R20550) FOR CONTINUED LANDSCAPE CONSTRUCTION ADMINISTRATION SERVICES FOR ENTRADA DEL PASEO LANDSCAPING PROJECTS SUBMITTED BY CONTRACTOR DATE: CONTENTS Recommendation: MISSY GRISA, PROJECT COORDINATOR HSA DESIGN, INC. 42-575 MELANIE PLACE PALM DESERT, CA 92211 FEBRUARY 28, 2008 CONTRACT AMENDMENT NO. 4 TO CONTRACT NO. R20550 By Minute Motion, that the Agency Board: 1. Approve Contract Amendment No. 4 in an amount not -to -exceed $10,625 plus $300 for reimbursable expenses to HSA Design Group (Contract No. R20550) for continued landscape construction administration services for Entrada Del Paseo projects. Funds are available in the Entrada Del Paseo capital improvement budget (Account No. 850-4358-433-4001). Executive Summary: Approval of staff recommendation will allow HSA Design Group to continue providing landscape construction administration services through completion of the Henderson Community Building, Eric Johnson Phase II, and the Multi - sensory Landscaping at Entrada Del Paseo. The proposed contract amendment is in the amount of $10,625, plus $300 for reimbursables. Staff recommends that the Agency amend the contract with HSA Design Group to allow for continued construction administration services to handle field design/construction questions that arise during construction. Staff Report Approve Contract Amendment No. 4 to HSA Design Group (Contract No. R20550) Page 2 of 2 February 28, 2008 Discussion: HSA has been involved in the landscape design of the master site plan for the Entrada Del Paseo project since project conception in 2000. Since design and site layouts have changed in the past, projected funds for construction administration have been depleted. The landscaping of the Eric Johnson Phase 2 Gardens, the Multi -Sensory Gardens, La Spiga, and the Palm Valley Storm Channel are under construction with the majority of the above -mentioned projects scheduled for completion at the end of March. HSA Design Group has submitted Addendum No. 4 for an extended scope of services, which will include construction administration such as review of materials, request for information response, construction observation, field change orders, and project close-out. Since construction has begun, HSA has been spending approximately 25 hours a month on -site. Staff recommends approval of the amendment as submitted to take us through project completion. The consultant shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner. Contract Time Extension -0- Days. Revised Contract Total $151,360.50 The undersigned Consultant approves the foregoing Professional Service Amendment # 4 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Professional Service Amendment # 4 . The Consultant agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Professional Service Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the Owner. Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well as any and all consequential damages. SCOPE OF SERVICES Phase I — Construction Administration Services Construction Administration services shall be provided and billed on an hourly rate. These service fees are to be incurred only through prior authorization by the Client and/or Client Representative and may include but are not limited to the following scope of services: 1. Submittal Review. Review pertinent submittals for the Landscape Architectural improvements within the construction documents and provide approvals, rejections or requests for additional information as required. 2. Requestfor Information Response. Provide responses to Contractor and Project Manager issued Requests for Information in regards to clarification for Landscape Architectural improvements, and provide design clarification or redesign if necessary. 3. Construction Observation. HSA Design Group will provide observation services during the construction process and will provide input and recommendations as necessary based upon site visits to review construction progress on the Landscape Architectural improvements. 4. Field Change Orders. HSA Design Group will provide direction to the Project Manager in written format for Field Changes Orders that are requested and approved by the Client. 5. Project Close -Out. At the completion of the construction process, HSA Design Group will coordinate with the Project Manager for preparation of a punch list which delineates the remaining Contractor responsibilities in order to complete the project to the satisfaction of the Contractor's contract. ii.
