Backaround Resolution No. 03-34, was adopted on April 10, 2003, authorizing the Agency to sell small housing projects in accordance with Health and Safety Code Section 33433(c). Any Agency that has sold or leased a small housing project is required to file a report with the legislative body after the end of the fiscal year which discloses; (i) the name of the owner/purchaser of the property, (ii) the legal description or street address of the property, (iii) the date of the conveyance of the property, (iv) the restrictions posed by the agreement on the owner/purchaser of the property, and (v) the date on which the Agency held its public hearing on the conveyance of the property pursuant to Section 33431. The following three properties were sold during the fiscal year 2009/2010, and meet the definition of a "small housing project' because they were sold to persons or families of low or moderate income. The Agency conveyed the properties pursuant to Health and Safety Code Section 33433(c) and 33431. Falcon Crest Development: 74530 King Fisher Circle (APN 624-440-009) Public Hearing: September 24, 2009 Owner/Purchaser: Ramon and Erika Heredia Date of Purchase: February 11, 2010 Sales Price: $224,997.00 Staff Report Receive and File Report Pursuant to Section 33433(c) December 9, 2010 Page 2 of 2 Desert Rose Development: 75434 Wildflower Lane (APN 634-061-008) Public Hearing: December 10, 2009 Owner/Purchaser: Cassandre M. Clarke Date of Purchase: May 28, 2010 Sales Price: $134,912.00 43980 Blueberry Lane (APN 634-061-027) Public Hearing: May 27, 2010 Purchaser: Filomena O. Richardson Date of Purchase: June 30, 2010 Sales Price: $131,100.00 All three properties were restricted by an "Affordable Housing Restriction and Lien Agreement," which was recorded at the time of sale which limits, among other things, affordability, encumbrances, transfers and resales for a period of up to 45 years. Staff recommends that the Agency Board receive and file this report pursuant to Health and Safety Code Section 33433(c). Fiscal Analysis There is no fiscal impact to the Agency to receive and file this report.
