REQUEST: APPROVE AMENDMENT NO. 1 TO THE DEVELOPMENT
AGREEMENT (CONTRACT NO. R23390) WITH COMDYN PD, LLC FOR
THE DEVELOPMENT OF BOTH THE FALCON CREST AND LAROCCA
VILLAS PROJECTS

Recommendation:
By Minute Motion, that the Agency Board approve Amendment No. 1 to Contract
No. R23390 with ComDyn PD, LLC for a no -cost, sixty-eight calendar day time
extension to the construction schedule.
Executive Summary:
Acceptance of this recommendation will authorize ComDyn PD, LLC to add sixty-eight calendar
days to their construction schedule in order to accommodate Agency delays in providing permit
ready drawings for rough grading and improvements in the public right-of-way.
Discussion:
On July 14, 2005, the Palm Desert Redevelopment Agency Board awarded a contract with
ComDyn PD, LLC for the development of affordable housing on the 20-acre site, currently
known as Falcon Crest and the LaRocca Villas. Civil improvements and infrastructure for the
project are close to completion. Sewer and water have been installed, along with streets and
storm drains, and vertical construction is set to begin May 8, 2006. As per the negotiated
Agreement, Exhibit B.3 (A), the Agency as owner was to provide permit ready drawings for
rough grading and improvements in the public right-of-way.
The Agency has worked in earnest to provide ComDyn with permit ready plans. However, due
to the impact of recent development in the Coachella Valley, the Agency experienced extended
review periods. The review timelines were also impacted by the incorporation of an enhanced
street tree landscape element.

ComDyn PD, LLC has worked diligently with the Palm Desert Redevelopment Agency, and
extension of their schedule for construction is required. There are no costs associated with this
Amendment, and the extended construction completion dates are as follows:
