POMONA, CA 91766 NOVEMBER 20, 2008 CONTRACT NO. R28170 By Minute Motion, that the Agency Board: 1. Authorize the award of Contract No. R28170 in the amount of $313,636 to Three D Service Company, Inc. for the deconstruction of the Country Village Apartments; 2. Authorize the Finance Director to set aside the amount of $31,363 as 10% contingency (use of contingency requires additional action); and 3. Funds are available in Account No. 870-4498-464-4001. Executive Summarv: Acceptance of staff's recommendation will award a contract to Three D Service Company, Inc. (Pomona, California), in the amount of $313,636 for the deconstruction of the Country Village Apartments. The deconstruction will provide for an environmentally friendly deconstruction of 66 dilapidated apartment units. The deconstruction will achieve the reuse or recycling of 75% of the materials and will prepare site for future redevelopment. Staff Report Award of Contract R21870 to Three D Service Company, Inc. — Deconstruction of Country Village Apartments Page 2 of 4 November 20, 2008 Discussion: In November 2005, the Redevelopment Agency acquired Country Village Apartments, 66 studio apartments on Washington Street and Avenue of the States. In August 2006, the Agency contracted with Interactive Design Group (IDC) to provide site utilization and configuration services for the Country Village Apartment site and adjoining properties to the south. On 11 October 2007, the Agency Board approved a contract with IDC to develop a schematic site plan for these properties to include Casey's Restaurant, a future fire station, and an affordable senior apartment project, including a conceptual architectural design. The proposed site includes both the existing Country Village Apartment parcel and the recently acquired 2.6 acres adjacent to the south. The results of the site utilization study concluded that the existing 66 apartment unit complex is not salvageable due to drainage and infrastructure issues. On 24 April 2008, the Agency Board approved Contract Amendment No. 1 with IDC for the preparation of deconstruction and recycling plans for the demolition of Country Village Apartments. The deconstruction plans detail procedures for environmentally friendly removal of the buildings and clearing of the site including: • Deconstruction of the Country Village Apartments which includes the removal of hazardous material and recycling/reuse of building materials with a goal of 75% diversion from the landfill of all building and site components; • Deconstruction of parking lot and underground utilities which includes the recycling/reuse of paving materials on the project site; Removal and green wasting of landscaping at adjacent Agency property; • Rough grading and soil stabilization to prepare the site for future construction. On 2 October 2008, the City Clerk advertised and called for bids for the deconstruction of the Country Village Apartments. IDC designed the approximately 110,000 square foot area deconstruction plans. The advertisement for bids was published in the Desert Sun and plans were available for pick up and distribution through OCB Reprographics' PlanWell site. Twenty-eight contractors picked up plans, thirty-two attended the pre -bid conference held on 9 October 2008, and sixteen attended the 20 October 2008 pre -bid conference. On Friday, 24 October 2008, the fourteen bids submitted were publicly opened and read. Three D Service Company, Inc. was the lowest responsible bidder and is based in Pomona, California. Based on staff's review and the bid results, staff recommends award of a contract to Three D Service Company, Inc. in the amount of $313,636. Relocation of the remaining tenants is complete and deconstruction can commence. Deconstruction of the project will start in December 2008 and will be complete in mid -February 2009. Staff is also in the process of designing a 72 unit affordable senior housing project on this site. A concept plan was presented to the Housing Sub -Committee and was received favorably. Staff is proceeding in developing preliminary plans to be presented to the Architectural Review Committee, Planning Commission, and City Council. CONTRACTOR shall commence the work within ten (10) calendar days after the date of the Notice to Proceed and will do all things necessary to construct the work generally described in Recital No. 1 in accordance with the Contract Documents and will complete said work within seventv-five (75) consecutive calendar days from the Notice to Proceed date to the satisfaction of the Owner's Representative. 3. That the CONTRACTOR agrees to indemnify, defend, and hold harmless the OWNER, and its officers, and employees, the ARCHITECT and Owner's Representative from any and all claims and losses accruing or resulting to any and all contractors, subcontractors, material men, laborers, and any other person, firm or corporation furnishing or supplying work, services, materials or supplies in connection with the performance of this Agreement. 4. Attention is directed to Section 00700-6.5, "Liquidated Damages" of the General Conditions. Liquidated damages shall be $1,500 dollars per calendar day of delay. 5. Should any litigation or arbitration be commenced between the parties concerning the works of improvements as referenced herein, the prevailing party in any such litigation, being the OWNER or the CONTRACTOR, should be entitled to a reasonable sum for attorney's fees and costs incurred in any such litigation relating to this Contract. 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 7. CONTRACTOR shall be paid in the manner set forth in the Contract Documents the amount of its proposal as accepted by OWNER, subject to such additions and deductions as may be made pursuant to the Contact Documents and applicable law. 8. Execution of the Agreement by the parties constitutes their agreement to abide by all applicable provisions of the California Labor Code; constitutes CONTRACTOR's certification that he is aware of the provisions of said Code and will comply with them; and further constitutes CONTRACTOR's certification as follows: "I am aware of the provisions of Section 3700 of the California Labor Code which requires every employer to be insured against liability for worker's compensation or to undertake self insurance in accordance with the provisions of that Code, and I will comply with such provisions before commencing the performance of the work of this contract." R28170 SECTION 00620 FAITHFUL PERFORMANCE BOND KNOW ALL PERSONS BY THESE PRESENTS, THAT, WHEREAS, the Palm Desert Redevelopment Agency, hereinafter designated the "Owner," has, on November 20th, 2008, awarded to Three D Service Comoanv. Inc., hereinafter designated as the 'Principal," a Contract for the Deconstruction of Country Villacae Apartments, and WHEREAS, said Principal is required under the terms of said Contract to furnish a bond for the faithful performance of said Contract: NOW, THEREFORE, WE, the Principal, and as Surety, are held and firmly bound unto the Owner the penal sum of Three Hundred Thirteen Thousand Six Hundred Thirtv-six Dollars ($313,636), plus reasonable attorney fees and costs, lawful money of the United States, for the payment of which sum well and truly to be made, we bind ourselves, our heirs, executors, administrators, and successors, jointly and severally, firmly by these presents. It is acknowledged that the Contract provides for a one-year warranty period, during which time this bond remains in full force and effect.
