The list of contractors deemed qualified will be provided to the Agency Board on June 24, 2010. Background The Desert Willow Kitchen and Building expansion project is in plan check, and bidding is anticipated to commence at the end of June. As a high profile project with an aggressive construction timeline, it is critical that the Agency secure bidders who can demonstrate the proper experience, qualifications, and ability to complete a project with similar scope and schedule. In order to achieve this goal, a contractor pre -qualification process is required. On June 3, 2010, staff published a notice seeking qualifications from general contractors interested in bidding the Desert Willow Kitchen and Building expansion project. The pre - qualification application requested specific information from contractors possessing a valid and current California contractor's license (Class B-General Contracting) and in good standing. The information requested included, but was not limited to, the contractors' ability to demonstrate that they are regularly engaged in the business of constructing renovation and hospitality projects with new or renovated commercial kitchens. In addition, the contractor was requested to demonstrate that they have successfully completed a minimum of four similar projects in the last five years with the ability to provide proper insurance and bonding capacity to meet the Agency's standards (see attached pre - qualification application). On June 14, 2010, staff received seven contractor's qualification applications. Gott Construction, Upland, CA Agency staff, our construction manager, and legal counsel are currently reviewing the qualifications. After review of the applications, staff will provide a pre -qualified contractors list to the Executive Director for approval on June 18, 2010. Our legal counsel has recommended that the Agency Board formally ratify the pre -qualified contractors list, and set up an appeals panel consisting of City staff to hear any appeals filed to the pre -qualified contractors list. If the pre -qualified contractors list is ratified and the appeals period ends (June 23, 2010) without a challenge, staff will solicit sealed bids from the pre -qualified contractors list for the construction of the Desert Willow Kitchen and Building expansion project. The estimated construction period is August to December 2010. Staff recommends that the Agency Board ratify the attached pre -qualified contractor list. Fiscal Analvsis The estimated construction cost for the project is $3.95 million, including the lobby remodel. The preliminary construction cost has been considered. Additional revenues produced as a result of the expansion may augment future General Fund revenues. Contractors who intend to submit a bid must be prequalified. The purpose of this prequalification process is to develop a list of qualified general contractors who can demonstrate the ability to complete the project on an aggressive schedule with a high degree of workmanship and with quality service. The general scope of work for the Project includes but is not limited to: o Demolition and remodel of the existing lobby/bar area to accommodate an expanded bar area with the relocation of two offices; o Expansion of the lobby/ballroom hallway to eliminate the pinch point adjacent to the ballroom; o Enclosure of the existing ballroom to reduce noise; and o Modification to the ballroom audio visual, window shading, and lighting; and o A 5,200 square foot remodel and expansion to the kitchen/building at east end of clubhouse including, but not limited to restroom expansion, installation of kitchen equipment, refrigeration, storage, and offices. The contractor will be required to supply all materials and expertise to complete the renovation per the Project plans and specifications. The existing facility will remain operational during the construction and contractor will be required to develop and maintain a schedule to complete the Project in 140 calendar days. The Project is subject to all laws pertaining to public works, including but not limited to prevailing wages. Contractors seeking prequalification must have successfully completed similar projects, as defined herein, for public agency owners. To be deemed prequalified, the Contractor must be regularly engaged in the business of construction and renovation of hospitality projects which include a commercial kitchen and shall have successfully completed a minimum of four (4) similar projects in the last five (5) years. 1 of 15 d3 1'1 i 1`ii'.0 AI ad,ii .s'dit \ For purposes of this prequalification package, a "similar project" is defined as follows: 1. Construction cost at the bid date was a minimum of 3M; 2. Scope of work included expansion of building footprint, renovation of existing facilities, demolition, and a commercial kitchen (of particular interest are projects where the facility remained operational during construction); 3. Contractor seeking prequalification must have been the general contractor on the project, using the same license number as that seeking prequalification. (Note: Projects completed by present employees of the Contractor for former employers are not acceptable); and 4. At least two (2) of the four (4) projects must have been a public work, owned and administered by a public agency. Contractor must possess a valid and current California Contractor's license (Class B — General Contracting) and the license must be in good standing at the time of submittal of the prequalification package. As provided in Public Contract Code Section 20101, completed prequalification packages and financial information are not public records and will not be open to public inspection. All information provided will be kept confidential to the extent permitted by law. Each prequalification package must be completed with all information requested and be signed under penalty of perjury by an individual who has the legal authority to bind the Contractor on whose behalf that person is signing. Pre -qualification packages must be received by Heather Buck, in the offices of the Redevelopment Agency located at 73-510 Fred Waring Drive, Palm Desert, CA 92260 before 4:00 p.m. on Monday, the 141" day of June 2010. Prequalification packages received after that time will be returned unopened, and the Contractor will not be eligible to participate in bidding for the contract to construct the Project. Incomplete or unsigned prequalification packages will be returned without review and the Contractor will not be eligible to participate in bidding for the contract to construct the Project. Where a timely and completed prequalification package results in a determination of non- prequalification, an appeal can be made. An appeal is begun by the Contractor delivering written notice to the Agency's Project Coordinator, Heather Buck, of its appeal of the decision with respect to its prequalification rating, no later than five (5) calendar days after adoption by the Agency of the qualified bidders list for the Project. Without a timely appeal, the Contractor waives any and all rights to challenge the decision of the Agency, whether by administrative process, judicial process or any other legal process or proceeding. If the Contractor gives the required notice of appeal and requests a hearing, the hearing shall be 2of15 „''I P Y 4 I”. s . • k0, iti ,-,-, pi Al !F"' ., f l �N conducted so that it is concluded no later than five (5) calendar days after the Agency's receipt of the notice of appeal. The hearing shall be an informal process conducted by a panel (the "Appeals Panel"). At or prior to the hearing, the Contractor will be advised of the basis for the Agency's prequalification determination. The Contractor will be given the opportunity to present information and present reasons in opposition to the determination. Within two (2) business days after the conclusion of the hearing, the Agency shall give the Contractor written notice of the outcome of the Appeals Panel decision which will be final and binding. The prequalification package, its completion and submission by the Contractor, and its use by the Agency, shall not give rise to any liability on the part of the Agency to the Contractor or any third party or person. This is not a solicitation for bid. No guarantees are made or implied that the Project will be constructed, either in part or whole. The Agency does not guarantee that the preliminary scope of work identified in the prequalification package will be the same or similar to that scope of work in the actual bid package. The Contractor accepts all risk and cost associated with the completion of the prequalification package without financial guarantee. All pre -qualified contractors will have the option to receive plans and specifications on the proposed project and submit a sealed bid at a future date. Pre -qualified contractors who seek to participate in the bidding process will be required to participate in a mandatory pre -bid meeting and site inspection. The prequalification of prospective bidders will be determined by evaluation of the information submitted by prospective bidders. The Agency may verify any or all information provided in completed prequalification package, consider information provided by sources other than the prospective bidder, and conduct such investigations as the Agency deems appropriate to assist in the evaluation of contractor's responsibility, qualifications and financial capacity. The contract for construction of the Project may be awarded, if at all, to the responsible, pre - qualified Contractor submitting the lowest responsive bid. Neither issuing the Notice nor any other activity related to the pre -qualification process, obligates the Agency to award a contract for construction of the Project to a particular Contractor, or at all. The Agency reserves the right to reject any or all prequalification packages and to waive any irregularities in any prequalification package submittal. The Agency reserves the right to determine that any Contractor is not qualified at any time before or after the prequalification packages are received and evaluated if it finds that any information it provided is inaccurate or false, or upon evidence of collusion or other illegal practices on the part of a contractor. The Agency, in its sole discretion, expressly reserves the right to cancel the prequalification process at any time, including but not limited to, after the deadline for the receipt of prequalification packages, reject any prequalification packages received by the Agency and competitively bid the Contract without first prequalifying the bidders. Any objection to the prequalification materials, or explanation desired by a prospective Contractor regarding the meaning or interpretation of the prequalification package and related materials, must be requested in writing by e-mail or facsimile and received before 5:00 p.m., June 8, 2010. Oral explanations or instructions will not be binding unless issued as a formal addendum to the prequalification package. Any information provided to any prospective 3of15 Contractor concerning a solicitation will be furnished to all prospective contractors who requested a prequalification package. By submitting a completed Pre -qualification Package, the prospective Contractor waives any and all objections to the form and content of the Pre - qualification Package. To be considered for prequalification the following form must be filled out entirely and all information requested in the form must be attached to the Contractor's submittal. A determination of qualification shall be made on a "Pass/No Pass" basis. Staff has conducted a pre -qualification process for the Desert Willow Kitchen project to qualify general contractors to bid on the above -mentioned project. The pre -qualification application required that general contractors provide four similar scope projects in excess of $3 million that have been completed in the last five years. Two of these projects must be public works projects.
