R23390 Recommendation: By Minute Motion, that the Agency Board: 1. Approve Amendment No. 16 in the cumulative amount of $1,624.32. Representing a deductive contract amendment in the amount of ($16,261.75), and an additive contract amendment in the amount of $17,886.07 for changes to the scope for the Falcon Crest development (Contract No. R23390). Executive Summarv: Approval of staffs recommendation will allow for a cumulative amendment in the amount of $1,624.32. This request is comprised of two amendments. The first represents a deduction to the scope of work at the Falcon Crest development. This will result in a ($16,261.75) credit to the Agency for the removal of a block wall from ComDyn's contractual scope of work. The second represents an additive amendment in the amount of $17,886.07 for drainage reconfiguration at the Emergency Access Lot "I". Discussion: On July 14, 2005, the Palm Desert Redevelopment Agency Board authorized an agreement with ComDyn PD, LLC for the development of affordable housing on the 20-acre site, currently known as Falcon Crest and the La Rocca Villas. Staff Report Approve Amendment No. 16 to Contract No. R23390 (ComDyn PD, LLC) February 14, 2008 Page 2 of 3 During the time of execution of the contract, all rough grading plans represented a block wall condition along the western boundary of the well site. In subsequent approved rough grading plans, the wall condition has been changed to that of a permanent fence along the western boundary to the well site, and is called out as such on the amended rough grading plans. As per Ordinance No. 1091A, a chain link fence cannot be a permanent wall condition in the City of Palm Desert, and will not be installed. The fence was implemented to accommodate CVWD's irrigation line/conditions of approval; however, this is not an acceptable permanent condition. The change in scope detailed below represents a deductive change order to the Agency for the original block wall condition. It will also allow for a comprehensive plan to be considered for the adjacent lot to accommodate use by the La Rocca Villas for the purpose of storage. Upon further review by the Public Works Department, the drainage solution, as originally conceived at the time of the approval, was not practical or efficient in the field. Public Works requested resolution of the potential flooding and storm drainage from the adjacent Hovley Gardens property. The solution, as approved by Public Works, represents additional work not conceived in the initial project costs in the amount of $17,886.07. This solution will accommodate the drainage from Hovley Gardens and preserve the Emergency Access topical materials implemented for Fire Department use.
