Civic Drive, Suite 10 Palm Springs, CA 92262 DATE: March 10, 2011 CONTENTS: Professional Services Amendment Recommendation By Minute Motion: Authorize and Ratify Contract Amendment No. 1 in an amount not to exceed $7,500 to Interactive Design Corporation (Contract No. R29410A) for Professional Architectural Services; and 2. Authorize the Director of Finance to transfer funds from contingency to base in the amount of $7,500. Funds are available in the Palm Desert Housing Authority Capital Budget for the Carlos Ortega Villas, Account No. 871-8691-466-4001. Backqround On April 8, 2010, the Palm Desert Redevelopment Agency Board ("Agency Board") authorized the Executive Director to negotiate and finalize a Professional Services Agreement with Interactive Design Inc. for architectural services for the Carlos Ortega Villas in an amount not to exceed $734,450 along with reimbursable expenses in an amount not to exceed $36,722. With the action the Agency Board also authorized the establishment of a contingency in an amount not to exceed $75,000 for the purpose of design modification and investigation/implementation of energy efficiency/sustainability measures not identified at the time of contract execution, and requires additional approval to be utilized. Amendment No.1 March 10, 2011 Page 2 of 2 Throughout the Request for Proposals ("RFP") and contracting process the Palm Desert Redevelopment Agency has emphasized that the Carlos Ortega Villas will be a flagship project, incorporating the latest in energy efficiencies into both design and construction with the ultimate goal being a net zero project. In an effort to achieve this goal the Palm Desert Redevelopment Agency, in conjunction with Interactive Design, has contacted and meet with the California Institute for Telecommunications and Information Technology, University of California Irvine ("UCI") or Calit 2. The Calit 2 project at UCI is part of a greater University of California program to explore, test, and develop new energy measures. Calit 2 specializes in electrical and electronic applications and efficiencies, through collaborative efforts staff hopes to utilize UCI's cutting edge knowledge and product information to reach the goal of net zero energy usage at the Carlos Ortega Villas. Staff recommends approval of the contract amendment in an amount not to exceed $7,500 (Contract No. R29410A) with Interactive Design in order to facilitate additional project energy efficiency research, not contemplated during the initial RFP or contracting processes. Fiscal Analvsis The fiscal impact to the Agency at this time is solely the contract not to exceed the amount of $7,500. These funds are available in the project contingency. The consultant shall perform all work as necessary or required to complete the Contract Amendment items for a lump sum price agreed upon between the Consultant and the Palm Desert Housing Authority, otherwise referred to as Owner. Contract Time Extension -0- Days. Revised Contract Total $741.950.00 The undersigned Consultant approves the foregoing Contract Amendment # 1 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Contract Amendment # 1 . The Consultant agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Contract Amendment items.
