Authorize the Executive Director to negotiate an Agreement for Professional Services with S.M.S. Architects, Inc. in an amount not -to - exceed $82,300.00, plus $4,100 for reimbursables for the Desert Willow Lake View Terrace Expansion; 2. Approve a 10% contingency in the amount of $8,230.00; 3. Authorize the Chairman to execute the Agreement; and 4. Appropriate $94,630 from Unobligated Project Area No. 2 Fund to Account No. 851-4663-454-4001. Executive Summary Approval of staff recommendation will authorize staff to negotiate a contract to Smart Michael Siminoff (S.M.S.) Architects in the amount not -to -exceed $82,300, plus an additional amount not -to -exceed $4,100 for reimbursables for the design of the Lake View Terrace Expansion at the Desert Willow Resort. S.M.S. was selected as the most Staff Report Approve Services Agreement with S.M.S. for Desert Willow Lake View Terrace Expansion December 10, 2009 Page 2 of 3 qualified firm that met the Agency's design scope and qualifications. Approval of staff's recommendation will allow the Executive Director to execute the final agreement. Background Agency staff worked with Desert Willow staff (Kemper Sports) and S.M.S. Architects to develop a conceptual plan that provides a variety of amenities to enhance the outdoor dining/seating venue at Desert Willow. The proposed expansion increases the outdoor terrace seating capacity by 100 seats and banquet capacity by 250. In addition, the expansion adds flexibility to host multiple events simultaneously while preserving the ability to service residents and guests (see attached conceptual plan). At the October 15, 2009 Lake View Terrance Study Session, the Agency Board reviewed the conceptual plans for the proposed Lake View Terrace Expansion. On October 22, the Agency Board authorized the Secretary to advertise and issue a Request for Proposals (RFP) for the final design of the expansion. On November 23, 2009, staff received eight (8) proposals for Architectural Services for this project. A review committee comprised of Agency, City, and Desert Willow staff participated in evaluating all responses to the RFP. Each of the responses was objectively evaluated on the basis of qualifications of the firms including history of work experience on similar projects in size and nature, scope of design services presented, fees, and location of firm. Based on the responses to the RFP, S.M.S. was selected as the qualified firm with experience in designing outdoor dining spaces, with a cost well within the industry standard. S.M.S. Architects submitted a proposal that demonstrated thorough knowledge of the project with qualifications that met the Agency's criteria with a reasonable cost. S.M.S. has an office in Palm Desert, completed the conceptual design for this project, and has successfully completed similar projects. The proposals were discussed at the November Presidents Meeting and S.M.S Architects was endorsed. It is anticipated that the design of the project will be completed by March 2010, with bidding taken place in April, and construction commencing in the summer of 2010. Staff recommends that the Agency Board authorize the staff to negotiate with S.M.S. Architects in the amount not -to -exceed $82,300, plus an additional amount not -to - exceed $4,100 for reimbursables for the design of the Lake View Terrace Expansion at the Desert Willow Resort. Fiscal Analvsis The estimated construction cost for the project is $1 M. The preliminary construction cost has been considered and the estimated return on investment is approximately 3-4 years. Funds are available in the Unobligated Project Area 2 Fund; therefore, there is no immediate fiscal impact to the General Fund.
