REQUEST: APPROVE AMENDMENT NO. 2 FOR THE DEVELOPMENT OF
FALCON CREST AND THE LA ROCCA VILLAS (CONTRACT
R23390) FOR THE PURPOSE OF INCREASING THE SCOPE OF
WORK THAT INCLUDES AGENCY APPROVED CHANGES TO
DESIGN AND ENGINEERING, ENERGY EFFICIENCY
MEASURES, HOUSING MIX, AND INCREASES IN PUBLIC
AGENGY PERMITS AND IMPACT FEES.

Recommendation:
By Minute Motion, that the Agency Board:
1. Approve Amendment No. 2 in the amount of $509,284 for the
development of Falcon Crest and La Rocca Villas (Contract No.
R23390) for the purpose of increasing the scope of work that
includes Agency approved changes to design and engineering,
energy efficiency measures, housing mix, and increases to public
agency permits and impact fees; and
2. Approve appropriation of $509,284 from the unobligated 20%
Housing Set -aside fund monies to Account No. 870-4698-466-
4001.
Executive Summary:
Approval of the staff recommendation will allow for increases to the Project Costs
excluded from the Stipulated Sum to accommodate both work outside the scope of the
Agreement, and Agency approved increases to design and engineering costs. All items
are necessary for the timely completion of the Falcon Crest and the La Rocca Villas
developments.

Discussion:
On July 14, 2005 the Agency Board entered into an Agreement between the Palm
Desert Redevelopment Agency and ComDyn PD LLC for Fee Developer Services for
Agency Owned Property Located in the City of Palm Desert (Contract No. R23390).
ComDyn PD, LLC was awarded the contract to develop affordable housing on a 20-acre
site located adjacent to Hovley Gardens at Merle Drive/42"d Avenue, the developments
currently known as Falcon Crest and La Rocca Villas.
The original Stipulated Sum Agreement addressed public agency fees and permits,
however, since negotiation these fees have increased. Also City/Agency requested
changes to the streetscape, hardscape, and housing design have amended the original
scope of services, resulting in increased project costs. The changes to the
streetscape/hardscape provided for the inclusion of street trees throughout the
development as proposed by the City of Palm Desert Planning Department. These
revisions have been reviewed and approved by the Landscape Beautification
Committee, and all design element changes were included in the final package
reviewed and approved by the Architectural Review Committee.
The Agency approved contract expressly states and defines the Owner's responsibility
for additional costs in Section 4.1, Items (a) through 0). Staff has reviewed ComDyn's
request for additional funding and agrees that all requests are valid and substantiated
by the Development Agreement.
Please refer to the attached table shown in Exhibit A, which outlines all additional costs
associated with this Amendment.
