R25590 OF THE PHASE II CIVIL IMPROVEMENTS AT ENTRADA DEL PASEO SUBMITTED BY: MISSY WIGHTMAN, PROJECT COORDINATOR CONTRACTOR: JACOBSSON ENGINEERING CONSTRUCTION, INC. 41-625 ECLECTIC, SUITE L-1 PALM DESERT, CA 92260 DATE: JUNE 28, 2007 CONTENTS: REQUEST FOR SUBSTITUTION Recommendation: By Minute Motion, that the Agency Board approve the substitution of Jacobsson Engineering Construction, Inc., for J.P. O'Neil, Inc., for the installation of dry utilities only for Contract No. R25590 of the Phase II Civil Improvements at Entrada Del Paseo. Executive Summary: Approval of the subject Substitution of Subcontractor will allow construction of the Phase II Civil Improvements to continue uninterrupted. Discussion: The subject Contract No. R25590 was awarded on November 16, 2006, to Jacobsson Engineering Construction, Inc. for the Phase II Civil Improvements at Entrada Del Paseo. Notice to Proceed was issued on January 11, 2007 to commence work on January 22, 2007, and construction is currently underway. As part of their Information Required of Bidder document, Jacobsson Engineering Construction, Inc. did not list any subcontractors, as the company foresaw themselves completing all the work proposed. They are requesting that the installation of dry utility work be subcontracted to J.P. O'Neil, Inc. due to unforeseen certification issues with Edison and to improve the efficiency of work being performed. California Public Contract Code 4107 requires a written notice to be provided to the proposed substituted subcontractor to be withdrawn from the subject project. Since Jacobsson Engineering Construction, Inc., as general contractor is requesting substitution of himself for a portion of the work, no further notification is required. Jacobsson Engineering Construction, Inc.'s request for subcontractor substitution is attached for verification, and the subcontractor proposed to complete the above -specified portion of work is listed below: J.P. Barnhart, Inc. 41-495 Boardwalk, Suite D Palm Desert, CA 92211 RE: Subcontractor Substitution Dear Mike: This letter is in response to your request for an explanation of why Jacobsson Engineering is requesting a subcontractor substitution for the above referenced project. Firstly, Jacobsson did not initially list a subcontractor for this work because we intended to self -perform the work. Our most recent project installing Edison duct work dates back to summer 2002. During our preconstruction talk with the Edison representative for Entrada, we informed that their requirements had changed since we had last performed their work. One major revision was that a specially certified contractor must perform the tie-in to their existing vaults. Recognizing that this project cannot afford any further complications, we chose to hire an outside firm to install the dry utilities. We feel that their experience in this particular type of installation will be an asset to the project and all its participants. Sincerely, (Pan Jacobsson
