Approve Amendment No. 5 in the amount of $51,019.39 to ComDyn PD, LLC. for a change in the project scope to include the implementation of modifications to the La Rocca Villas; and 2. Approve appropriation of $51,019.39 from the unobligated 20% Housing set -aside monies to Account No. 870-4698-466-4001. Executive Summary: Approval of the staff recommendation will allow for a change in the scope of work at the La Rocca Villas development to allow for modifications to the stucco finish, telephone jack and outlet placement, and the implementation of pocket doors to provide access to the restroom facility in each unit. Discussion: ComDyn, LLC has provided an opportunity for both the Agency and the architect to preview a La Rocca Villas unit by constructing Unit 14 prior to moving forward with the construction of the balance of the units. Through this process, the Agency was able to identify a number of functional issues that were not determined during the design process. They include outlet/phone jack addition and relocation, the inclusion of a Staff Report Approve Amendment No. 5 to Contract R23390 for implementation of modifications to La Rocca Villas Page 2 of 2 January 25, 2007 pocket door leading to the restroom, and the incorporation of a fine grade finish on the stucco. In each villa, the telephone jacks and outlets in the kitchen and bedroom were revised. This will allow for senior residents to easily access both the telephone and electric outlets in both locations. The total cost associated with the modification is $4,786. The inclusion of a pocket door to the restroom will allow for easy accessibility/fuller range of movement, and will allow for the repositioning of a vertical cabinet close to the shower. By moving the cabinet, in the long term, it will help prevent deterioration and mold growth. The total cost associated with this modification is $18,497. Finally, Agency staff has along with the developer, ComDyn, and architect, Kristi Hanson Architects, Inc. has reviewed and evaluated the architect's recommendation to upgrade the stucco finish. After reviewing panels samples of both rough and fine grade finishes, it was determined that the fine grade presents a smoother finish that compliments the design of the Villas. It will also be easier to keep clean over the life of the buildings. The cost associated with this design modification is $27,736.39. Agency staff recommends the approval of Amendment No. 5 in the amount of $51,019.39 for implementation of modifications to the La Rocca Villas. The consultant shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner. Contract Time Extension -0- Days. Revised Contract Total $27,074,966.88 The undersigned Consultant approves the foregoing Professional Service Amendment # 5 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Professional Service Amendment # 5 . The Consultant agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Professional Service Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the Owner. Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well as any and all consequential damages.
