Recommendation:
By Minute Motion, that the Agency Board:
(1) Approve Change Order No. 3 to Contract No. R22600A for the change
order requests listed above in a cumulative amount of $47,945.85 for the
Henderson Community Building; and
(2) Authorize the Finance Director to move $47,945.85 from contingency to
base.
Executive Summary:
Approval of this recommendation will allow the General Contractor to move ahead as scheduled
with the attached, referenced change order requests. The above -referenced change order
requests total a cumulative amount of $47,945.85.
Discussion:
On 13 July 2006, the Agency Board authorized the award of Contract No. R22600A in the
amount of $4,540,000 to Steton Construction Group for the construction of the new 5,800
square foot Henderson Community Building at the Entrada del Paseo site. Construction is
currently underway and additional changes above and beyond the original contract that need to
be done for a successful completion are presented here for approval.
Two major changes in price have occurred due to a revision in the mop closet layout, and the
requested pricing for the installation of security cameras/equipment. A mop closet was
incorporated in the original design, but during construction, the City Building Maintenance
department requested modifications of this space. These modifications would accommodate a
ventilated, janitorial storage area that could store cleaning chemicals, as well as janitorial supply

products that would serve both Henderson and the Palm Desert Visitor Center. The second
major change reflects pricing for a security system and on -site cameras. The City's Risk
Management department has recommended incorporating these into the building now due to
the type of construction and from past experience on -site to deter vandalism.
The remaining change orders are due to changes in the plans that were not a part of the original
scope that the contractor bid. These items resulted from inspections that required a change in
installation to meet code or specifics not shown on the drawings at bid time that needed
additional clarifications. All of these changes result in a contract price increase of $47,945.85.
The major set back with the key subcontractor on the job requiring replacement due to non-
performance has pushed the completion date back significantly. Although 50% of the building
has now had shotcrete applied, much work remains to be done. A completion date is now on
track for the middle of March.
A 5-day time extension has been granted for Change Order 3, as it has been determined that
change order request 64 would have an impact on the time of completion. Based on review by
the Construction Manager and staff, Change Order No. 3 is recommended for approval to allow
the construction of the Henderson Community Building to move forward towards completion.

This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish
equipment and materials, and perform all work as necessary or required to complete the Change Order items for a
lump sum price agreed upon between the Contractor and the Palm Desert Redevelopment Agency, otherwise referred
to as Owner.
Contract Time Extension -0- Days.
Revised Contract Total $4,615,290.46
The undersigned Contractor approves the foregoing Change Order # 3 as to the changes, if any, in the contract
price specified for each item including any and all supervision costs and other miscellaneous costs relating to the
change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Change Order # 3 . The Contractor agrees to furnish all labor and materials and perform all other necessary work,
inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order
items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood
that the Change Order shall be effective when approved by the Owner.
Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies,
waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of
or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and
indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as
any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

We have reviewed the attached documentation received for Change Order Requests listed below from
Steton Construction Group for the above named project. Based on our review, we recommend award/denial
as follows:
1. COR-27, PCO-20, ACD-17: Additional scone of work (retention pond).
Approved for $2,860.00 with NO time extension.
2. COR-43.1, PCO-30 ACD-28: Owner requested security system (security equipment).
Approved for $13,674.89 with NO time extension.
3. COR-57 : Revised wall angle Fover.
Approved for $7899.29 with NO time extension.
4. COR-64, PCO-46, ACD-41: Owner requested mop closet revision.
Approved for $22,807.68 with a five (5) day extension.
