STANTEC CONSULTING, INC. IN THE AMOUNT OF $18,000

Recommendation:
By Minute Motion, that the Agency Board ratify Contract Amendment No. 1 in
the amount of $18,000.00 to Stantec Consulting, Inc. of Palm Desert,
California, for additional design work associated with the civil improvements
for La Spiga and the Henderson Community Building at Entrada del Paseo.
Funds are available in Account No. 850-4358-433-4001.
Executive Summarv:
Approval of the staff recommendation will ratify a contract amendment approved by the
Executive Director under the authority granted by Section 3.30.270 of the Palm Desert
Municipal Code. The same section of code requires this report of the Executive
Director's action.
Discussion:
Stantec Consulting, Inc., was retained to design the civil improvements and
infrastructure for the Henderson Community Building and La Spiga restaurant at
Entrada del Paseo in January 2006. The design work was substantially complete in
June 2006, based in part on the preliminary design of La Spiga reasturant. Since that
time, the civil improvements and infrastructure work was put out for bid, and the bid
awarded. In recent months, however, the exact placement of La Spiga has changed
several times as the developer of the restaurant has tried to maximize use of the parcel
that he is acquiring. The relocation of the building, although not significant in distance,

necessitated changes to the precise grading plan, the design of the storm drainage
system, and the hardscape in the public right-of-way near the restaurant. It also
required preparation of design documents for encroachment permits from CVWD, and
additional coordination efforts and meetings between Stantec as the civil engineer and
La Spiga's architect, owners, and landscape designer. Contract Amendment No. 1
compensates Stantec for these additional services. It was approved by the Executive
Director on 29 December 2006, and is hereby presented to the Agency Board for
ratification.

This Professional Service Amendment covers changes to the subject contract as described herein. The consultant
shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump
sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as
Owner.
Contract Time Extension -0- Days.
Revised Contract Total $70.800.00
The undersigned Consultant approves the foregoing Professional Service Amendment # 1 as to the changes, if any,
in the contract price specified for each item including any and all supervision costs and other miscellaneous costs
relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on
account of said Professional Service Amendment # 1 . The Consultant agrees to furnish all labor and materials and
perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required
to complete the Professional Service Amendment items. This document will become a supplement of the contract and
all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the
Owner.
Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that
fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or
equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown,
including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of
productivity, as well as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

ENTRADA DEL PASEO PHASE III
ADDENDUM FOR ADDITIONAL SERVICES
SCOPE OF SERVICES
Under the scope of services for "Entrada Del Paseo — La Spiga (Phase III)", Stantec completed
a precise grading plan for La Spiga, to accommodate the restaurant's site plan layout. The
Precise Grading Plan for this was approved June 16, 2006. A "Miscellaneous Tasks" budget
was included in the scope of services to allow for future La Spiga revisions. Unfortunately,
this budget was used for "delta" revisions to the Rough Grading Plans and for revised
calculations for the restaurant site plan through August 2006. With this budget depleted,
Stantec is requesting an addendum to provide additional services to the Palm Desert
Redevelopment Agency (Agency) for the Entrada Del Paseo project as indicated below:
TASK 101 - Bid Set Drawings
Prepare a set of drawings for bidding purposes in conjunction with the "Phase Two Civil
Improvements for Entrada del Paseo" as requested and required by the Agency, including
eliminating a retention basin, revising drainage design and relocating a storm drain line, new
contours, new restaurant pad, eliminate restaurant retaining wall, remove restaurant perimeter
wall, add brick pavers and colored concrete for bid addendum.
TASK 102 - Restaurant Site Lavouts
Prepare alternate site plan layouts for the restaurant incorporating the revised building layout
and revised drainage design, including revised grading contours behind the restaurant and into
the CVWD right-of-way, preparation of an exhibit for CVWD Encroachment Permit
application and cross sections.
TASK 103 - Precise Grading Plan Delta Revisions
Prepare a revised set of Precise Grading Plans as a "delta- I" revision to the approved Precise
Grading Plans. This will incorporate the "Phase Two Civil Improvements for Entrada del
Paseo" bid set drawings and restaurant site layout changes to indicate the new restaurant pad,
new storm drain line, grading into the CVWD right-of-way and revision of quantities.
Prepare another revised set of Precise Grading Plans to integrate the new restaurant site plan
and hardscape layout provided by the architect, finished grade elevations for the new restaurant
pad and court yard area, perimeter walls for the restaurant, with grades, and revision of
construction quantities.
TASK 104 - Meetings and Coordination
Stantec will attend additional meetings, assist with technical information and coordinate with
other consultants and field personnel. This task will be billed at a time and materials basis not
to exceed the amount indicated. In the event that this budget is in jeopardy of being depleted,
Stantec will notify the client so as to budget additional dollars. Stantec will not incur
additional fees without written authorization.
