Recommendation
By Minute Motion:
1. Approve Professional Services Contract Amendment No. 1 to Contract
No. R 30910 with Sladden Engineering in the amount not to
exceed $13,147.55 for special inspections and soil compaction testing
services for the Desert Willow Kitchen and Building Expansion and
Lakeview Terrace Expansion; and
2. Authorize the Chairperson to execute said amendment.
Funds are available in the Post Construction Costs Fund, Account No.
851-4663-454-4001.
Background
On June 29, 2010, the Executive Director approved a contract with Sladden
Engineering in the amount of $24,079.00 for Special Inspections and Soil Compaction
Testing Services for both the Desert Willow Kitchen and Building Expansion and the
Lakeview Terrace Expansion Projects. Sladden Engineering was on the Master
Consultants list and was familiar with these projects due to their involvement in the
design specification process.

The Desert Willow Kitchen and Building Expansion and Lakeview Terrace Expansion
Projects are now complete. However, construction projects involving renovations and/or
expansions are subject to unforeseen field conditions that are often discovered during
construction. These field conditions often require retrofitting and design modifications to
meet current building codes, and to avoid conflicts with the proposed design.
Additional testing and inspection services were required for both projects due to
increased scope, design modifications, and existing field conditions. One example of an
unforeseen field condition was the discovery of a deteriorated concrete slab that was
engineered to be joined with the new kitchen slab using rebar and epoxy. However, the
existing slab had to be removed and additional testing and inspection services were
required.
The total amount of additional testing and inspection services requested is $13,147.55
above the original contract amount. A portion of these additional services is being
recovered from one of the Contractors due to concrete re -pours and additional
inspections required due to unacceptable finishes and ponding. Staff recommends
approval of a Contract Amendment No. 1 in the cumulative amount of $13,147.55. This
amendment will closeout all remaining work for both projects.
Fiscal Analvsis
Funds are available in the Post Construction Costs Fund. The project is funded with
Redevelopment Agency funds; therefore, there is no fiscal impact to the City's General
Fund. Staff recommends approval.

This Contract Amendment covers changes to the subject contract as described herein. The consultant shall perform
all work as necessary or required to complete the Contract Amendment items for a lump sum price agreed upon
between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner.
Contract Time Extension -0- Days.
Revised Contract Total $37,226.55
The undersigned Consultant approves the foregoing Contract Amendment # 1 as to the changes, if any, in the
contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to
the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Contract Amendment # 1 . The Consultant agrees to furnish all labor and materials and perform all other necessary
work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Contract
Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is
understood that the Contract Amendment shall be effective when approved by the Owner.
Execution of this Contract Amendment by the Consultant constitutes a binding accord and satisfaction that fully
satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity,
arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not
limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well
as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
