ADJOURN TO CLOSED SESSION Request for Closed Session: None PRELIMINARY MINUTES PALM DESERT REDEVELOPMENT AGENCY MEETING MAY 24, 2007 Upon motion by Ferguson, second by Finerty, and 5-0 vote of the Agency Board, Chairman Kelly adjourned the meeting to Closed Session of the City Council at 3:03 p.m. He reconvened the meeting at 4:04 p.m. IV. RECONVENE REGULAR MEETING - 4:00 P.M. A. REPORT ON ACTION FROM CLOSED SESSION. None V. AWARDS, PRESENTATIONS, AND APPOINTMENTS None VI. CONSENT CALENDAR ALL MATTERS LISTED ON THE CONSENT CALENDAR ARE CONSIDERED TO BE ROUTINE AND WILL BE ENACTED BY ONE ROLL CALL VOTE. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS MEMBERS OF THE REDEVELOPMENT AGENCY OR AUDIENCE REQUEST SPECIFIC ITEMS BE REMOVED FROM THE CONSENT CALENDAR FOR SEPARATE DISCUSSION AND ACTION UNDER SECTION VII. CLAIMS AND DEMANDS AGAINST THE AGENCY TREASURY - Warrant Nos. 230RDA, 231 RDA, 234RDA, 237RDA, 239RDA, 231-Housing, 235-Housing, 237-Housing, 240-Housing, 236HA, and 241 HA. Rec: Approve as presented. C. REQUEST FOR APPROVAL of Agreement with Southern California Edison for Installation of a Distribution Line to Service the Self-help Lots Located on Merle Drive (Contract No. R26540). Rec: By Minute Motion, authorize the Executive Director to execute the subject agreement for extension of an electric distribution line and residential line extension agreement to service the 14 self-help lots along Merle Drive. 2 PRELIMINARY MINUTES PALM DESERT REDEVELOPMENT AGENCY MEETING MAY 24, 2007 D. REQUEST FOR RATIFICATION of Professional Services Agreement for Landscape Irrigation Coordination Design at Entrada del Paseo (Contract No. R26470). Rec: By Minute Motion, ratify the Executive Director's approval of the subject agreement with Randy Purnel Landscape Architects, Rancho Mirage, California, in an amount not to exceed $5,500 (including reimbursables) — funds are available in Account No. 850-4358-433-4001. Upon a motion by Benson, second by Spiegel, and 5-0 vote of the Agency Board, the Consent Calendar was approved as presented. VII. CONSENT ITEMS HELD OVER None VIII. RESOLUTIONS None IX. NEW BUSINESS None X. CONTINUED BUSINESS None XI. OLD BUSINESS A. REQUEST FOR APPROVAL OF FOURTH AMENDMENT TO THE OWNER PARTICIPATION AGREEMENT WITH AMERICAN INVESTMENT PALMS TO PINES EAST LLC (CONTRACT NO. R19820). Mr. Ortega noted this project had been ongoing for a few years and was almost over the hump. He noted the staff report and developer's request for a short extension. Senior Management Analyst Catherine Walker stated Phases I and II of the Palms to Pines East renovations were substantially complete. She said Mr. Glasser with American Investment Palms to Pines East, LLC, was requesting a short extension to the commencement of Phase III, which represented the facade improvements to the back portion facing El Paseo. 3 PRELIMINARY MINUTES PALM DESERT REDEVELOPMENT AGENCY MEETING MAY 24, 2007 Responding to question, she replied that Mr. Glasser requested to push the commencement of Phase III out to June 18 and complete on October 30 The extension request was to accommodate the restaurant merchants. With regards to notification, Ms. Walker replied she would forward that question to the developer. Member Spiegel moved to, by Minute Motion: 1) Approve Fourth Amendment for improvements to the property pursuant to the Owner Participation Agreement between the Redevelopment Agency and American Investment Palms To Pines East LLC; 2) authorize the Chairman to execute the agreement incorporating the changes. Motion was seconded by Ferguson and carried by a 5-0 vote. XII. PUBLIC HEARINGS A. CONSIDERATION OF PUBLIC TESTIMONY ON THE PROGRESS OF THE PALM DESERT REDEVELOPMENT PROJECT AREAS (JOINT CONSIDERATION WITH THE PALM DESERT CITY COUNCIL). Mr. Ortega stated a plan was adopted in 2004, and it required future reports on how the plan was being implemented. He noted the Five-year Implementation Plan, that explained what the City was doing to abide with the plan and the status of the projects identified. He offered that staff was available to answer questions. Mayor/Chairman Kelly declared the public hearing open and invited public testimony on this matter. With no testimony offered, he declared the public hearing closed. No action was required or was action taken. XIII. REPORTS, REMARKS, AND AGENCY BOARD ITEMS REQUIRING ACTION A.
