Recommendation
By Minute Motion:
1. Authorize the Executive Director to execute Contract Amendment No. 1
with the Barnhart Balfour Beatty for construction management services for
the Desert Willow Lakeview Terrace and Kitchen/Building Expansion
projects in an amount not to exceed $17,840 and an additional amount
not to exceed $2,500 for reimbursable expenses;
2. Move $17,040 from the budgeted contingency to contract base;
3. Appropriate $3,300 from the Unobligated Project Area No. 2 Fund to
Redevelopment Agency (RDA) Post Construction Costs, Account No.
851-4663-454-4001; and
4. Authorize the Executive Director to execute the contract amendment.
Executive Summary
Approval of staff's recommendation will authorize the Executive Director to execute
Contract Amendment No. 1 in the amount not to exceed $17,840 with Barnhart Balfour
Beatty for construction management services, plus $2,500 for reimbursable expenses for
the Lakeview Terrace and Expansion project at the Desert Willow Golf Resort.

Background
Design of the Desert Willow Lakeview Terrace and Kitchen Expansion were authorized in
early 2010. Design of the Lakeview Terrace was completed by SMS Architects, which
increases the outdoor terrace seating capacity by 100 seats and banquet capacity by 250.
In addition, the expansion adds flexibility to host multiple events simultaneously while
preserving the ability to service residents and guests.
The design of the kitchen/building expansion was completed by MDR Architects and
expansion includes the following components:
• Remodel of the existing lobby/bar area to accommodate an expanded bar area with
the relocation of two offices.
• Expansion of the lobby/ballroom hallway to eliminate the pinch point.
• Enclosure of the existing ballroom to reduce noise.
• A 5,264 square foot expansion to the kitchen/building at the east end of clubhouse.
• Modification to the ballroom audio visual, window shading, and lighting.
On March 25, 2010, the Agency Board authorized a contract with Barnhart Balfour Beatty
for construction management services for the Desert Willow Lakeview Terrace and
Kitchen/Building Expansion projects in an amount not to exceed $170,400 and an additional
amount not to exceed $3,500 for reimbursable expenses.
The contract included construction management services for the two projects (Lakeview
Terrace and Kitchen/Building Expansion) and included the following tasks:
• Performance of constructability review.
• Review of schedule/phasing/budget.
• Bidding and negotiation assistance.
• Preparation and issuance of addenda.
• Conduct the progress meetings, and special meetings as required during the
construction phase of project.
• Identification of potential change orders.
• Review and recommendation of pay applications.
• Periodic review of the as -built documents.
• Field visits and site observations during construction.
• Coordination with the testing and inspection lab(s), contractor(s), architects and the
City inspectors.
• Conducting the final inspection to determine that the contractor's work is complete.
• Reviewing and responding to correspondence prepared by the construction
contractor(s).
• Monitoring and logging the request for information (RFIs), submittals, and field
orders.

Contract Amendment No. 1:
The proposed contract amendment allows for additional construction management services
for the Lakeview Terrace only. The terrace expansion was scheduled to commence in July
2010, with a 75-day construction period and completion by September 2010.
In July 2010, the Agency Board awarded a contract to GHA Holdings to commence
construction of the terrace expansion. In August 2010, the Agency Board rescinded a
contract with GHA Holdings as they failed to produce the necessary bonding per the project
specifications causing a minor delay. The Agency Board awarded a contract to the next
response bidder DavisReed.
The proposed contract amendment includes additional construction management services
for the months of October and November in the amount of $17,840, which coincides with
the delay experience at the beginning of the project and project delays experienced due to
unforeseen site conditions such as relocation of a 12" golf course irrigation line, discovery of
mold in existing column, and additional scope added by Change Order No. 1.
Staff recommends that the Agency Board authorize the Executive Director to execute
Contract Amendment No. 1 in the amount not to exceed $17,840, plus an additional $2,500
for reimbursable expenses with Barnhart Balfour Beatty for additional construction
management services for the Lakeview Terrace expansion at the Desert Willow Golf Resort.
Fiscal Analvsis
Funds are available in the Unobligated Project Area 2 Fund; therefore, there is no
immediate fiscal impact to the General Fund.

This Contract Amendment covers changes to the subject contract as described herein. The consultant shall perform
all work as necessary or required to complete the Contract Amendment items for a lump sum price agreed upon
between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner.
Contract Time Extension -0- Days.
Revised Contract Total $194.240.00
The undersigned Consultant approves the foregoing Contract Amendment # 1 as to the changes, if any, in the
contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to
the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Contract Amendment # 1 . The Consultant agrees to furnish all labor and materials and perform all other necessary
work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Contract
Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is
understood that the Contract Amendment shall be effective when approved by the Owner.
Execution of this Contract Amendment by the Consultant constitutes a binding accord and satisfaction that fully
satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity,
arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not
limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well
as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
