Ratify Contract Amendment No. 5 in the amount not -to -exceed $25,000 with Douglas E. Barnhart, Inc., (Contract No. R24780) of Palm Desert, California for continued construction management services at the Henderson Community Building. Funds are available in Account No. 850-4358-433-4001. Executive Summanr: Approval of the staff recommendation will ratify Contract Amendment No. 5 with Douglas E. Barnhart, Inc. (DEB), to provide construction management services beyond their original contract. The Henderson Community Building is substantially complete, with only punch list items remaining. Staff recommends ratification of contract amendment with DEB in the amount not -to -exceed $25,000 services rendered in July and August 2008. Discussion: Due to the complexity of construction and non-performance of a critical subcontractor, the Henderson Community Building project has been delayed. The new completion date is August 2008. The proposed contract amendment will ratify a contract amendment with Douglas E. Barnhart approved by the Executive Director in the amount not -to -exceed $25,000 for construction management services rendered in July and August 2008. Staff Report Douglas E. Barnhart, Inc. Contract Amendment No. 5 (Contract No. R24780) Page 2 of 2 August 28, 2008 The construction management services include the coordination and work involved to resolve contractor issues in the field, review and issue responses to Requests for Information, review and issue Architect's Clarification Directives, review and enforce project specifications and contract documents, and conduct bi-weekly construction meetings. The construction manager also acts as the liaison between the Owner and the general contractor, sub -contractors, architect, materials and soils testing engineers, and all other consultants that are providing services to this project. Based on the extended project completion date, staff recommends approval of the ratification of Contract Amendment No. 5 for construction management services rendered in July and August of 2008 and through the completion of the project. Contract R24780 Amendment No. 5 Continued from front This Professional Service Amendment covers changes to the subject contract as described herein. The consultant shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner. Contract Time Extension -0- Days. Revised Contract Total $444,050.00 The undersigned Consultant approves the foregoing Professional Service Amendment # 5 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Professional Service Amendment # 5 . The Consultant agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Professional Service Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the Owner.
