Recommendation:
By Minute Motion, that the Agency Board:
Approve a contract amendment in the amount of $49,350 to Douglas E.
Barnhart, Inc., (Contract No. R24780) of Palm Desert, California for continued
construction management services for the Henderson Community Building;
and
2. Authorize the Finance Director to move $19,694 from the original remaining
contingency to the base contract.
Funding for the remaining contract amendment amount of $29,656 is available in the
capital budget for the current fiscal year for the Entrada del Paseo project (Account No.
850-4358-433-4001).
Executive Summary:
Approval of the staff recommendation will approve Contract Amendment No. 1 to allow Douglas
E. Barnhart, Inc., to continue construction management services beyond their original contract
and through the completion of the Henderson Community Building. At its regular meeting of
January 26, 2006, the Palm Desert Redevelopment Agency authorized award of contract with
Douglas E. Barnhart, Inc., for Construction Management Services at Entrada del Paseo to
oversee the Henderson Community Building, the Phase II Civil Improvements, and the Eric
Johnson Phase II Landscaping. The complexities of construction on the Henderson Community
Building has occupied more time than was originally anticipated in the construction manager's
initial proposal.

Discussion:
Due to the complexity of construction, materials, and coordination of work involved with the
Henderson Community Building, additional time is required for the construction manager to
oversee construction through completion. Construction is now well under way and these project
complexities and coordination were not anticipated and included in the original scope of work
proposed by Douglas E. Barnhart. Although additional time to complete the Henderson
Community Building has not been requested from the general contractor, Steton Construction
Group, the construction manager is anticipating a two -month delay based upon a schedule
review and the amount of work that has been completed to date.
The requested contract amendment would allow Douglas E. Barnhart, Inc., to continue to
provide construction management services through project completion. Their services include
the coordination and work involved to resolve contractor issues in the field, review and issue
Requests for Information answers, review and issue Architect's Clarification Directives, review
and enforce project specifications and contract documents, and conduct bi-weekly construction
meetings. The construction manager also acts as the liaison between the Owner and the
general contractor, sub -contractors, architect, materials and soils testing engineers, and all
other consultants that are providing services to this project.
Based on this increased scope of work and the attached projected hour breakdown, staff
recommends approval of Contract Amendment No. 1 to allow continued construction
management services for the Henderson Community Building.

This Professional Service Amendment covers changes to the subject contract as described herein. The consultant
shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump
sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as
Owner.
Contract Time Extension -0- Days.
Revised Contract Total $248,790.00
The undersigned Consultant approves the foregoing Professional Service Amendment # 1 as to the changes, if any,
in the contract price specified for each item including any and all supervision costs and other miscellaneous costs
relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on
account of said Professional Service Amendment # 1 . The Consultant agrees to furnish all labor and materials and
perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required
to complete the Professional Service Amendment items. This document will become a supplement of the contract and
all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the
Owner.
Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that
fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or
equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown,
including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of
productivity, as well as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

Extension of CM Services
Dear Mr. Alvarez,
Per our meeting last week, please review our proposed costs for extension of construction
management services for the Henderson Community Building Project. As we have discussed
previously, additional oversight of the project is required due to the delayed start of construction
from March, 2006 to June, 2006 and the anticipated completion in December, 2007 in lieu of
October, 2007.
These additional 5+ months would have increased the cost of our services in excess of $70,000,
but as the attached projections indicate, we are proposing a reallocation of personnel costs to
minimize the impact to the City to less than $50,000, while providing an increased level of onsite
oversight of the project.
The net increase to our original agreement is $49,350.00, adjusting our contract amount to
$246,290.00. If you have any questions regarding this proposal, please do not hesitate to contact
me at your earliest convenience.
