EXHIBIT B LOCATION MAP Recommendation: By Minute Motion, that the City Council/Agency Board authorize the City Manager/Executive Director to execute the Grants of Easement/Pipeline agreements to the Coachella Valley Water District after formal review and approval of all associated documents by the Coachella Valley Water District and the City Attorney. The easements will facilitate construction by WVC Rancho Mirage, Inc., of the Starwood development at the Desert Willow Golf Resort. Executive Summary: As outlined in Exhibit B, two of the three easements are to be obtained from the City of Palm Desert and the third grant of easement is to be obtained from the Palm Desert Redevelopment Agency. Approval of the staff recommendation will allow for execution of the agreements once formal approval from the Coachella Valley Water District has been obtained and the City Attorney has reviewed and approved all associated documentation. Staff Report Authorization for Grants of Easement/Pipeline Agreements to CVWD for development at Desert Willow Golf Resort Page 2 of 2 June 26, 2008 Discussion: On March 22, 2007, the Agency Board approved the Third Amendment to the Disposition and Development Agreement between the Palm Desert Redevelopment Agency and WVC Rancho Mirage, Inc. (Starwood) for the implementation of the Starwood Master Plan and subsequent development at the Desert Willow Golf Resort. These Grants of Easement and Pipeline agreements to CVWD will facilitate the WVC Rancho Mirage, Inc. development at Desert Willow, and allow for the implementation of two domestic water lines and one sewer line to service the development. CVWD is in the final stages of approval for all associated exhibits and documentation. Once formal approval is obtained and all documents have been reviewed by the City Attorney, this action will allow for the execution of the Grants of Easement and Pipeline agreements.
