3. Authorize Staff to solicit bids for construction; and
4. Authorize the release of the RFP for operations of the said project.

Funds for the original design service contract are available in Account No. 233-4602-
454-4001(±40 percent), Park Fund; and Account No. 851-4549-454-4001 (±60 percent),

Project Area 2 Aquatic Facility Capital Budget. Funds for Contract Amendment No. 1
are also available in Account No. 851-4549-454-4001 held as contingency. No General
Fund money is being used for this expenditure.
Parks and Recreation Commission Recommendation
The Parks and Recreation Commission requested an update of the Aquatic Center at its
May 18, 2010, special meeting. At the conclusion of the presentation by staff, the
Commission discussed many aspects of the Aquatic Center including the need for
additional recreational features to help in offsetting operational costs. Even though there
is an operation fee study being performed by Ballard*King & Associates from Colorado
with the assumption of recouping 60 percent of the operation cost, the Commission felt
strongly that the 60 percent recovery marker for the pool should be higher and having
additional recreational features could accomplish that. At the conclusion of the
discussion, the Commission formed a subcommittee to study the current design and
report back to the Commission.
At its regular meeting of June 1, 2010, the Parks and Recreation Subcommittee
reported back to the Commission on their findings. The Subcommittee felt that due to
the financial constraints surrounding the project, asking for additional features in the
Aquatic Center would not be feasible at this time. However, Commissioners expressed
that now would be an opportune time to add infrastructure to the project that would
accommodate future expansions. It was also the recommendation of the Subcommittee
to increase the site area further to the south, which would give a defined area for future
expansion (see attached site map). The Commission supported sending the
recommendation to the City Council for additional recreational features and expanded
site area.
Background
On December 10, 2009, the City Council approved a contract with Gould Evans
Associates in an amount not -to -exceed $992,700 for design and construction support
services, and a 10 percent contingency of $99,270 for the City's Aquatic Center project.
On March 24, 2010, the City Council convened for a special joint meeting with the
Planning Commission and approved the pool layout (see attached original pool layout).
The layout included a competition pool on the west side south of the Date Grove, a
children's splash pool with play structure on the northeast corner south of the Date
Grove, a therapy pool immediately south of the splash pool, and a slide structure
between the therapy pool and competition pool at the south end of the project site.
On April 7, 2010, the design consultant received comments back from the Riverside
County Health Department stating that splash pool with play structure would need to be

completely separated from the therapy pool. Subsequently, the splash pool was
redesigned to be separated from the therapy pool. Due to this separation, one of the
council members at the April Aquatic Center Committee meeting suggested moving the
splash pool closer to the slide structure for better parental monitoring. In order to
accommodate this, a redesign of the pool deck layout, lawn areas, deck drain locations,
and the slopes and locations of some of the pool area walls was required (see attached
revised pool layout).
On May 26, 2010, the design consultant submitted the request for additional services in
the amount of $23,600, which was negotiated from an initial request of $33,600. Due to
the tight schedule for this project, the City Manager has authorized the amendment.
Fiscal Analvsis
The request for additional services results in a potential increase of $75,000 in
construction cost. To keep the project under budget, this potential increase is offset by
implementing some cost -saving options such as changing the exterior wall type from
concrete to masonry, reducing the size of the roof overhang slightly, and changing
some of the irrigation features. The latest overall design and construction cost estimate
for the entire project, including this additional service request, is approximately
$10,500,000.

As follows:
The referenced Additional Service is based on the City's request to have the recreation/therapy pool revised in order
to have the entry steps into the pool on the West side in lieu of the original location on the East side. The original
location was approved at the joint council meeting on March 24th, 2010 which also had the children's splash pool to
the North of the Therapy pool. This change affected the slopes and locations of some of the pool area walls, which
required redesign by the pool consultant and structural engineer to the therapy pool. The change also impacted the
pool deck layout, lawn areas and dock drain locations which required reworking of the site background for all
consultants. This change has taken some additional effort by our team to incorporate and is reflected below.
The following adjustments shall be made to compensation and time.

Because the design consultant received comments back from Riverside County Health Department stating that Splash

This Professional Service Amendment covers changes to the subject contract as described herein. The Consultant
shall perform all work as necessary or required to complete the Professional Service Amendment items for a not -to -
exceed price agreed upon between the Consultant and the City of Palm Desert, otherwise referred to as Owner.
Contract Time Extension: None Days.
Revised Contract Total $1,016,300.00.
The undersigned Consultant approves the foregoing Professional Service Amendment # 1 as to the changes, if any, in
the contract price specified for each item including any and all supervision costs and other miscellaneous costs
relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on
account of said Professional Service Amendment # 1. The Consultant agrees to furnish all labor and materials and
perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required
to complete the Professional Service Amendment items. This document will become a supplement of the contract and
all provisions will apply hereto. It is understood that the Professional Service Amendment shall be effective when
approved by the Owner.
Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that
fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or
equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown,
including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of
productivity, as well as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
