Recommendation
By Minute Motion, that the Agency Board receive and file this report
pursuant to Section 33433 (c) of the Health and Safety Code.
Background
Resolution No. 03-34, was adopted on April 10, 2003 authorizing the Agency to sell
small housing projects in accordance with Health and Safety Code Section 33433(c).
Any Agency that has sold or leased a small housing project is required to file a report
with the legislative body after the end of the fiscal year which discloses; (i) the name of
the owner/purchaser of the property, (ii) the legal description or street address of the
property, (iii) the date of the conveyance of the property, (iv) the restrictions posed by
the agreement on the owner/purchaser of the property, and, (v) the date on which the
Agency held its public hearing on the conveyance of the property, pursuant to Section
33431.
The following property was sold during the fiscal year 2010/2011 and meets the
definition of a "small housing project" because the property was sold to persons or
families of low or moderate income. The Agency conveyed the property pursuant to
Health and Safety Code Section 33433(c) and 33431.
The property was restricted by an Affordable Housing Restriction and Lien Agreement
("AHRLA") which was recorded at the time of sale which limits, among other things,
affordability, encumbrances, transfers and resales for a period of up to 45 years.

The Agency currently owns 13 properties (9 in Falcon Crest and 4 in Desert
Rose). The Agency is also in negotiations on 4 additional properties in the two
developments.
Staff recommends that the Agency Board receive and file this report pursuant to Health
and Safety Code Section 33433(c).
Fiscal Analysis
There is no fiscal impact to the Agency to receive and file this report.
