAYMENT(S)TO CONSULTANT 1. This work is to be performed for a "Not-to-Exceed Fixed Fee." 2. The Consultant shall provide a "Payment Schedule" indicating the fee for individual tasks with a "Not-to-Exceed Fixed Fee" which shall be the sum of all tasks. 3. Tasks shall include, but be limited to, all professional consultant services necessary to complete the work covered by this proposal. 4. The City will pay the consultant for work completed as identified in the payment schedule. Construction Management and Inspection Services RFP Page 8 of 10 November 8,2005 5. Progress payments shall be based on tasks performed as identified in the payment schedule. Monthly invoices will specifically identify man-hours and costs incurred by each task. An itemized cost breakdown for the work described herein must be submitted with your Proposal in a separate sealed envelope. 6. Sub-categorization of task is permitted to better define the task for payment. 7. Task shall include, but not be limited to, all Construction Management, contract administration, and Inspection services such as evaluating plans for completeness; analyze addenda for completeness; specification review; project report; surveying; geotechnical; research; pre-construction meeting; questions during construction; contract change orders; as-built drawings; construction staking; etc. 8. Reimbursement costs such as mileage, printing, telephone, photographs, postage and delivery, are to be included in the "Not-to-Exceed Fee." 9. The City will pay the Consultant for all acceptable services rendered in accordance with the "Agreement for Professional Consultant Services." 10.When the Consultant is performing, or is requested to perform, work beyond the scope of service in the "Agreement for Professional Consultant Services," an "Amendment to the Agreement" will be executed between the City and Consultant. IX. CONTRACT The Contract will include the Agreement for Professional Consultant Services, Consultant's Proposal, and City's Request for Proposal. X. GENERAL CONDITIONS The City shall not, in any event, be liable for any pre-contractual expenses incurred by the Consultant. 1. Pre-contractual expenses are defined as expenses incurred by the Consultant in: A. Preparing the proposal; B. Submitting the proposal to the City; C. Presentation during selection interview; D. Negotiating with the City any matter related to this Proposal; E. Any other expenses incurred by the Consultant prior to an executed Agreement Construction Management and Inspection Services RFP Page 9 of 10 November 8, 2005 2. The City reserves the right to withdraw this RFP at any time without prior notice. Further, the City makes no representations that any Agreement will be awarded to any Consultant responding to this RFP. The City expressly reserves the right to postpone reviewing the proposals for its own convenience and to reject any and all Proposals responding to this RFP without indicating any reasons for such rejection(s). 3. The City reserves the right to reject any or all proposals submitted. Any contract awarded for these consultant engagements will be made to the consultant who, in the opinion of the City, is best qualified. 4. Any contract to be awarded as a result of this Request for Proposal will be awarded without discrimination based on race, color, religion, sex, or national origin. 5. The Consultant's proposal shall be no more than 20 pages, excluding a cover letter of up to two pages, dividers, and certificates. The RFP will not be counted when included in the proposal. Xl. SELECTION CRITERIA 1. The proposals will be rated according to the following criteria. All criteria will be waited evenly and the proposals will be scored out of a maximum 120 points. A. Demonstrated understanding of the scope of work of the project and ability to complete the project requirements with minimal change orders. (15 pts max); B. Qualification and experience of the Consultant's project manager that will be assigned to this project. Proven experience in dealing effectively with City staff and others to resolve issues (25 pts max); C. Adequate available staff with substantial appropriate ability and experience on like projects to be assigned full term to this project (15 pts max); D. Sub consultants demonstrated understanding of the scope of work for the project (15 pts max); E. Proven recent experience on projects of like nature. Include description of work performed for other public agencies and provide reference contact phone numbers. This information is required of all sub consultants used in this project(25 pts max); and F. Fee proposals will be scored with the lowest proposal receiving the maximum points. All other proposals will receive a percentage of the points based on how their costs compare to the lowest priced proposal (25 pts max). Construction Management and Inspection Services RFP Page 10 of 10 November 8,2005 Criteria A through E will be scored prior to scoring Criteria F to insure that the evaluation committee is unbiased when judging those sections. 2. Proposals failing to provide sufficient information and assurances of performance accurately assess each category of the required services and failing to comply with requirements and conditions of the RFP will not be given further consideration. 3. After proposals are received and evaluated, the Consultant may be invited to a selection interview depending on the number and quality of the submittals. 4. The firm whose submittal is selected by the City will be contacted for the purpose of entering into negotiations with the City for a possible written agreement. Final costs will be determined through negotiations with the firm selected. There can be no assurance that negotiations will result in a finalized agreement. The City and the respondent will not be obligated in any way unless and until a written agreement is entered into and executed by both parties. If negotiations with the first-ranked consultant are not successful, negotiations may be initiated with the second-ranked consultant. This procedure may be continued, initiating negotiations with the other ranked consultants in sequence of ranking selected by the City, until a mutually satisfactory agreement has been reached.
