R23390 Recommendation: By Minute Motion, that the Agency Board approve Amendment No. 6 to Contract No. R23390 with ComDyn PD, LLC for a no cost, thirty-five calendar days time extension to the construction schedule for the La Rocca Villas. Executive Summary: Acceptance of this recommendation will authorize ComDyn PD, LLC to add thirty-five days to their construction schedule in order to accommodate Agency delays in surveying the Management/Laundry Facility at the La Rocca Villas, to develop design solutions to accommodate accessibility, as well as address usability issues, with minimal impact to the frame or external design of the structure as possible. After working closely with both ComDyn (Developer) and Kristi Hanson and Associates (Architect), Agency staff decided to move forward with the original design of the facility, and make appropriate adjustments to the layout, as necessary, once the total utility of the space has been determined. As currently conceived, the Management/Laundry Facility will meet the immediate needs of the twenty-seven future residents and management staff. Discussion: At its meeting of February 12, 2004, the Palm Desert Redevelopment Agency approved the Agreement between Kristi Hanson Architects, Inc. At the onset of construction, the Agency identified possible issues with functionality, use, and accessibility that were not fully understood until construction commenced on the management/laundry facility. For example, the management office will be open five days a week, typical of other Agency properties, and work to address residents' concerns effectively and timely, while the laundry facility will be available seven days a week to tenants. After the 35-day review, Staff has determined the building is functional, and will meet the immediate needs of the tenants/management staff as designed. Future improvements will be made, as needed, in order to accommodate the above - mentioned uses. The consultant shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner. Contract Time Extension -35- Days. Revised Contract Total $29,125,986.27 The undersigned Consultant approves the foregoing Professional Service Amendment # 5 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Professional Service Amendment # 5 . The Consultant agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Professional Service Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the Owner. Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well as any and all consequential damages.
