CHANGE ORDER REQUEST — ALESSANDRO ALLEY ADDITIONAL
SERVICES
By Minute Motion, that the Agency Board:
Approve Professional Service Amendment No. 2 in an amount not -to -exceed
$22,000 to Stantec Consulting, Inc. (Contract No. R24310) for additional services
for the Alessandro Alley Improvements; and
2. Authorize Finance Director to move $22,000 from contingency balance of $26,327
(Account No. 850-4341-433-4001) to base for the subject amendment.
Executive Summarv:
Stantec Consulting, Inc. is providing Professional Engineering Services for the Alessandro Alley
Improvements. This Professional Service Amendment is for changes required to the plans after
they were substantially completed and which are beyond the scope of their Professional
Services Agreement.
Discussion:
The Alessandro Alley runs behind the commercial area on the north side of Highway 111 from
Las Palmas Avenue to approximately 300 feet east of Monterey Avenue. The original
conceptual plan was to widen the alley by 27 feet along its entire length to a total width of 47
feet; providing parking at a 900 angle on the north side of the alley; and close off San Marcos
Street from the alley to San Clemente Circle. The Alessandro Alley design provides parking
spaces along the north side with landscaping and a barrier wall buffer between the adjoining
residential properties.

The Agency has been unable to acquire the necessary portions from all of the adjoining
residential properties to the north as originally designed. This requires changes to the plans for
the Alessandro Alley Improvements after they had been substantially completed. Two of the
residential property owners to the north have declined to sell their property or a portion thereof.
Staff is continuing to negotiate with these owners; however, in the event staff is unsuccessful,
the improvements will be redesigned around these properties in order to proceed with the
project ($4,000). In addition four property owners have agreed to sell less property for the right
of way than in the original design requiring changes to acquisition documents and plans
($1,500).
The plans require redesign to accommodate changed requirements for plan approval. This
includes additional ADA improvements and a water retention basin for a replacement parking
area ($2,000). The plans also require substantial redesign because of the existing utility poles
which will remain in place to provide unobstructed traffic circulation of 24 feet for the entire
length of the project ($14,500).
Therefore, staff recommends approval of Professional Services Amendment No. 2 in an amount
not -to -exceed $22,000 to Stantec Consulting, Inc. for additional services for the Alessandro
Alley Improvements.

This Contract Amendment covers changes to the subject contract as described herein. The consultant shall perform
all work as necessary or required to complete the Contract Amendment items for a lump sum price agreed upon
between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner.
Contract Time Extension Days.

The undersigned Consultant approves the foregoing Contract Amendment # 2 as to the changes, if any, in the
contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to
the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Contract Amendment # 2 . The Consultant agrees to furnish all labor and materials and perform all other necessary
work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Contract
Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is
understood that the Contract Amendment shall be effective when approved by the Owner.
Execution of this Contract Amendment by the Consultant constitutes a binding accord and satisfaction that fully
satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity,
arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not
limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well
as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

Dear Mr. White:
Stantec respectfully requests a change order to our above referenced contracts for additional
services as described as follows:
1. Width of Travel — This issue pertains to the full length of the project. The cost of this item
includes meeting time, support exhibits and actual design changes to the signing and striping
plans as well as the improvement plans.
a. Amend the plans to reflect a 24 ft traveled way versus a 22.5 ft traveled way
COST - $14,500
2. Apartment Parking — This issue pertains to APN's 627-092-035 and 627-092-045. The cost of
this item includes meeting time, support exhibits and actual design changes to the signing and
striping plans as well as the improvement plans.
a. Design an additional ADA Stall. The ADA stall requires a push in the geometry at the
south end of the string of stalls.

b. Stantec will analyze the local condition and make note of whether or not the basin has
adequate capacity. This effort does not include any additional design changes in the
event the basin is too large or too small. If very minor changes are necessary to
accommodate the local, calculated flows, Stantec will provide those changes free of
cost. '
c. Minor changes for the extension of the sidewalk between the north end of the parking
area and the retention basin.
d. Utility meters and services — Analyze and discuss recommendations for the disposition
of the meters and services on the west wall of the parking garage. Stantec is not
anticipating any additional design services for this issue and therefore none are
included herein.
COST - $2,000
3. Right -of -Way Documents — As a result of changes in the ROW take from 27 feet to 10.5 feet,
several documents need to be changed.
COST - $1,500
4. Un-acquired ROW or Parcels - This issue pertains specific areas of the project. The cost of
this item includes meeting time, support exhibits and actual design changes to the signing and
striping plans as well as the improvement plans.
a. The parcel fronting San Marcos Avenue has not been acquired. There are changes
required to accommodate access to that parcel and change the design from its current
state. An option has been prepared in exhibit form. Once direction is given by the
City, Stantec will make the necessary changes. This item does not include additional
changes beyond the initial direction.
b. APN 627-071-013 — This parcel has not been acquired. There are various work -around
changes that are required to accommodate the issue. An option has been prepared in
exhibit form. Once direction is given by the City, Stantec will make the necessary
changes. This item does not include additional changes beyond the initial direction.
COST - $4,000
For the above described services, Stantec is respectfully requesting additional fixed fee budget of
twenty two thousand dollars ($22,000).
