BOX 270399 SAN DIEGO, CA 92198-2399 DATE: JANUARY 26, 2006 CONTENTS: CONTRACT NO. R- 24780 Recommendations: By Minute Motion, that the Agency Board: 1. Authorize the award of a construction management services Contract No. R- -r V to Douglas E. Barnhart in the amount not to exceed $196,940 plus reimbursable expenses not to exceed $2,500 for construction management services at Entrada del Paseo, including those needed for the Henderson Community Building and Phase 2 of the landscaping. 2. Authorize the Director of Finance to set aside an additional amount of $19,694 as 10% contingency (use of contingency requires additional action); and 3. Authorize Chairman to execute said contract. Funds are available in Account No.850-4358-433-4001. Executive Summarv: By approval of the staff recommendation, the Agency Board will authorize the professional services necessary to manage the construction of the new Henderson Community Building, the landscaping for the multi -sensory gardens and Phase 2 of the Eric Johnson Memorial Gardens, and associated civil improvements. Rejection of the staff recommendation would reduce construction oversight controls and could increase Agency exposure to construction- related claims. Discussion: A new 5,700 square foot Henderson Community Building has been designed for construction at Entrada del Paseo, and landscaping along Highway 111 and at the Eric Johnson Memorial Staff Report Authorize Award of Contract R- 24760 Construction Management Services Page 2 of 2 January 26, 2006 to Douglas E. Barnhart, Inc., for Gardens has been planned. Construction is anticipated to begin later in the year after plan check, permitting, and bidding activities have been completed. Staff proposes the use of a professional construction management firm to serve as Owner's Representative and to minimize the Agency's potential exposure to claims related to the construction project. A single construction management firm is desired in order to coordinate between the multiple contractors who will be used. In order to select a CM firm, staff issued a Request for Statements of Qualifications to four firms. The firms were ranked on a basis of: qualifications of key personnel; experience with similar projects; hourly rates for professional services; and depth of firm resources. A panel interviewed the two top ranked firms with representatives from Redevelopment and the Public Works Department. Douglas E. Barnhart was selected on the basis of their long-standing presence in Palm Desert and the qualifications of the particular personnel who will be used on the project. The recommended professional services agreement was negotiated with Douglas E. Barnhart based upon provision of: a constructability review; recommendations for bidding and award of the construction contract; inspection of the building during construction; administration of the construction contract; negotiation of change orders and recommendations regarding pay applications; conducting progress meetings and preparing minutes of those meetings; preparing and maintaining logs of RFI's, changes, submittals, and similar documents; reviewing and approving schedules, and performing other associated tasks. The attached agreement is for construction management services for up to three separate construction contracts for work at Entrada del Paseo.
