PROPOSAL CONTRACT AMENDMENT NO. 3 Recommendation: By Minute Motion, that the Agency Board: 1. Approve Contract Amendment No. 3 in the amount of $76,100 to Douglas E. Barnhart, Inc., (Contract No. R24780) of Palm Desert, California for continued construction management services at Entrada del Paseo. Funds are available in Account No. 850-4358-433-4001. Executive Summary: Approval of the staff recommendation will approve Contract Amendment No. 3 with Douglas E. Barnhart, Inc. (DEB), to provide construction management services beyond their original contract. The contract amendment approved in September 2007 provided additional construction management services for the following construction projects at Entrada del Paseo scheduled to be completed by January 2008. • Henderson Community Building • Phase II Civil Improvements Due to the complexities of construction, the Henderson Community Building is now scheduled to be complete in April 2008. The Phase II Civil Improvements are 95 percent complete, but staff is proposing to include the addition of 24 overflow parking spaces and the paving of originally specified turf block fire access lane near La Spiga and Henderson Community Building. In addition, under this contract amendment, DEB will provide construction management services on the Entrada del Paseo Phase 2 Landscaping which includes finalizing all landscaping at the site. Staff recommends approval of the contract amendment to provide construction management services through the completion of all current projects at Entrada del Paseo (April 2008). Contract Amendment No. 3 (Contract No. R24780) Page 2 of 2 February 28, 2008 Discussion: Due to the complexity of construction and non-performance of a critical subcontractor, the Henderson Community Building project has been delayed. The new completion date is April 2008. The proposed contract amendment will extend the construction management services contract with Douglas E. Barnhart in the amount of $76,100, for an additional three months (February -April) for all construction projects underway at Entrada del Paseo. The construction management services include the coordination and work involved to resolve contractor issues in the field, review and issue responses to Requests for Information, review and issue Architect's Clarification Directives, review and enforce project specifications and contract documents, and conduct bi-weekly construction meetings. The construction manager also acts as the liaison between the Owner and the general contractor, sub -contractors, architect, materials and soils testing engineers, and all other consultants that are providing services to this project. Based on this increased scope of work and the attached projected hour breakdown, staff recommends approval of Contract Amendment No. 3 to continue construction management services at Entrada del Paseo. Contract R24780 Amendment No. 3 Continued from front This Professional Service Amendment covers changes to the subject contract as described herein. The consultant shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner. Contract Time Extension -0- Days. Revised Contract Total $380,890.00 The undersigned Consultant approves the foregoing Professional Service Amendment # 3 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Professional Service Amendment # 3 . The Consultant agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Professional Service Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the Owner. Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well as any and all consequential damages. This document will become a supplement to the Contract and all provisions will apply hereto, all items included above must have required signatures as per the purchase resolution.
