PROPOSAL CONTRACT AMENDMENT NO. 4 Recommendation: By Minute Motion, that the Agency Board: 1. Approve Contract Amendment No. 4 in the amount of $38,160 to Douglas E. Barnhart, Inc., (Contract No. R24780) of Palm Desert, California for continued construction management services at Entrada del Paseo. Funds are available in Account No. 850-4358-433-4001. Executive Summary: Approval of the staff recommendation will approve Contract Amendment No. 4 with Douglas E. Barnhart, Inc. (DEB), to provide construction management services beyond their original contract. Contract amendment No. 3 approved in February 2008 provided additional construction management services for the all construction projects at Entrada del Paseo scheduled to be completed by the end of April 2008. Henderson Community Building Entrada Phase II Civil Improvements E.J. Phase II Landscaping The Phase II Civil Improvements and the Eric Johnson Phase II Landscaping projects are substantially complete, with punch list items being addressed. The Henderson Community Building is nearing completion and 90 percent complete. The project is scheduled to be complete in early June 2008. Staff recommends approval of the contract amendment to provide construction management services in the amount of $38,160 to allow proper oversight through the completion of the Henderson Building. Contract Amendment No. 4 (Contract No. R24780) Page 2 of 2 May 22, 2008 Discussion: Due to the complexity of construction and non-performance of a critical subcontractor, the Henderson Community Building project has been delayed. The new completion date is June 2008. The proposed contract amendment will extend the construction management services contract with Douglas E. Barnhart in the amount of $38,160, through completion and closeout of the Henderson Building. The construction management services include the coordination and work involved to resolve contractor issues in the field, review and issue responses to Requests for Information, review and issue Architect's Clarification Directives, review and enforce project specifications and contract documents, and conduct bi-weekly construction meetings. The construction manager also acts as the liaison between the Owner and the general contractor, sub -contractors, architect, materials and soils testing engineers, and all other consultants that are providing services to this project. Based on this increased scope of work and the attached projected hour breakdown, staff recommends approval of Contract Amendment No. 4 to continue construction management services through the completion of the Henderson Building. The consultant shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner. Contract Time Extension -0- Days. Revised Contract Total $419,050.00 The undersigned Consultant approves the foregoing Professional Service Amendment # 4 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Professional Service Amendment # 4 . The Consultant agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Professional Service Amendment items.
