Recommendation:
By Minute Motion, that the Agency Board:
1. Approve Contract Amendment No. 2 in the amount of $56,000 to Douglas E.
Barnhart, Inc., (Contract No. R24780) of Palm Desert, California for continued
construction management services for the Henderson Community Building.
Funds are available in Account No. 850-4358-433-4001.
Executive Summarv:
Approval of the staff recommendation will approve Contract Amendment No. 2 to allow Douglas
E. Barnhart, Inc., to continue construction management services beyond their original contract
and through the completion of the Henderson Community Building and Phase 2 Landscaping.
At its regular meeting of January 26, 2006, the Palm Desert Redevelopment Agency authorized
award of contract with Douglas E. Barnhart, Inc., for Construction Management Services at
Entrada del Paseo to oversee the Henderson Community Building, the Phase II Civil
Improvements, and the Phase 2 Landscaping. The complexities of construction on the
Henderson Community Building and additional scope in the Phase 2 Landscaping have
occupied more time than originally anticipated in the construction manager's initial proposal.
Discussion:
Due to the complexity of construction on the Henderson Community Building and the non-
performance of a critical subcontractor, the Henderson Community Building project will require
additional time for the construction manager to oversee construction through project completion.
The entire building is now 85% framed. The subcontractor responsible for the framing and the
shotcrete process of the walls has delayed the project. Steton Construction, the general

contractor, requested a substitution of this subcontractor and staff held the required
administrative hearing to allow the general and the sub -contractor to state their cases to a
mediator not involved on the project. At the conclusion of the hearing, it was determined that
Steton's request for substitution was valid due to the sub -contractor's non-performance in
adhering to the contracted schedule and the lack of valid worker's compensation insurance.
Steton has now taken responsibility for this work and construction has resumed. The project is
now estimated to be complete by the end of December 2007.
The requested contract amendment would allow Douglas E. Barnhart, Inc., to continue to
provide construction management services through project completion on Henderson and the
recently awarded Phase 2 Landscaping at Entrada del Paseo. Phase 2 Landscaping will begin
in mid -October and is scheduled to be complete by mid -February. Their services include the
coordination and work involved to resolve contractor issues in the field, review and issue
responses to Requests for Information, review and issue Architect's Clarification Directives,
review and enforce project specifications and contract documents, and conduct bi-weekly
construction meetings. The construction manager also acts as the liaison between the Owner
and the general contractor, sub -contractors, architect, materials and soils testing engineers, and
all other consultants that are providing services to this project.
Based on this increased scope of work and the attached projected hour breakdown, staff
recommends approval of Contract Amendment No. 2 to allow continued construction
management services for the Henderson Community Building.

This Professional Service Amendment covers changes to the subject contract as described herein. The consultant
shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump
sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as
Owner.
Contract Time Extension -0- Days.
Revised Contract Total $304,790.00
The undersigned Consultant approves the foregoing Professional Service Amendment # 2 as to the changes, if any,
in the contract price specified for each item including any and all supervision costs and other miscellaneous costs
relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on
account of said Professional Service Amendment # 2 . The Consultant agrees to furnish all labor and materials and
perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required
to complete the Professional Service Amendment items. This document will become a supplement of the contract and
all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the
Owner.
Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that
fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or
equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown,
including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of
productivity, as well as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

Please review the attached for additional extension of construction management services for the
Entrada del Paseo projects. As previously discussed, additional oversight of the project is
required due to postponement of the bid of the Landscape Park Project from June, 2007 to
August, 2007 with a new anticipated completion at end of January, 2008.
Per the attached chart, time is divided between the Henderson Building Project and the
Landscape Park Project during the months of August — December, 2007. The anticipated
completion of the Henderson Building in November/December places our management on a full-
time basis overseeing the completion of the Landscape Park Project by the end of January, 2008.
The net increase to our adjusted contract amount of $246,290.00 is $56,000.00, further adjusting
our contract amount to $302,290.00. If you have any questions regarding this proposal, do not
