No. 06-29CITY OF PALM DESERT/PALM DESERT REDEVELOPMENT AGENCY STAFF REPORT REQUEST: APPROVAL OF ADOPTION OF RESOLUTIONS OF THE CITY COUNCIL AND THE PALM DESERT REDEVELOPMENT AGENCY APPROVING PAYMENT BY THE AGENCY FOR ALL OR A PART OF THE COST OF THE INSTALLATION AND CONSTRUCTION OF FREEDOM PARK SUBMITTED BY: DAVE YRIGOYEN, DIRECTOR OF REDEVELOPMENT/HOUSING DATE: MARCH 9, 2006 CONTENTS: AGENCY RESOLUTION NO. 518 CITY COUNCIL RESOLUTION NO. 06- 29 PROJECT AREA MAP Recommendation: By Minute Motion, that: The Redevelopment Agency adopt Resolution No. 518, a resolution of the Palm Desert Redevelopment Agency approving payment by the Agency for all or a part of the cost of the installation and construction of Freedom Park; and 2. The City adopt Resolution No. 06-29 , a resolution of the City Council of the City of Palm Desert approving payment by the Palm Desert Redevelopment Agency for all or a part of the cost of the installation and construction of Freedom Park. Executive Summary: The adoption of these resolutions will allow funds from Project Area No. 2 to be used in the construction of Freedom Park. Discussion: The City has previously identified Freedom Park to be a benefit to Project Area No. 4 since it is adjacent to that Project Area. As a Regional Park, it will also be of benefit to Project Area No. 2. This finding will provide for flexibility in funding the construction project. Among the findings is that both project areas contain vacant and underutilized properties, properties that suffer from depreciated or stagnant property values, and deteriorated, aged and obsolete buildings. In addition, the project areas are characterized by the existence of inadequate public improvements and public facilities, including inadequate circulation improvements, which cannot be remedied by private or governmental action without redevelopment. One of the benefits is that Freedom Park will increase recreational opportunities and provide new, modern and efficient recreational facilities to serve the residents and taxpayers of the City and Project Areas No. 2 and No. 4. Recreational facilities help reduce crime and juvenile delinquency, which benefits the health, safety and welfare of such residents and taxpayers. Therefore, Freedom Park will assist in the elimination of conditions of blight within both project areas, which are caused by inadequate public improvements. This in turn will assist in eliminating a factor, which prevents or substantially hinders the economically viable use or capacity of buildings or lots and will encourage private -sector investment in both project areas, thereby facilitating the redevelopment of the project areas. Later on the agenda, there will be a request for authorization to award the bid and an additional $2,827,425 from Project Area No. 2. Staff would recommend the approval of this recommendation in order to accomplish the award as presented. Pursuant to provisions of the Community Redevelopment Law (California Health and Safety Code Section 33000, et seq.), and in particular Section 33445 thereof, the Palm Desert Redevelopment Agency proposes to pay for all or a part of the cost of the installation and construction of Freedom Park, which is located on Country Club Drive, immediately adjacent to the northern boundary of Project Area No. 4 and in the immediately vicinity of Project Area No. 2. The City Council has previously determined that both Project Area No. 2 and Project Area No. 4 are areas in which the combination of conditions of blight are so prevalent and so substantial that it causes a reduction of, or lack of, proper utilization of the areas to such an extent that it constitutes a serious physical, social and economic burden on the community which cannot reasonably be expected to be reversed or alleviated by private enterprise or governmental action, or both, without redevelopment. Among other things, both Project Areas contain vacant and underutilized properties, properties which suffer from depreciated or stagnant property values, and deteriorated, aged and obsolete buildings. In addition, the Project Areas are characterized by the existence of inadequate public improvements and public facilities, including inadequate circulation improvements, which cannot be remedied by private or governmental action without redevelopment. Freedom Park will improve recreational facilities in both Project Areas, all for the benefit of the health, safety and welfare of the residents and taxpayers of the Project Areas. Freedom Park will serve a basic purpose of redevelopment; redevelopment includes the provision of structures and spaces as may be appropriate or necessary in the interest of the general welfare, including recreational and other facilities, as well as the provision of public recreation areas. In addition, a fundamental purpose of redevelopment is to expand employment opportunities and to provide an environment for the social, economic and psychological growth and well-being of all citizens. Freedom Park will increase recreational opportunities and provide new, modern and efficient recreational facilities to serve the residents and taxpayers of the City, including the residents and taxpayers of both Project Areas. Recreational facilities help reduce crime and juvenile delinquency, all for the benefit of the health, safety and welfare of such residents and taxpayers. Freedom Park will thereby assist in the elimination of conditions of blight within RESOLUTION NO. 518 both Project Areas which are caused by inadequate public improvements. This in turn will assist in eliminating a factor which prevents or substantially hinders the economically viable use or capacity of buildings or lots and will encourage private -sector investment in both Project Areas, thereby facilitating the redevelopment of the Project Areas. Section 2. The budget constraints of the City prevent the City from financing Freedom Park by any means. No moneys of the City are available to pay for the cost of Freedom Park. Traditional methods of financing such as the issuance of general obligation bonds are unavailable as a practical matter because of the extraordinary majority voter approval requirements of two-thirds of the electorate. Assessment financing or special tax financing could overburden benefiting properties with assessments or special taxes and, in addition, special taxes require a two-thirds vote and assessments are subject to a majority protest. Section 3. The City Council hereby finds and determines that based upon the foregoing and other information presented to the City Council: (i) Freedom Park is of benefit to both Project Area No. 2 and Project Area No. 4 and the immediate neighborhood in which the project is located; (ii) the payment of funds for the cost of Freedom Park will assist in the elimination of one or more blighting conditions inside both Project Areas; (iii) the payment of funds for the acquisition of land and the cost of such facilities is consistent with the Agency's implementation plan adopted pursuant to Health and Safety Code Section 33490; and (iv) no other reasonable means of financing Freedom Park is available to the City. 875201 RESOLUTION NO. 518 Section 4.
