NO. R28170 WITH THREE D SERVICE COMPANY, INC. EXTENDING
THE CONTRACT COMPLETION DATE TO APRIL 2, 2009 FOR
DECONSTRUCTION OF THE COUNTRY VILLAGE APARTMENTS

Recommendation:
By Minute Motion, that the Agency Board:
(1) Approve Change Order No. 1 (no cost) to Contract No. R28170 with
Three D Service Company, Inc. extending the completion date to April 2,
2009 for deconstruction of the Country Village Apartments.

On November 20, 2008, the Agency Board awarded Contract R28170 to Three D Service
Company, Inc., in the amount of $313,636 for deconstruction of the Country Village Apartments.
The project includes the following components:
• Deconstruction of the Country Village Apartments, which includes the removal of
hazardous material and recycling/reuse of building materials with a goal of 75%
diversion from the landfill of all building and site components;
• Deconstruction of parking lot and underground utilities, which includes the
recycling/reuse of paving materials on the project site;
• Removal and green wasting of landscaping at adjacent Agency property;
• Rough grading and soil stabilization to prepare the site for future construction.

The Notice to Proceed was issued on January 12, 2009, with a 75-day completion
(March 27, 2008). The project is 75% complete and to date has diverted 81 % of construction
debris from landfills. From February 9-15, 2009, Three D Service Company, Inc.
accommodated valuable fire department training which included:
• Approximately 200 firefighters and paramedics from Riverside County including: Moreno
Valley, Banning, Beaumont, Coachella, Desert Hot Springs, Calimesa, Temecula, Perris,
Indio, Rancho Mirage, Indian Wells, La Quinta, San Jacinto, Office of Emergency
Services
• Live smoke training simulated exercises
• Videotaping for county wide distribution and training
• The unique opportunity to train in a realistic environment
• Drills performed: command, fire attack, forcible entry, search and rescue, hose
deployment, ventilation, and patient treatment (burn victim)
Asbestos had to be cleared from the units prior to Fire Department use. During the training the
Contractor was not able to begin demolition of these buildings as originally scheduled. Three D
Service Company, Inc. has requested a change order to modify their contract completion date
by five (5) working days, from March 27, 2009 to April 2, 2009.
Staff has reviewed the request and believes it is justifiable. Therefore, staff recommends
approval of a no -cost change order to extend the contract completion date to April 2, 2009.

Contract R28170 Change Order No. 1 Continued from front
This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish
equipment and materials, and perform all work as necessary or required to complete the Change Order items for a
lump sum price agreed upon between the Contractor and the Palm Desert Redevelopment Agency, otherwise referred
to as Owner.
Contract Time Extension Seven (7) calendar Days.
Revised Contract Total $313,636.00
The undersigned Contractor approves the foregoing Change Order # 1 as to the changes, if any, in the contract
price specified for each item including any and all supervision costs and other miscellaneous costs relating to the
change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Change Order # 1 . The Contractor agrees to furnish all labor and materials and perform all other necessary work,
inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order
items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood
that the Change Order shall be effective when approved by the Owner.
Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies,
waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of
or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and
indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as
any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
