Recommendation:
By Minute Motion, that the Agency Board:
(1) Authorize the award of Contract No. R-28590 in the amount of
$826,784.00 to Earth Sculptures for the renovation of the Mountain View
Golf Course at Desert Willow;
(2) Authorize the Finance Director to set aside the amount of $82,678.40 as
10% contingency (use of contingency requires additional action); and
(3) Appropriate an additional $149,462.40 from unobligated Project Area No.
2 to Account No. 851-4663-454-4001 as remaining contract amount and
10% contingency. There is $760,000 available in Account No. 851-4663-
454-4001 for 2008-2009 fiscal year.
Executive Summary:
On February 12, 2009, the Agency Board authorized staff to seek bids for the renovation of the
Mountain View Golf Course at Desert Willow. Bids were opened on April 2, 2009. After review
of the bids and contractor's qualifications, Earth Sculptures is the lowest bidder that met the
qualification criteria outlined in the contract specifications. Approval of staff recommendation
will award a contract to Earth Sculptures in the amount of $826,784.00 for the renovation of all
18 greens, greenside bunkers, fairway bunkers, and the restoration of all lake edges at the
Mountain View Golf Course.

Background:
The Mountain View Golf Course at Desert Willow opened in October 1998. The design intent of
the Mountain View Course was to provide a course that would challenge the avid golfer while
still providing playability for the average player. At the request of staff, Dana Fry of Hurdzan/Fry
inspected the Mountain View Golf Course to review the condition of the greens, lakes, and
bunkers, and evaluate the playability of the course in relation to the original design intent.
Over the years, the greens have become smaller in size; the aggressive growth of the Bermuda
grass has encroached onto the greens. Over time, the green's surface becomes smaller, thus
making golf play harder and increasing the time it takes to play a round. Increasing the length
of a round, reduces the enjoyment of the round, and affects the total number of rounds that can
be sold.
The issue with the lakes is the overgrowth of grass onto the lake causing the lakes to shrink in
size. With the dirt and sand buildup over time, the grass attaches itself onto the lake
environment. Additionally, the sand buildup in the lake is causing a reduction in the volume of
water. The dirt will need to be excavated and the grass removed bringing the lake to its normal
size, where the original concrete edge is.
The bunkers reshaping would provide for faster play and easier maintenance issues. In some
instances, we would combine multiple bunkers that are close together to make them one
bunker. This would eliminate the hard to mow areas between them, and make them more
dramatic. In the waste areas, we would fill in some of the capes that stick out into play areas
and simply grass them in.
Discussion:
On February 12, 2009, the Agency Board authorized staff to seek bids to renovate the Mountain
View Golf Course at Desert Willow. The scope of the project includes the following components:
Base Bid:
• Renovation of all 18 greens, restoring the greens to original size and condition using
"sprigging" technique (i.e. planting graphs of new grass on the greens)
• Renovating/reshaping all greenside bunkers to address shape, ease of maintenance,
installing bunker liners, new and repairing/installing drainage to all greenside bunkers
• Re-establishing the lakes edges by removing excess grass and silt accumulations along
all lake edges

Bid Results
On February 27, 2009, Agency staff published a notice inviting sealed bids for the renovation
project. The advertisement for bids was published in the Desert Sun. A pre-bid conference was
held at Desert Willow on March 11, 2009. On April 2, 2009, the City Clerk publicly opened and
read bids. A total of 11 bids were received. Below is a summary of the lowest five bids received
and attached to this report is a full summary of all bids.

Additive Alternate No. 1 includes the use of sod material instead of sprigging for the restoration
of all 18 greens. The use of sod is recommended by the Architect and the Desert Willow
Superintendent to allow for better consistency in the greens and also to ensure adequate time
for establishment of the greens before overseeding occurs in the fall.
Additive Alternate No. 2 Includes the renovation of all fairway bunkers. This renovation includes
reshaping and in some instances combining smaller bunkers into one larger bunker to assist
with maintenance and pace of play. In addition, new bunker liners and sand would be installed
and drainage improvements would be incorporated. This item was included as an additive
alternate to allow the flexibility to remove this item from the scope in case the bids came in well
above the industry standard.

Staff is recommending that both additive alternates be included in this project in order to take
advantage if the golf course is closed from June to September. Consolidating all work into one
project will also create a more consistent course and impacts to revenues would be minimized
by doing all the work at once.
Contractor Qualifications
As part of the bid package, the Agency requested that bidders provide a listing of a minimum of
five projects with similar scope completed within the last 10 years. The inclusion of contactor
qualifications as part of the bid would allow the Agency to ensure that the prospective contractor
has experience with this type of specialized work. Prior to bidding the project, the process of
including the review of qualifications as part of the bid was approved by the City Attorney.
In order to evaluate bids and the contractors' qualifications, a committee comprised of Agency
staff, the course architect, the City Landscape Manager, Community Development Director and
Desert Willow staff reviewed the contractors' qualifications. The Committee's evaluations
determined that the apparent low bidder, Sierra Landscape does not have direct experience
working with the renovation of golf course greens, which comprises a majority of the scope of
work. Although project managers on their staff have worked on similar scope projects, Sierra
Landscape, as a company, has not completed the required 5 projects of similar scope.
Earth Sculptures was the second lowest bidder. The committee also reviewed their
qualifications and determined that they met the criteria set forth in the bidding process. Earth
Sculptures has completed projects of similar scope, including specific construction and
renovation of golf course greens, which comprises the majority of the work and is the most
critical element of the renovation. In addition, the Hurdzan/Fry, course architect has provided
an independent review of the bids and contractor qualifications (see attached letter).
Hurdzan/Fry also recommends that the Agency contract with Earth Sculptures who has the
requested experience with projects of similar scope. Staff has consulted with the City Attorney,
and he recommends that we award the contract to Earth Sculptures, the lowest qualified bidder.
Schedule
If staff is authorized to award a contract to Earth Sculptures, the project would commence on
May 18, 2009, and the renovation would be complete by September 2009. The course would
reopen in November 2009 after normal reseeding. In addition, the renovated golf course would
be ready for use by the new Starwood Vacation Ownership units, scheduled to be open in early
2010. From an operation standpoint, this work will be completed during the non-peak period
(i.e., summer months). The Firecliff golf course will remain open during the summer and will
accommodate the traditionally lower number of golf rounds.
Funding Source
The Redevelopment Agency Board budgeted $760,000 for this project in FY 2008/2009. An
additional $149,462.40 is recommended to be appropriated from Unobligated Project Area No. 2
Fund to Account No. 851-4663-454-4001 to cover the remaining contract amount and a 10%
contingency.

Dear Cathy,
We received the bidder information you forwarded to us. We have reviewed it and would
like to make the following comments.
While the project does include other elements, the heart of the project is the greens
restoration and resurfacing. This is most specialized of all golf course work—and the most
important. The condition of the greens is the number one item in the minds of most golfers.
With the alternates included, the bids of Sierra Landscape and Earth Sculptures are less
than $10,000 different. From our review of the documents provided, Sierra Landscape appears
to be a large landscape company that has done some work on golf courses, while Earth
Sculptures specializes in golf course restoration and renovation.
Sierra's listed experience does not list any greens restoration projects, though they have
employees that apparently previously worked on greens construction. Earth Sculptures has
experience with greens reconstruction and expansion at some of the finest courses in California.
While we have had no previous work history with either firm,based on the information provided
Earth Sculptures clearly has more relevant experience to the scope of this project.

AGREEMENT
THIS AGREEMENT is made and entered into this 23rd day of April 2009, by and
between the Palm Desert Redevelopment Agency, California, hereafter called_"OWNER," and
Earth Sculptures hereinafter called "CONTRACTOR."
WITNESSETH
RECITALS:
CONTRACTOR has submitted to OWNER its CONTRACTOR's Proposal for the
construction of OWNER's Project,
1. Desert Willow Golf Resort Mountain View Course Renovation, PROJECT NO. 970-
09, CONTRACT NO. R-28590 in strict accordance with the Contract Documents identified
below and OWNER has accepted said Proposal, inclusive of the base bid plus the following
additive alternates: No. 1 and No. 2 .
2. CONTRACTOR states that it has re-examined its CONTRACTOR's Proposal and found
it to be correct, has ascertained that its subcontractors are properly licensed and possess the
requisite skill and forces, has examined the site and Contract in accordance with the Contract
Documents for the money set forth in its Proposal to be paid as provided in the Contract
Documents.

2. CONTRACTOR shall commence the work within ten (10) calendar days after the date of
the Notice to Proceed and will do all things necessary to construct the work generally
described in Recital No. 1 in accordance with the Contract Documents and will complete
said work within one hundred forty days (140) consecutive calendar days from the
Notice to Proceed date to the satisfaction of the Owner's Representative.
3. That the CONTRACTOR agrees to indemnify, defend, and hold harmless the OWNER,
and its officers, and employees, the ARCHITECT, Owner's Representative from any and
all claims and losses accruing or resulting to any and all contractors, subcontractors,
material men, laborers, and any other person, firm or corporation furnishing or supplying
work, services, materials or supplies in connection with the performance of this
Agreement.
4. Attention is directed to Section 00700-6.5, "Liquidated Damages" of the General
Conditions. Liquidated damages shall be $1,000.00 dollars per calendar day of delay.
5. Should any litigation or arbitration be commenced between the parties concerning the
works of improvements as referenced herein, the prevailing party in any such litigation,
being the OWNER or the CONTRACTOR, should be entitled to a reasonable sum for
attorney's fees and costs incurred in any such litigation relating to this Contract.
6. This Agreement shall be binding upon all parties hereto and their respective heirs,
executors, administrators, successors, and assigns.
7. CONTRACTOR shall be paid in the manner set forth in the Contract Documents the
amount of its proposal as accepted by OWNER, subject to such additions and
deductions as may be made pursuant to the Contact Documents and applicable law.
8. Execution of the Agreement by the parties constitutes their agreement to abide by all
applicable provisions of the California Labor Code; constitutes CONTRACTOR's
certification that he is aware of the provisions of said Code and will comply with them;
and further constitutes CONTRACTOR's certification as follows:
"I am aware of the provisions of Section 3700 of the California Labor
Code which requires every employer to be insured against liability for
worker's compensation or to undertake self insurance in accordance
with the provisions of that Code, and I will comply with such provisions
before commencing the performance of the work of this contract."

FAITHFUL PERFORMANCE BOND
KNOW ALL PERSONS BY THESE PRESENTS, THAT, WHEREAS, the
Palm Desert Redevelopment Agency, hereinafter designated the "Owner," has,
on April 23, 2009, awarded to Earth Sculptures, hereinafter designated as the "Principal," a
Contract for the construction of Desert Willow Mountain View Renovation Project, and
WHEREAS, said Principal is required under the terms of said Contract to furnish a bond
for the faithful performance of said Contract:
NOW, THEREFORE, WE, the Principal, and ,
as Surety, are held and firmly bound unto the Owner the penal sum of Eight Hundred Twenty-
six Thousand Seven Hundred Eighty-four Dollars ($826,784.00), plus reasonable attorney fees
and costs, lawful money of the United States, for the payment of which sum well and truly to be
made, we bind ourselves, our heirs, executors, administrators, and successors, jointly and
severally, firmly by these presents.
THE CONDITION OF THIS OBLIGATION IS SUCH, that if the above bounden Principal,
it or its heirs, executors, administrators, successors, or assigns, shall in all things stand to and
abide by, and well and truly keep and faithfully perform the covenants, conditions, and
agreements in the said contract and any alterations made as therein provided, on it or their part
to be kept and performed, at the time and in the manner therein specified, and in all respects
according to their true intent and meaning, and shall indemnify and save harmless, the Owner,
its officers and agents as therein stipulated, then this obligation shall become null and void;
otherwise it shall be and remain in full force and virtue.
It is acknowledged that the Contract provides for a one-year warranty period, during
which time this bond remains in full force and effect.

extension of time, alteration, or addition to the terms of the Contract or to the work to be
performed thereunder or the specifications accompanying the same shall, in any way, affect its
obligations on this bond, and it does hereby waive notice of any such change, extension of time,

WHEREAS, said Principal is required to furnish a bond in connection and with said
Contract, providing that if said Principal, or any of it or its subcontractors shall fail to pay for any
materials, provisions, or other supplies used in, upon, for, or about the performance of the work
contracted to be done, or for any work or labor done thereon of any kind, the Surety of this bond
will pay the same to the extent hereinafter set forth:

bond, such reasonable attorney's fees to the Owner as shall be fixed by the court.
This bond shall insure to the benefit of any and all persons, companies, and corporations
named in Section 3181 of the Civil Code of the State of California so as to give a right of action
to them or their assigns in any suit brought upon this bond.

extension of time, alteration, or addition of the terms of the Contract or to the work to be
performed thereunder or the specifications accompanying the same shall, in any way, affect its

Kathi Williams / Project Manager
Kathi Williams has been providing services to Sierra Landscape Company, Inc. since
October 2005. She has extensive experience in the public works arena, landscape and
golf course construction. Her understanding of project procedures and policies required
by public works projects is only overshadowed by her knowledge of agronomy and
construction practices required to successfully build a golf course.
She has previously worked as a consultant for Gary Heinbuch, owner of Heinbuch Golf
in Canyon Lake, CA. She worked with his construction management team, providing the
project management services required to review and update project costs, completing
designs and providing assistance in the preparation of various bid packages for
construction, as well as providing full time project management services during
construction for projects requiring a full time resident engineer.
American Landscape, Inc. employed Kathi for 12 years, and during this period she held
various positions including Director of Purchasing, Chief Estimator, and Project Manager
for the company's Golf Course Construction Division.

Mexico. I began my career as an Apprentice Pipe Fitter and now hold the position

RE: Contract No. R-28590 Experience Narrative for bidder qualifications
Mountains at Bighorn, Palm Desert, CA
1. Driving Range-We removed the turf from the tees and practice bunker complex,
reshaped the tees, reshaped and enlarged the bunkers and installed new turf. The
main objective of this task was to rid the tees of irregularities (Bird baths) and
enhance the bunker practice complex.
2. Tee Complex's # 1-18-We reshaped the access paths and tee complexes, added
hand set rock stairs. rock stacked retaining walls and boulder outcroppings to
enhance the access paths and create a natural element.
3. Drainage/Irrigation-We have updated storm drainage on fairways, waste areas
and bunkers to meet new demands and replace malfunctioning drainage.
4. #8-We completely remodeled the tee complex consisting of reshaping landforms,
irrigation and drainage retrofit. We constructed rock stacked retaining walls, re-
landscaped and re-installed turf.
Canyons at Bighorn, Palm Desert, CA
1. Holes #1-18-We have and continue to reshape the"Natural Area" landforms that
border several of the holes to account for new home construction and ease the tie-
in to existing golf areas. We have constructed boulder walls in retaining
conditions, retrofitted irrigation/drainage and re-installed landscape material.
2. #7 Tee Complex-We reconstructed the lake to accommodate larger tee boxes,
reshaped the tee complex,constructed boulder stacked walls to retain the
elevation differences between tee boxes and constructed boulder stairs for access.
This project included installation of drainage, irrigation and landscape material.
3. #6 Lake-We reconstructed the North lake edge and tie into golf to provide more
water surface as an aesthetic enhancement.
The Hideaway-Pete Dye Course, La Quinta, CA
1. General Remodel Holes 1-18-We reshaped fairways, fairway bunker complexes,
added and removed turf, re-shaped green complex backdrops, retrofitted drainage
and irrigation, re-shaped cart paths, re-shaped perimeter planting areas, and re-
installed landscape material. During this project we also performed grading.

1. Back Nine Construction-We shaped and fine graded for planting areas, cart paths
and easement areas. We installed irrigation, drainage and landscape material
throughout the back nine.
Toscana Country Club-South Course, Indian Wells,CA
1. Holes #1-18=We shaped and fine graded for planting areas, cart paths and hole
perimeters. We installed irrigation, drainage and landscape material throughout
the golf course. During this project we also performed grading, shaping,
irrigation, drainage and landscape installations for the comfort stations.
2. Hole #16/17-We retrofitted the underground drainage retention system and added
more storage capacity. This task included removal of turf,construction and
retrofit of drywells, re-shaping of the turf area and re-installation of turf.
Mission Hills North, rancho Mirage, CA
1. 44-We constructed a new lake,replacing a waste area along the west side of#4.
This task included excavation, lake liner installation, construction of subterranean
concrete shoreline, finish shaping of the lake floor, drainage, irrigation, pump
station construction, shaping of the fairway tie-in, removal and re-installation of
turf. This job also included remodel of an existing lake on #3.
2. #13- We constructed a new lake, replacing a waste area along the south side of
#13. This task included excavation, lake liner installation, construction of
subterranean concrete shoreline, construction of RR Tie vertical retaining
shoreline, finish shaping of the lake floor, drainage, irrigation, pump station
construction, aeration equipment installation, shaping of the fairway tie-in,
shaping of the tee complex to accommodate the lake, removal and re-installation
of turf.

CONTRACTOR QUALIFICATION STATEMENT
The Bidder is required to state, in detail, in the space provided below, what work of a
character similar to that included in the proposed contract he has done, to give reference and
such other detailed information as will enable the Owner, the Engineer and the Golf Course
Consultant to judge of his responsibility, experience, skill and financial standing.
Among other things, this statement shall include the following:
1. evidence to the effect that the Bidder maintains a permanent place of business
2. list of construction equipment available for work under the proposed contract
including:
a. when purchased or otherwise obtained
b. statements as to its present physical condition
c. or proposals from a leasing company
3. evidence to the effect that the Bidder has a suitable financial status to meet
obligations incident to the work
4. evidence to the effect that the Bidder has appropriate technical experience
List a minimum of five (5) golf course construction projects, similar in scope to this project that
the Bidder has completed within the last ten (10) years. Point of contact and golf course
architect shall also be included for each project listed.
