REQUEST: RATIFICATION OF EXECUTIVE DIRECTOR'S APPROVAL OF A
PROFESSIONAL SERVICES AGREEMENT WITH HARRIS &
ASSOCIATES IN AN AMOUNT NOT TO EXCEED $10,000 FOR
THE CALIFORNIA VILLAS REHABILITATION PROJECT

Recommendation:
By Minute Motion, that the Agency Board ratify the Executive Director's approval
of a professional services agreement with Harris & Associates in an amount not
to exceed $10,000 for the California Villas Rehabilitation Project. Funds are
available in Account Number 871-8680-466-4001.
Executive Summarv:
Approval of staff recommendation ratifies an interim agreement approved by the Executive
Director under the authority granted under Title 3, Revenue Finance, of the Palm Desert
Municipal Code.
Background:
At their 11 May 2006 meeting, the Housing Authority Board approved a professional
services agreement with Harris & Associates. Approval of insurance, execution by all
parties, and issuance of the Notice to Proceed typically takes ten days to two weeks.
Since construction work commenced on May 4t", staff found it necessary to retain a
construction manager during the period of time between the contractor's Notice to
Proceed and the construction manager's Notice to Proceed in order to manage the
contractor during the abatement of asbestos and commencement of exterior rehabilitation
of the housing units. Consequently, Harris & Associates agreed to provide the necessary
services on an interim basis under a letter agreement on a time -spent basis for an amount

not to exceed $10,000. The Executive Director approved that letter agreement, and it is
hereby brought before the Agency Board for ratification of the Executive Director's
approval.

Harris & Associates is prepared to offer construction management services on a time -spent basis
in response to your immediate needs at the California Villas Exterior Renovation Project. We
propose to provide the services of Ramiro Herrera, Kurt Gray, John Johnson, and Adriana
Sanchez as Project Manager, Construction Manager, Construction Inspector, and Administrator,
respectively, at the following rates:
Project Manager $170 per hour
Construction Manager $140 per hour
Inspector $120 per hour
Administrator $70 per hour
These services will be provided as necessary to manage the contract with Portrait Homes for the
subject project, on which Notice to Proceed was issued yesterday, 1 May 2006. We will provide
these services on an hourly basis for an amount not to exceed $10,000 under the same germs
an conditions as are in our proposal dated April 26. 2006. We understand that you anticipate
approval of a contract for our full CM services on this project at the next regular meeting of the
Palm Desert Housing Authority. This time -spent agreement proposal will provide our services
during the period leading up to issuance of Notice to Proceed for Harris & Associates after
approval of that contract.
