Authorize the Chairman to execute Contract No. R30070 with the lowest responsive bidder in the amount not to exceed $ (verbal recommendation to be provided) for tenant improvements for the new Visitor Center located at 73-470 El Paseo, Suite 14; 2. Authorize the Finance Director to set aside the amount of $ (verbal recommendation to be provided) as 10 percent contingency; and 3. Appropriate $ from the Agency's Economic Development Rental Services/Facilities Fees Unobligated Funds to Account No. 850- 4430-422-3421. Executive Summary On June 12, 2010, the Agency Board authorized staff to proceed with the process of relocating the Visitor Center operation to 73-470 El Paseo, Suite 14. The move would facilitate the opening of a satellite facility by Palm Springs Art Museum at the existing Visitor Center site located at Entrada del Paseo. The relocation of the Visitor Center to El Paseo requires tenant improvements to alter the interior from a former real estate office to a Visitor Center. Staff requests the Agency Board authorize the Chairman to execute a contract for construction of the necessary tenant improvements to the El Paseo building based on the results of the bid opening scheduled for September 7, 2010. Staff will provide a verbal recommendation. Staff Report Award Contact No. R30070 Visitor Center Tenant Improvements September 9, 2010 Page 2 of 3 Background On June 23, 2010, Prest-Vuksic Architects (PVA) was hired to design and prepare construction documents for the tenant improvements required at the proposed 1,972 square foot Visitor Center located at 73-470, Suite 14. The design scope includes, but is not limited to the following components: • Demolition of existing interiors that formerly housed real estate offices. • Addition of a unisex public restroom to serve El Paseo and Visitor Center customers. • Addition of storage space to accommodate retail and informational materials. • Creation of a functional front counter with incorporated workstations for staff. • Design of display areas for informational materials and retail fixtures. • Maintaining of small break room/kitchenette. • Reduction of manager's office to accommodate additional storage. • El Paseo quality construction and materials and would provide for a look and feel consistent with the existing Visitor Center and other City facilities. • Basic materials in back -of -house areas while allowing public areas to be built to a higher standard. PVA completed the design work and on August 7, 2010, Agency staff published a notice in The Desert Sun inviting sealed bids for the tenant improvement project. A pre -bid conference was held at the site on August 13, 2010. Bids are scheduled to be opened on September 7, 2010. A complete summary of the bid results and a verbal recommendation will be provided to the Agency Board at its September 9, 2010 meeting. If the project is approved, the Visitor Center will relocate from its existing 8,200 square foot building to the 1,972 square foot El Paseo site while maintaining services and a retail program at the same quality our customers have come to expect. This will include a full selection of area information, Wi-Fi access, local publications for resale, souvenir items, and helpful, knowledgeable staff. The design will provide a functional lobby/retail area to accommodate a substantial volume of visitors and a refined retail program. Schedule If the contract is awarded to the lowest responsive bidder at the September 9, 2010 meeting, the project would commence by mid -September with a 60 day construction period. The estimated completion date is November 15, 2010, with the move -in date to follow immediately. This schedule accomplishes staffs timeline of relocating the Visitor Center prior to the beginning of peak season and the Palm Springs Art Museum's goal of commencing its lease this fall. WITNESSETH RECITALS: CONTRACTOR has submitted to OWNER its CONTRACTOR's Proposal for the construction of OWNER's Project, 1. CONTRACTOR shall commence the work within five (5) calendar days after the date of the Notice to Proceed and will do all things necessary to construct the work generally Contract No. R30070 described in Recital No. 1 in accordance with the Contract Documents and will complete said work within sixty 60 consecutive calendar days from the Notice to Proceed date to the satisfaction of the Owner's Representative. 3. That the CONTRACTOR agrees to indemnify, defend, and hold harmless the OWNER, and its officers, and employees, the ARCHITECT, Owner's Representative from any and all claims and losses accruing or resulting to any and all contractors, subcontractors, material men, laborers, and any other person, firm or corporation furnishing or supplying work, services, materials or supplies in connection with the performance of this Agreement. 4. Attention is directed to Section 00700-6.5, "Liquidated Damages" of the General Conditions. Liquidated damages shall be $1,500 dollars per calendar day of delay. 5. Should any litigation or arbitration be commenced between the parties concerning the works of improvements as referenced herein, the prevailing party in any such litigation, being the OWNER or the CONTRACTOR, should be entitled to a reasonable sum for attorney's fees and costs incurred in any such litigation relating to this Contract. 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 7. CONTRACTOR shall be paid in the manner set forth in the Contract Documents the amount of its proposal as accepted by OWNER, subject to such additions and deductions as may be made pursuant to the Contact Documents and applicable law. 8. Execution of the Agreement by the parties constitutes their agreement to abide by all applicable provisions of the California Labor Code; constitutes CONTRACTOR's certification that he is aware of the provisions of said Code and will comply with them; and further constitutes CONTRACTOR's certification as follows: "I am aware of the provisions of Section 3700 of the California Labor Code which requires every employer to be insured against liability for worker's compensation or to undertake self insurance in accordance with the provisions of that Code, and I will comply with such provisions before commencing the performance of the work of this contract."
