Authorize payment of a deposit to Time Warner Cable in an amount not - to -exceed $9,626; and 2. Funds are available in Account No. 854-4256-464-4001, Palm Desert Country Club (PDCC) Undergrounding. Background The franchise agreement between Time Warner Cable and the State of California ("Agreement') has superseded the previous agreement between Time Warner (formally Palmer Cablevision) and the City of Palm Desert. The new Agreement calls for Time Warner Cable to be reimbursed for engineering design services in relation to the PDCC undergrounding. A complete set of plans from all impacted utilities will enable the assessment engineer, Willdan Financial Services (formally known as MuniFinancial), to prepare an accurate preliminary assessment amount for PDCC homeowners. On February 14, 2008, the Agency Board authorized payment of deposits to Southern California Edison, Verizon Communications, and Willdan Financial Services for the purpose of providing engineering cost estimates in association with the PDCC undergrounding. The previous cable agreement called for Time Warner to provide preliminary engineering estimates at no cost to the City. However, with the new Agreement, Time Warner is to be reimbursed in the same manner as the other utilities. Prior to February 2008, the Agency was only able to estimate the potential cost of the undergrounding by analyzing previous undergrounding project budgets. The Staff Report Time Warner Cable Engineering Design Services Page 2of2 November 12, 2009 procurement of the utility engineering estimates will allow for Willdan to properly develop the parameters of the assessment, and in turn provide PDCC residents with an accurate estimate of the assessment. Southern California Edison has completed all necessary engineering plans and provided a cost estimate for review. Verizon is in the process of finalizing their engineering estimates, and Time Warner is the last utility necessary to begin scoping the potential assessment. Once the utility and construction estimates are received, the formation process, including processing the report, the public hearing, and balloting will take approximately seven months. Staff recommends approval of the funding to Time Warner in an amount not -to -exceed $9,626, in order to determine the potential assessment costs to PDCC residents. Fiscal Analvsis The fiscal impact to the Agency at this time is solely the contract amount of $ 9,626. However, the impact of the Palm Desert Country Club Undergrounding project cannot yet be accurately determined, and is contingent upon approval of the assessment district. Per the request of the City, this estimate is being submitted as a "not to exceed" amount. Should Time Warner Cable experience additional design costs, we will not seek additional compensation for the design of this undergrounding project.
