Recommendation:
By Minute Motion, that the Agency Board:
(1) Approve Change Order No. 1 to Contract No. R25590 for the
change order requests 2, 4, and 8 in the amount of $14,465 for the
Phase Two Civil Improvements at Entrada del Paseo; and
(2) Authorize the Finance Director to move this amount from
contingency to base.
Executive Summarv:
Approval of this recommendation will allow the General Contractor to move ahead as
scheduled with the attached, referenced change order requests. The above -referenced
requests together create Change Order No. 1 in the amount of $14,465.
Discussion:
On 13 July 2006, the Agency Board authorized the award of Contract No. R25590 in the
amount of $695,584.80 to Jacobsson Engineering Construction, Inc. for the construction
of the Phase 2 Civil Improvements at the Entrada del Paseo site.

The Entrada del Paseo site currently has three contractors working simultaneously on -
site. Towards the middle of Jacobsson's job there were some high wind warnings, which
caused blowing sand that was determined as coming from the Agency's undeveloped
adjacent property. Staff requested to have Jacobsson Engineering Construction, Inc. to
include this in their site watering, since they were already on -site and mobilized. This
accounts for Change Order Request No. 2.
Change Order Request No. 4 is for the deletion of work that is currently in Jacobsson
Engineering Construction, Inc.'s scope of work. Steton Construction Group, the general
contractor for Henderson Community Building, was in need of additional staging areas
to store equipment and materials. Since this area is adjacent to their site, they proposed
to delete a portion of work from Jacobsson's contract and add it to their contract for an
equal amount. This is shown on the attached documents as a credit of ($2,860).
Change Order Request No. 8 is due to the delta two changes on the revised grading
plans. These changes include revisions made to the drawings to correct the slope ratio
required for handicap accessibility. These drawing changes also include the adjustment
of curb and gutter from a rolled version which has a steep incline to a design with a near
zero slope to accommodate trash pick-up by Waste Management.
Based on the Architect's, Construction Manager's, and staff's review, Change Order
No. 1 is recommended for approval to allow the construction of the Phase 2 Civil
Improvements at Entrada Del Paseo to move forward towards completion.

This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish
equipment and materials, and perform all work as necessary or required to complete the Change Order items for a
lump sum price agreed upon between the Contractor and the Palm Desert Redevelopment Agency, otherwise referred
to as Owner.
Contract Time Extension -0- Days.
Revised Contract Total $710,049.80
The undersigned Contractor approves the foregoing Change Order # 1 as to the changes, if any, in the contract
price specified for each item including any and all supervision costs and other miscellaneous costs relating to the
change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Change Order # 1 . The Contractor agrees to furnish all labor and materials and perform all other necessary work,
inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order
items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood
that the Change Order shall be effective when approved by the Owner.
Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies,
waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of
or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and
indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as
any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

We have reviewed the attached documentation received for Change Order Request s #2, #4 and # 8 from
Jacobsson Engineering Construction Inc. for the above named project. Based on our review, we recommend
award as follows:
Change Order Request #2 — PCO # 2: Provide dust control utilizing a water truck two times a day. The area
is approximately 2 acres bordered by the storm water channel, Highway 111 and existing development at
Entrada. Duration from April 1, 2007 to August 1, 2007.
Recommended amount of Change Order #2 $9,750.00
Change Order Request #4 — PCO #4: Credit for the deletion of work regarding the retention basin; currently
within the Henderson Community Buildings project site.
Recommended amount of Change Order #4: $-2860.00
Change Order Request # 8 — PCO # 8: Grade change, remove and install curb and gutter per delta two
revised grading plans.
Recommended amount of Change Order # 8 $7575.00

We hereby request that the Original Construction Agreement be modified and amended
by the following deviations from original plans and specifications:
Provide dust control utilizing water truck in area approximately 2 acres bordered
by Stormwater CHannel, Highway ill and existing development at Entrada. Dust
control to consist of twice daily coverage M-F during normal working hours. This
proposal is void if Jacobsson Engineering is not simultaneously engaged in other
work at Entrada Del Paseo. No weekends or after-hours are included.
1. DUST CONTROL April 1, 2007 through August 1, 2007 $9.750.00
Jacobsson to present project manager with weekly ticket for watering.
It is mutually agreed that for such change the contract price is increased by
$9,750.00 (Nine Thousand Seven Hundred Fifty and 00/100) payable with the payments
due under the original construction agreement.
Time for completion of the above cited work is hereby extended 0 days beyond any
completion date set forth in the original contract for such work.
All other provisions of the original contract and agreement shall remain in full
force and effect without change because of the above deviations.
