PROPOSAL
By Minute Motion, that the Agency Board approve Professional Services
Amendment No. 1 in an amount not -to -exceed $25,500 for Contract No.
R24980A with Interactive Design Corporation to prepare deconstruction and
recycling plans for demolition of Country Village Apartments.
Funds are available in Account Nos. 870-4195-466-3092 and 854-4195-466-3092.
Executive Summary:
Approval of staff's recommendation will allow preparation of environmentally friendly
deconstruction and recycling plans for demolition of the Country Village Apartments. Rejection
of staff's recommendation will require demolition and disposal without plans for reuse and
recycling.
Discussion:
In August 2006, the Agency contracted with Interactive Design Corporation (IDC) to provide site
utilization and configuration at the existing Country Village Apartments' site at 42-555
Washington Street on the southwest corner of Washington Street and Avenue of the States and
adjacent property to the south at 42-615 Washington Street. On October 11, 2007, the Agency
Board approved a contract with IDC to develop a schematic site plan for these properties to
include Casey's Restaurant, a future fire station, and an affordable senior apartment project,
including a conceptual architectural design.

Before the proposed improvements can be built, the existing Country Club Apartments will need
to be removed. A relocation plan has been prepared for the existing tenants, and removal of the
existing buildings is intended to begin shortly after all of the units are vacated. The subject
professional services amendment will provide plans for environmentally friendly removal of the
buildings and clearing of the site. IDC will provide plans and specifications for the following:
Phase One
• Remediation of hazardous materials
• Deconstruction and demolition of the buildings above the concrete slabs
• Reuse and recycling of removed materials
• Disposal of non -recyclable materials
Phase Two
• Deconstruction and demolition of the balance of the site, including concrete
slabs, asphalt, and below grade items, which will remain in place until site
grading begins to limit fugitive dust and erosion
• Reuse and recycling of removed materials
• Disposal of non -recyclable materials
• Crushing and reconditioning of concrete and asphalt on site (optional)
IDC's scope of services also include: (1) preparation of bid documents for Phase One; (2)
contract administration for Phase One; and (3) coordination and estimated cost for professional
services provided by Civil Engineer.
Staff recommends approval of the subject amendment to prepare deconstruction and recycling
plans for demolition of the Country Village Apartments.

This Professional Service Amendment covers changes to the subject contract as described herein. The consultant
shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump
sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as
Owner.

The undersigned Consultant approves the foregoing Professional Service Amendment # 1 as to the changes, if any,
in the contract price specified for each item including any and all supervision costs and other miscellaneous costs
relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on
account of said Professional Service Amendment # 1 . The Consultant agrees to furnish all labor and materials and
perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required
to complete the Professional Service Amendment items. This document will become a supplement of the contract and
all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the
Owner.
Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that
fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or
equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown,
including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of

Amendment to
Contract Services Agreement for
Architectural Design Consulting Services
Dated October 01, 2007
Based upon the provisions for Contract Amendment in above mentioned contract, the
following amendment shall be incorporated in the Agreement:
SECTION I I -SERVICES
I. ARCHITECT'S SERVICES:
E. Demolition Plan and Specifications: Prepare a demolition plan for two phases of
work. Phase One includes the demolition and/or de -construction and recycling
of the buildings above the concrete slab; Phase Two includes the on -site re-
conditioning of concrete, concrete with re -bar, and asphalt.
Phase One includes the remediation of hazardous material, demolition
and deconstruction of the project materials (buildings) above finish grade
and finish building slab. The demolition plan will include the
deconstruction recycle and reuse programs for items listed in the Palm
Desert Construction/Demolition Debris Recyclers and Reuse sites
determined during this phase. Items such as asphalt, concrete, concrete
w/ rebar will be included as part of Phase Two work. Destination of
recycled material to be provided by Lisa Ream, Recycling Technician
from the City of Palm Desert. Destination of reuse sites will be finalized
based on research provided by Architect.

b. Phase Two includes the deconstruction of the project materials below
finish grade and finish building slab. The demolition plan will include the
deconstruction recycle program for concrete, asphalt, rebar, piping, etc.
The concrete and asphalt will be crushed and reconditioned on -site for
use as sub -base material for new driveways and parking areas of the
proposed project. Utility Data will also be provided in this plan for
reuse or permanent capping. The information of Phase Two will be
provided to the Agency for inclusion in the scope of work for the
construction of the proposed housing project.
Note: the concrete and other paving material will remain in place both
to limit fugitive dust and erosion, and for recycling as part of the as part
of the construction of the new housing project.

H. Civil Engineering Consultant:
a. Site Demolition Plan: Using information from the ALTA Surveys (by
DUDEK and STANTEC) supplemented by field review, Civil Engineer to
provide location, size, and invert elevations of on -site utility meters,
underground lines and points of connection.
b. Site Demolition Plan: Civil Engineer to provide direction for on -site
"potholing" to locate below grade utilities and record same on
demolition plan.
c. Utility Plan: Civil engineer to research and provide the sizes of existing
utility line feeds to the site (laterals), off -site main line sizes, and points
of connections for water, sewer, storm drain, electrical, phone, cable,
and gas.

Today our office received the above referenced Agenda and Staff report from the City of
Palm Desert. Although I had Intended to be writing.to you with a simple update relating to your: , , ,.
inquiry of last Friday regarding PDCC Development's progress in connection with the Golf `
Course Maintenance facility and update on the Cart Path configuration, we Celt that the notice
we recelved greatly impacts the update we Intended to make.

Our response on •the matters about which you inquired changes little from the reports we
have given in the, recent past. Speciflcally, PDCC Development is still waiting for a response to
its. detailed Gateway Project proposal, a copy of which I have Included for your reference. To
veep, PDCC Development has been working with the Redevelopment Agency on a master
planned Gateway Project for the Palm Desert Country Club Community, During its last meeting
With agency representatives in October 2007, PDCC Development was made aware that the
Agehcy intended to proceed.with a previously proposed project involving Casey's Restaurant &
Bar, a City Fire'Station and the Country Village Apartments. Although details were not forth
coming, this proposal deletes the retail component from the proposed project only and the
remainder of the redevelopment concept and proposal remained unchanged.
Our, client's• last, communication with the Agency was in November when Mr. Kosmont
spoke, with. W. McCarthy as a follow up to the PDCC Development presentation and Mr..
Kosmont's follow up letter dated October 24, 2007, a copy of which is also attached. During the
cal(;,'Mr. McCarthy stated that he was reviewing the information presented, including the pro .
formas.bn affordable and worker housing, and that he would be getting back to Mr. Kosmont.
Mr.'Xosmont stated that PDCC Development would take no .action until hearing from the
Agency. As we have noted in the past, the Maintenance Facility issue is tied directly to the
proposed project, even as -reduced in scope. If that project: goes forward, the facility must be
relocated and the current site incbrporated into the Gateway Project, To address the other two
itSULas raised in your e-mail prior to addressing the larger redevelopment Agency matter, the
debris located. at the maintenance facility has been removed and PDCC Development has
assured. the adjacent homeowners that the accumulation will not happen again- Regarding the

cart path reconfiguration, the proposal PDCC Development received for the final design work
was out,of keeping with standard rates and our client has put,the job out for further. bid.
Contrary to what may have been reported to the City, PDCC Development has not stopped
work on this portion of the project and will commenm the reconfiguration work as soon as final
bids are received.
Regarding the Materials received today from the City, we have done as much research
and investigation as we could regarding the proposed action and staff report in order to bring
our concerns to your attention before tomorrow's Redevelopment Agency and Housing Authority
Meeting, In mehy instances we are drawing what we consider logical conclusions from the
information we have in hand. 'One of the biggest concerns is that information has just not been
made available to the PDCC community. We ask for you indulgence if we have come to an
incorrect conclusion. We trust you will correct any faulty information we have or conclusions we
have reached.','.
The Palm Desert. Redevelopment Agency (RDA) recently Issued Staff Reports regarding
thle.bbnsideration of a Relocation Plan by Overland, Pacific & Cutler, Inc. and a Deconstruction
and Recycling Plan by Interactive Design•Corporation ('tDC'') for -the Country Village Senior
Apartments located at 42455 Washington Street (noted in the reports as 42-655 Washington
Stt" et and 42-555 Avenue of the Staters). Agency staff is requesting, approvals on January•24,
2068 in connection with the plans an..d corresponding expenditures.: •:

environmental analysis as required by the California Environmental Quality Act ("CIECW) of
which we are aware.
Based on -the above, we believe: '

• These are discretionary actions which cumulatively may result in physical
changes to the anvironment - thereby necessitating CEQA review

At a minimum, such a large project involving the redevelopment of Casey's Restaurant &
Bar, a future fire station, and an affordable senior apartment project may have environmental
impacts, including but not limited to.,
• Land Use impacts (a bar open until midnight, and a fire station next to senior
housing)
• Noise impacts (a fire station with on -site fire alarms and truck alarms, adjacent to
senior housing)
" Construction -related impacts (demolition of Country Village Apartments including
asbestos and lead paint disturbance and removal)
• . Cumulative impacts
These environmental impacts should be analyzed as part of CEQA review'by means of a
Mitigated Negative Declaration or -an Environmental Impact Report. However.'no documents -
pettaining to CEQA or an Initial Study Checklist required. under CEQA have been disclosed to
the -public. resulting in our conclusion that CEQA review has not transpired.
Lack of environmentaJ'review and/or segmentation of the redevelopment of a large
project involving Casey's Restaurant & 139r, a future fire station, and an, affordable senior
apartment project is improper and violates the requirements of CEQA.
CEQA mandates: .
"...environmental considerations do not become submerged by chopping a large
project into many little ones , each w th a minimal potential impact.. on the
environment . which cumulatively may have disastrous consequences."
As counsel for nearby property owner PDCC Development, we request that the Agency
act expadltiously'to initiate full CEQA review in connectlon with the redevelopment project
involving Casey's Restaurant & Bar, a futura fire station, and a new affordable senior apartment.

immediately. Our client advises that numerous PDCC Club members who reside in the area,
horse owner association ,representatives and Palm Desert County Club home owners with

Good evening, my name is Karen Lyons and I live at 77065 New York Ave. in the Palm Desert
Country Club Community.
I am very concerned with tonight's Redevelopment Agency Meeting, specifically:
Agenda Item VI. D. — "Request for Approval of Amendment No. 1 to Contract No. R24980A-
Professional Design Services for Country Village Apartments at 42-555 Washington Street" and
Agenda Item IX. B. — "Request for Approval of the Final Relocation Plan for the Country Club
Village Apartment Project at 42-555 Washington Street."
The public has received no notice as to the details of the project being planned at 42-555
Washington Street. The Agency admits in its staff reports and other public documentation that
the project at this site will include affordable housing, yet the community has not been advised or
engaged as to the details of this project. There has been no communication between the city and
us! The location of this site is a crucial part of our community as it is our primary point of
entrance; this is why we are so concerned.
While I am here as an individual, this project would affect everyone in the immediate vicinity of
Washington Street and Avenue of the States, including the HOA property.
As an individual, I am here to say there should be no decision on these agenda items
tonight. In fact, I think if you make a decision tonight you will be violating the California
Environmental Quality Act (CEQA) because you have not provided environmental studies on
what is clearly a project under CEQA.
My community is simply asking to be a part of this process. The city has imparted a lot of
affordable housing on our local community. Why should we accept more affordable housing and
a reconstructed bar and restaurant as the best use for this site? If it is evaluated as the best use
for the site, why not consult with us so that we may give you input on how this development
should look, how the development may affect traffic and whether there is adequate aesthetic
public improvements on Avenue of the States, which requires a significant upgrade. You should
not be able to build this project without improving Avenue of the States.
The Palm Desert County Club has recently improved a significant part of the community by
investing over $13 million. All of us in the community have become very involved, especially
since our golf course has been dramatically improved and has become an award winning facility.
This community deserves to be a part of any plans, especially plans that address our major point
of entry on Washington Street and Avenue of the States. The city has ignored us by not coming
to the community with a workshop to discuss the plans and to discuss whether or not it is
appropriate to add more affordable housing to a community that has gotten more than its fair
share. We think you need to find other neighborhoods in Palm Desert in which to develop
affordable housing, not just ours. We think you should help us plan our community instead of
secretly moving forward on a project that has never been discussed, even though you have
worked on it for 18 months.
Please do not act on these agenda items tonight! Please respect our community and come to
us to discuss this project, tell us what it's about, let us provide input, and certainly do not ignore
CEQA as that would be a breach of your responsibility as civic leaders.
