Authorize the award of Contract No. C29570 for deconstruction of 44-887 San Antonio Circle, 44-870 San Antonio Circle, 44-850 San Antonio Circle, and 44-889 San Clemente Circle associated with the Alessandro Alley Improvement Project and the deconstruction of 42-135 Kansas Street in the deductive bid price of $77,118. 2. Authorize the Chairman to execute said Agreement for Contract No. C29570. 3. Authorize the Director of Finance to set aside the amount of $7,712.00 as 10 percent contingency (use of contingency requires additional action); and Funds are available in Account No. 850-4341-433-4001 for Alessandro Alley Capital Improvements and Account No. 854-4625-454-4001 for Kansas Street Improvements. Staff Report Award of Contract C29570 August 26, 2010 Page 2 of 6 Executive Summary Approval of staff's recommendation will provide for deconstruction of the four subject houses associated with the Alessandro Alley Improvement Project. The subject properties are zoned R- 1 (Single Family Residential). The southerly 27.0 feet of the subject properties are within the new Alessandro Alley right-of-way. The approval will also provide for the deconstruction of 42- 135 Kansas Street. The deconstruction will provide environmentally friendly removal of the existing buildings on these properties most of which are dilapidated. Backqround The proposed Alessandro Alley Improvement Project will widen and improve Alessandro Alley with public parking spaces and landscaping improvements from Las Palmas Avenue on the east to approximately 300 feet east of Monterey Avenue on the west. As part of the project, San Marcos Avenue will be closed at Alessandro Alley. The project will widen Alessandro Alley by 27.0 feet to a total width of 47.0 feet, and provide parking at a 90-degree angle on the north side of Alessandro Alley with landscaping and a barrier wall to protect the adjoining residential parcels. Plans for the improvements to the Alessandro Alley have been prepared and completed and have been approved for construction. Environmental site assessments have been completed at the subject properties, and there are no known onsite conditions that would limit future development. Asbestos and lead -containing paint/ceramic tile inspections have been completed and the recommendations will be performed during deconstruction. On February 11, 2010, the City Council and Agency Board authorized the City Clerk to advertise and call for sealed bids for deconstruction of the four subject properties associated with the Alessandro Alley Improvement Project in addition to the deconstruction of 44-845 San Clemente Circle which is suspended pending alternative disposition of this property. On November 12, 2009, the City Council and Agency Board authorized the acquisition and subsequent deconstruction of 42-135 Kansas Street. An environmental site assessment has been completed at the subject property, and there are no known onsite conditions that would limit future development. Asbestos and lead -containing paint/ceramic tile inspections have been completed and the recommendations will be performed during deconstruction. The property at 42-135 Kansas Street will be landscaped and used primarily for water retention. 44-887 San Antonio Circle: This property consists of a 7,500 square foot parcel with a 1,267 square foot residence and an attached garage. The property is zoned R-1 (Single Family Residential) and back up to the Alessandro Alley. The southerly 27 feet (1,865 square feet) is necessary to implement the Alessandro Alley improvements. A covered patio attached to the south side of the residence needs to be removed to fully implement the Alessandro Alley improvements. It has been determined that the balance of the improvements remaining after removal of the covered patio are not suitable for low/moderate affordable housing, and would require significant improvements to bring the property up to current code requirements. Removal of the existing improvements will provide a remainder vacant lot of approximately 5,635 square feet that is smaller than allowable under current zoning requirements in an R-1 zone; therefore, not suitable for low/moderate affordable housing without obtaining a variance. 44-870 San Antonio Circle: This property consists of a 14,580 square foot parcel with a 942 square foot residence, pool, and a detached garage. The property is zoned R-1 (Single Family Residential) and backs up to the Alessandro Alley. The southerly 27 feet (4,055 square feet) is necessary to implement the Alessandro Alley improvements. The approximate 1,200 square foot detached garage on the southerly portion of the property needs to be removed to fully implement the Alessandro Alley improvements. The Agency Board approved the purchase of the subject property on June 22, 2005. It has been determined that the balance of the improvements remaining after removal of the garage are not suitable for low/moderate affordable housing, and would require significant improvements to bring the property up to current code requirements. Removal of the existing improvements will provide a remainder vacant lot of approximately 10,525 square feet that is suitable for development of future low/moderate affordable housing. 44-850 San Antonio Circle: This property consists of a 17,697 square foot parcel with a 1,380 square foot residence and a detached garage. The property is zoned R-1 (Single Family Residential) and backs up to Alessandro Alley. The southerly 27 feet (1640 square feet) is necessary to implement the Alessandro Alley improvements. The approximate 1,200 square foot detached garage on the southerly portion of the property needs to be removed to fully implement the Alessandro Alley improvements. The City Council approved the purchase of the subject property on April 9, 2009, and the Agency Board approved reimbursement to the City and for the Housing Authority to reimburse the Agency using Housing Set -Aside funds if it is determined that the property qualifies as low/moderate affordable housing. It has been determined that the balance of the improvements remaining after removal of the garage are not suitable for low/moderate affordable housing, and would require significant improvements to bring the property up to current code requirements. Removal of the existing improvements will provide a remainder vacant lot of approximately 16,057 square feet that is suitable for development of future low/moderate affordable housing. 44-889 San Clemente Circle: This property consists of a 7,840 square foot parcel with a 2,216 square foot triplex, pool, and attached garage all in very poor condition. The triplex is a nonconforming use on this parcel, which is zoned R-1 (Single Family Residential) and backs up to Alessandro Alley. The southerly 27 feet (1,865 square feet) is necessary to implement the Alessandro Alley improvements. The City Council approved the purchase of the subject property on May 7, 2009, and the Agency Board approved reimbursement to the City and for the Housing Authority to reimburse the Agency using Housing Set -Aside funds if it is determined that the property qualifies as low/moderate affordable housing. It has been determined that the improvements are not suitable for low/moderate affordable housing, and would require significant improvements to bring the property up to current code requirements. Removal of the existing improvements will provide a remainder vacant lot of approximately 5,975 square feet that is smaller than allowable under current zoning requirements in an R-1 zone; therefore, not suitable for development of future low/moderate affordable housing without obtaining a variance. The two subject remainder parcels at 44-870 San Antonio Circle and 44-850 San Antonio Circle when vacant can be combined into a larger parcel of 26,582 square feet for future low/moderate affordable housing. The two remainder parcels at 44-887 San Antonio Circle and 44-889 San Clemente Circle are now smaller than allowable under current zoning requirements in an R-1 zone; however, if adjoining vacant parcels are acquired in the future, they could be combined into larger parcels that would be suitable for future low/moderate affordable housing. 44-845 San Clemente: This property consists of a 17,697 square foot parcel with a 1,331 square foot residence and an attached garage. The property is zoned R-1 (Single Family Residential) and backs up to the Alessandro Alley. The southerly 27 feet (1,640 square feet) is necessary to implement the Alessandro Alley improvements. The City Council approved the purchase of the subject property on April 24, 2009, and the Agency Board approved reimbursement to the City and for the Housing Authority to reimburse the Agency using Housing Set -Aside funds if it is determined that the property qualifies as low/moderate affordable housing. It has been determined that the improvements are not suitable for low/moderate affordable housing, and would require significant improvements to bring the property up to current code requirements. Removal of the existing improvements will provide a remainder vacant lot of approximately 16,057 square feet that is suitable for development of future low/moderate affordable housing. There are currently negotiations for the sale of 44-845 San Clemente Circle. Therefore, the deconstruction of the subject property is currently on hold. The Line Item Lump Sum Bid Price of $16,380 to deconstruct this property has been deducted from the total Bid Price of $93,498. The remainder Deductive Total Lump Sum Bid Price is $77,118. 42-135 Kansas Street: This property consists of a 6,534 square foot parcel with a 1,318 square foot residence and an attached carport. The property is zoned R-1 (Single Family Residential) and is on the southwest corner of Kansas Street and Hovley Lane East. The rear of the property is also in line with Oasis Club Drive which ends at Hovley Lane East. The deconstruction will provide for environmentally friendly removal of the improvements from G:Vda\Bryce White\ pecs alessandro alley decon\Bryce Staff report-c-29570.doex Staff Report Award of Contract C29570 August 26, 2010 Page 5of6 the five parcels and clearing of the sites including: • The removal of hazardous material. • Recycling/reuse of building materials with a goal of 100% diversion from the landfill of inert waste and 75% of all other building and site components waste. • Removal and green wasting of landscaping. • Rough grading and soil stabilization to prepare the site for future construction. The Notice Inviting Sealed Bids was published in the Desert Sun on July 9, and July 14, 2010. Sealed bids were opened on August 12, 2010, from six contractors who were responsive bidders. The results are listed below for the Total Lump Sum Bid Price, Deduct Line Item Lump Sum Bid Price for 44-845 San Clemente Circle, and Deductive Total Lump Sum Bid Price. The order of consideration of bids is (1) Total Lump Sum Bid Price and (2) Deductive Total Lump Sum Bid Price. In April of 2009, Three D Service Company Inc. satisfactorily completed the deconstruction for the Agency's Country Village Deconstruction Project located at 42-455 Washington Street. Therefore, staff recommends award of contract to Three D Service Company, Inc. for the Deductive Total Lump Sum Bid Price of $77,118.00. Deconstruction of these properties will save the Agency approximately $7,000 annually in maintenance expenses. Funds are available for this project in Account Nos. 850- 4341-433-4001 and 854-4625-454-4001. There will be no impact on the General Fund. Contractor shall commence the work within twenty (20) calendar days after the date of the Notice to Proceed and will do all things necessary to construct the work generally described in Recital No. 1, in accordance with the Contract Documents and will complete said work within forty-five (45) calendar days from the Notice to Proceed date to the satisfaction of the Owner's Representative. 3. Contractor agrees to indemnify, defend and save Owner and its officers, agents and employees harmless from: a. Any and all liability, claims, damages, losses or injuries to any person or other entity, including injury to Contractor's employees, and all claims which arise from or are connected with the negligent performance of or failure to perform the work or other obligations of this Agreement, or which are caused or which are claimed to be caused by the negligent or intentional acts or omissions of Contractor, its subcontractors, its agents or employees, and, all expenses of investigating and defending against same, b. Any and all liability, claims, damages, losses or injuries to any and all contractors, subcontractors, material -men, laborers, or any other person, firm or corporation furnishing or supplying work, services, materials or supplies in connection with the performance of the Agreement. c. Attention is directed to the General Specifications - Claims, Liability, and Indemnity Agreement/Hold Harmless sections, which specifications are made part of this Agreement as set forth in Agreement paragraph 1, above. 4. Attention is directed to Section 6-9, "Liquidated Damages" of the Standard Specifications and is hereby amended to substitute the "Palm Desert Redevelopment Agency" in place of "City." Liquidated damages shall be two hundred fifty dollars ($250.00) per calendar day of delay for the first two weeks, increasing by an additional $250.00 per calendar day every week thereafter to a maximum of $2,000.000. 5. Should any litigation or arbitration be commenced between the parties concerning the works of improvements as referenced herein, the prevailing party in any such litigation, being the Owner or the Contractor, should be entitled to a reasonable sum for attorney's fees incurred in any such litigation relating to this Contract. 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 7. Contractor shall be paid in the manner set forth in the Contract Documents the amount of its Proposal as accepted by Owner, subject to such additions and deductions as may be made pursuant to the Contact Documents and applicable law. Any delay or postponement of payment from the above referenced time frame may occur only for good cause following written approval of the Palm Desert Redevelopment Agency. Release of Retention The prime Contractor agrees further to release retention payments to each Subcontractor within thirty (30) days after the Subcontractor's work is satisfactorily completed. Any delay or postponement of payment from the above referenced time frame may occur only for good cause following written approval of the City of Palm Desert. 8. Execution of the Agreement by the parties constitutes their agreement to abide by all applicable provisions of the California Labor Code; constitutes Contractor's certification that he is aware of the provisions of said Code and will comply with them; and further constitutes Contractor's certification as follows: "I am aware of the provisions of Section 3700 of the California Labor Code which requires every employer to be insured against liability for worker's compensation or to undertake self insurance in accordance with the provisions of that Code, and I will comply with such provisions before commencing the performance of the work of this contract."
